Sri Kankanala Ramabrahmam, S/o. Late K.Butchiyya, R/o. Yarazerla Village, Ongole Mandal,
Prakasham District 523 272 has filed 2nd appeal dated 09-04-2014 which was received by this Commission
on 17-04-2014 for not getting the information sought by him from the PIO / The Assistant Divisional
Engineer, Operation, Rural Sub Division-2, APSPDCL, Ongole, Prakasham District and 1st Appellate
Authority / O/o. The Divisional Electrical Engineer, APSPDCL, Operation Circle, Ongole, Prakasham
District.

The brief facts of the case as per the appeal and other records received along with it are that the
appellant herein filed an application dated 25-09-2013 before the PIO requesting to furnish the information
under Sec.6(1) of the RTI Act, 2005, on the following points mentioned in his application:
The Divisional Electrical Engineer, Operation, APSPDCL, Ongole transferred the 6(1) Application of the
Appellant
to
the
Assistant
Divisional
Engineer/Operation/RSD-2/Ongole
vide
Memo
No.DEE/O/OGL/Tech/F.RTA/D.No.3682/13 dated 15-10-2013 to furnish information to the Appellant.

The Public Information Officer / Assistant Divisional Engineer/Operation/RSD-2/Ongole informed
the Appellant vide Lr.No.ADE.O.RSD-2.OGL.F.RTI.D.No.3008/13 dated 11-11-2013 that certain
information is called for from the Asst.Accounts Officer/ERO/Rurals/Ongole and the Assistant
Engineer/O/Rural/Ongole. The information shall be furnished soon.

Since the appellant did not receive the information from the Public Information Officer, he filed 1st
appeal dated 23-12-2013 before the 1st Appellate Authority requesting him to furnish the information
sought by him u/s 19(1) of the RTI Act, 2005.

The Divisional Engineer / Technical, Operation Circle, APSPDCL transferred the appeal dated 2312-2013 to the PIO / O/o. Divisional Engineer, Operation Division, APSPDCL, Ongole to furnish
information to the Appellant immediately.

The appellant stated that as he did not get the information from the 1st Appellate Authority even
after 30 days of filing his 1st appeal, he preferred this 2nd appeal before this Commission requesting to take
action against the PIO and 1st Appellate Authority for not furnishing information sought by him and also to
arrange to furnish the information sought by him u/s 19(3) of the RTI Act, 2005.
The 2nd appeal was taken on file and Notices issued to both the parties for hearing on 4-7-2014.
On 4-7-2014 the case is called. The Appellant is absent. The Respondent, PIO / is present. The 1st
Appellate Authority is absent. The PIO represents that part information was furnished to the appellant on
02-7-2014. As per the records placed before the Commission, the 1st Appellate Authority had failed to hear
the case and pass appropriate orders on the 1st appeal filed before him. Issue Show Cause Notice, to the
PIO for not furnishing information in time.
