Consideration of preliminary and final approval of a land division dividing land owned by
FRED –THE JUNCTION, LLC and a recommendation to the Village Board of Trustees
regarding the Certified Survey Map generally located on the Northside of Roosevelt Drive
approximately ¼ mile east of Water Street, in the Southeast ¼ of Section 3, Tax Key
Numbers 12.998, 12.995, 12.171, 12.202.002, 12.985, 12.202.003 and a portion of the
property identified by Tax Key Number 12.984, Planned Development District No. 2.
History
The Village approved Certified Survey Map (CSM) No. 11216 on July 8, 2014 combining
the properties identified by Tax Key Numbers 12.202.003, 12.202.002, 12.985 and a
portion of Tax Key Number 12.984 into Lot 1 of this Certified Survey Map. Although this
Certified Survey Map was approved and recorded, the Waukesha County Register of
Deeds has not yet assigned a Tax Key Numbers for the Lots contained in CSM No.
11216.
The Village is also in the process to vacate a portion of Hayes Avenue, between Roosevelt
Drive and Pershing Avenue. The Village Board is scheduled to hold a public hearing and
act on this vacation at its meeting on October 6, 2014
Proposed Certified Survey Map
The submitted Certified Survey Map combines Lot 1 of CSM No. 11216 with 3 parcels to
the west of Hayes Avenue, and the lands proposed to be vacated from Hayes Avenue.
The Certified Survey Map then redivides this land into 4 lots each containing a portion of
the White Stone Station Apartment Development.
The four lots range is size between 2.4 acres and 3.1 acres, each complying with the
minimum requirements of Planned District No. 2 – the Zoning District of these lands.
The Village Comprehensive Plan classifies the subject land for “High Density Residential
Development”. This proposal would create four parcels that would be developed,
according to approved plans, in compliance with the Village Land Use Plan.
The application fees have been paid, and no special assessments have been levied on
this property, however the applicant will need to pay the recording fees prior to the
document being recorded with Waukesha County.
Since the submitted Certified Survey would redivide 4 existing parcels into 4 new lots,
the number of parcels is not increasing and as such the fee in lieu of dedication is not
required.
Staff Comments
The Police, Fire, Community Development, and Engineering Departments, as well as the
Director of Utilities have all reviewed and approved the submitted Certified Survey Map.
The Financial Services Department states the subject parcel does not have any
outstanding special assessments.
The Engineering Department states:

The Certified Survey Map will need to dedicate 5 additional feet of right of way
along Roosevelt Drive so that the Northern ½ of the right of way is 30 feet wide.
This needs to be shown on the southwest corner of Lot 1 and Lot 4.
The WE Energies easement along the west side of Lot 4 needs to be identified.
A Temporary Easement must be placed over the sanitary sewer in and near Hayes
and Pershing Avenues until the sanitary sewer is discontinued.
A portion of Hayes Avenue, north of Roosevelt Drive is proposed to be vacated.
The Village Board of Trustees is scheduled to act on this item at their October 6,
2014 meeting. This Certified Survey Map will need to be updated to show the
vacated right of way split between abutting property owners – if the Village Board of
Trustees approves this vacation.
The Department of Community Development has found:
 The title of each page should be updated to reference CSM No. 11216 instead of
“_____”.
 All adjoining lands must be identified. The lands to the north and east must be
identified as CSM No. 11216. The lands on the northwest corner of Hayes and
Roosevelt need be identified. The abutting parcel configuration to the northwest
of Lot 4 is incorrect and mislabeled.
 The Owner’s Certificate lists “FRED – The Junction, LLC” as the owner but has a
signature line for the President of “Fiduciary Real Estate Development, Inc.” The
signature line must be revised for the proper signatory of the stated owner.
 If the Certified Survey Map is approved, the applicant will need to pay the
recording fee in the amount of $10 per page.
 Since the lands would be dedicated to the Village for right of way purposes, the
Village Board of Trustees will need to accept the dedications and approve the
Certified Survey Map. As the following signature lines must be added:
VILLAGE BOARD APPROVAL
RESOLVED that the Certified Survey Map of FRED – The Junction, LLC,
owner of said lands, being a part of the Northwest ¼ and the Northeast ¼ of
the Southeast ¼ of Section 3, T8N, R20E, Village of Menomonee Falls,
Waukesha County, Wisconsin, having been approved by the Plan
Commission and the same is hereby approved and the dedication contained
herein accepted by the Village Board of Trustees of the Village of
Menomonee Falls. On ____________, 2014
Recommendation
Since the proposed Certified Survey Map is in compliance with the Comprehensive
Plan, and conforms to the existing zoning district, Staff recommends the Plan
Commission approve the Land Division and recommend the Village Board of Trustees
approve the Certified Survey Map subject to the following conditions:
1. Dedicating 5 additional feet of right of way along Roosevelt Drive along the
Southwest corner of Lots 1 and 4.
2. Identifying the WE Energies Easement along the west side of Lot 4.

3. A Temporary Easement must be placed over the sanitary sewer in and near Hayes
and Pershing Avenues until the sanitary sewer is discontinued, and this easement
must be shown on the Certified Survey Map.
4. Correctly showing the exterior boundaries of the parcels on the North side of
Roosevelt Drive near Hayes Avenue, if the Village Board of Trustees vacates the
Hayes Avenue right of way north of Roosevelt Drive.
5. Updating the title of each page to reference CSM No. 11216.
6. Correctly identifying all adjoining lands, and filling in the CSM Number on the
abutting properties.
7. Correcting the Owner’s Certificate to contain a proper signature line for “FRED –
The Junction, LLC”.
8. Submitting the recording fee in the amount of $40
