efficiency report enabling a more efficient use of power
and improved life style without an increase in costs.

*Not all applicants will be eligible as Uniting Communities are governed by
some Government restrictions in term of funding. You are encouraged to submit

Beat the Heat Program
New Government Regulations affecting
Landlords and Tenants
Uniting Communities are a “Not for Profit Organisation”
with a heart for people.
Laws and Regulations are constantly being reviewed by
Government.
In association with Lin Andrews Real Estate and other
research groups, a program called “Beat the Heat” is
being rolled-out to benefit tenants and landlords who are
of a specific profile. Homes occupied by eligible tenants*
may be included in the program with the written consent
of the owner/landlord.
Effective March 1st 2014 a number of changes will
regulate landlord and tenant relationships. The more
important are listed below:
The objective of the program is to provide solutions to
energy consumption costs facing many low income
families.
1.
Rent reviews may not occur randomly during the
course of the lease. A lease amount as specified
at the time of entering the tenancy agreement
shall be binding for the period of the lease unless
specific variations are agreed in writing at that
time.
2.
A property may be sold during the period of a
lease but there are now restrictions as to time
frames for written advice to the tenant and
protection of the tenant in terms of agent/owner
entry to achieve a sale.
3. Lin Andrews Real Estate as your Managing
Agent strongly encourage every owner to install
regulation quality smoke alarms and if there are
alarms already fitted that these be checked to
ensure that they are still functioning correctly.
There are new tenant rights to vacate and
cancel a lease in the event of the property being
placed on the market within six months of the
commencement of tenancy.
To facilitate this we have obtained quotations from
different electricians and have agreed on a price and
level of service and reporting-back from one dedicated
firm.
3. In regard to the growing variety of plant &
equipment which goes into rental accommodation
there are now stringent requirements for the
landlord to provide instruction books for each
appliance. The objective is not only the “how to”
for the usage of each item of plant, but how it
should be maintained and cleaned so the tenant
does not have to meet future claims for alleged
damage in caring for the item under question.

speak to your property manager and determine if you
would like to be a part of this program.
We would be grateful if every property under management
were safe and secure for the use of tenant clients under
every circumstance.
We agree with the changes as they bring residential
tenancy contracts into line with prudent contract law.

Smoke Alarms

interest groups to persuade
us that we as property

legally responsible to have
working smoke alarms in our properties.
The law is a little confusing in that there is no one piece
of legislation to which we may refer.
Known facts are:
1.
When a home is sold it must have smoke alarms
installed and strategically placed within the home
prior to settlement. This applies whether the
home is for letting or for personal use.
2.
The Real Estate Institute of South
Australia together with other
professional bodies recommend
that every leased property should
have adequate smoke alarms installed such that
the owner is protected from common law claims
of negligence in the event of a fire in which a
lessee suffers harm or death.
