NOTIFICATION Clause (d) of section 4 of the Explosive Act, 1884 (IV of 1884), the term “ Explosive” includes “ Fire Works” Section 5 of the said Act, 1884, empowers the central Government to frame rules for the manufacture, possession, use, sale, transport, import and export of explosives. In exercise of the powers conferred by section 5 of the Explosives Act, 1884, Central Government framed the Explosive Rules, 2008. Rule 7 of the said Explosive Rules, 2008 provides that no person shall manufacture, import, export, transport, possess for sale or use an explosive except as authorized or license under these rules. As per provision contained under rule 99, read with paragraph 5(b) of Schedule-IV of the said rules, I Rajeev Kumar, Commissioner of Police, Bidhannagar, am authorized to grant license for possession and sale from a shop, at any one time, not exceeding 100 Kilograms of manufactured fireworks of Class 7, Division 2, sub-division 2. Sub-rule (1) of rule 6 of the said rules provides that no person shall import, transport, manufacture, possess, use or sale any explosive, unless it has been declared as an authorized explosive by an order issued by the Chief Controller and published by the Central Government in the official Gazette. Thus, dealer in fireworks must take appropriate license /permits from the Commissioner of Police, Bidhannagar and other competent Authorities, as the case may be, observing the requirements of the Explosives Act.1884 and the Explosives Rules, 2008. In course of raising/erection of temporary stalls/ sheds etc. and their subsequent use by the allottees, the provisions of the Explosives Act, 1884, and the Explosives Rules,2008, and other terms and conditions subsequently to be imposed at the time of allotment of land as also terms and conditions to be imposed by West Bengal Fire Service should strictly be adhered to. No person shall let off rockets or send up fire balloons or sell fireworks in the vicinity of the temporary fireworks markets/shops in terms of section 9 of the West Bengal Fire Services Act, 1950. I, Rajeev Kumar, Commissioner of Police, Bidhannagar being an Executive Magistrate for the metropolitan areas of Bidhannagar, specially empowered under the Noise Pollution ( Regulation and Control) Rules,2000, being satisfied that it is necessary in order to prevent annoyance, disturbance, discomfort or injury on risk of annoyance, disturbance, discomfort on injury to public, do hereby under rule 8 of Noise Pollution ( Regulation and Control) Rules, 2000 prohibit, within the city of Bidhannagar and its suburban, the carrying, use, sale, trade or possession of banned fireworks in obedience to and in conformity with the orders passed by the Hon’ble National Green Tribunal dated21.08.2013 and 25.09.2013 in connection with the appeals filed by the manufactures/ traders of firecrackers and the subsequent order passed by the West Bengal Pollution Control Board under their Memo No. 1594/3L/WPB-B (III) /2013 ( PART) dated- 09.10.2013 and also subsequent corrigendum No. 1605/3L/WBP-B (III)/2013 (PART) dated- 10.10.2013. In terms of the order passed under Memo No. 1594/3L/WPB-B (III) /2013 (PART) dated09.10.2013 and also subsequent corrigendum under Memo No. 1605/3L/WBP-B (III)/2013 (PART) dated- 10.10.2013. by the West Bengal Pollution Control Board, the dealers of fireworks would not be permitted to sell any fireworks which may create sound more than 90 dB (A) impulse at five meter distance from the point of bursting as the same would result in noise pollution.
