Relevant facts emerging during hearing: Complainant is not present. Respondent is present. Complaint filed an RTI application dated 17 September 2013 seeking above information. Having not received any reply from PIO, complaint filed complaint u/s 18 of the RTI Act. Respondent from External Service Division, All India Radio, submitted that the RTI application was transferred to CPIO, Women Cell Directorate General, AIR, New Delhi on 17.10.2013, under intimation to the appellant. He further submitted that the complainant has not preferred the first appeal and has approached the Commission directly. PIO, Women Welfare Cell submitted his written submissions dt 4.9.14, during the hearing, which were taken on record. PIO submitted that the information sought was provided to the complainant in an earlier RTI filed by the complainant. Interim Decision: After perusing the written submission dated 04.09.14 of the PIO, the Commission finds that in reply given by the PIO in response to another application of the complainant, complete information sought has not been provided. The Commission directs PIO Women Welfare Cell, All India Radio, to submit written submission, latest by 10th October 2014, to show cause why penalty should not be imposed on him under Section 20 (1) of the RTI Act, for not providing information within the prescribed period under the RTI Act.
