Relevant facts emerging during hearing: Both the parties are present and heard through video conference. Appellant sought the above information by filing an RTI application dated 27.08.2013. PIO vide reply dated 27.09.2013 asked the appellant to deposit requisite fee for getting copy of the desired document. FAA vide order dated 12.12.2013 directed the PIO to provide the information to the appellant within 10 days of receipt of his order. Having not received any response from the PIO in compliance of FAA order, the appellant filed second appeal before the Commission. Appellant submitted that only information in respect of point No.1 & 2 has been provided and the rest of the information at point 3 to 9 has not been provided to him till today. Respondent submitted that in compliance of FAA order, reply was sent to the appellant on 04.02.2013 and information on point No.1, 2 & 7 has been provided. With respect to point No.3, the appellant sought copy of ACR of all the candidates which was not provided u/s 8(1)(j) of the RTI Act, 2005 and for the remaining points he submitted that as the post was filled in only on adhoc basis, hence the information provided to point No.1 & 2 cover all other points. Decision: After hearing both the parties and on perusal of record, the Commission is of the view that the information sought and permissible under the RTI Act has been provided to the appellant.
