Recommendation
That the Development Services Committee recommend to City Council:

1.
That pursuant to Report DS-14-174 dated September 3, 2014, Plan
20Twenty for Downtown Oshawa be approved as a guide for further
revitalization of the downtown; and,
2.
That staff continue to meet regularly and work with the Plan 20Twenty
steering committee, known as "Group 20Twenty"; and,
3.
That staff report on the progress of Plan 20Twenty for Downtown Oshawa
on an annual basis through the Development Services Committee; and,
4.
That a copy of the Plan 20Twenty for Downtown Oshawa and the related
staff report and Council resolution be posted on the website and sent to
the Downtown BIA, Greater Oshawa Chamber of Commerce, UOIT,
Durham College, Trent University, Durham Workforce Authority, Spark
Centre, Business Advisory Centre Durham, Region of Durham and any
other organization that will be engaged in the implementation of the plan.
Proposed Licence Agreement with the Oshawa Aeronautical Military and

4.
That in accordance with Section 34(17) of the Planning Act and
notwithstanding that the rezoning proposed in the public meeting report
and at the public meeting differs to some degree from that approved by
City Council, such differences are not substantial enough to require further
notice and another public meeting.

application submitted by First Oshawa Holdings Inc. to amend the
Oshawa Official Plan (File: B-3100-0171) to add a site specific policy to
permit a flea market within the Industrial designation at 155 First Avenue
be approved generally in accordance with the comments contained in the
above-noted Report and that the necessary by-law be passed; and,
2.
That pursuant to Report DS-14-163 dated September 3, 2014, the revised
application submitted by First Oshawa Holdings Inc. to amend Zoning
By-law 60-94 (File: Z-2012-08), to rezone 155 First Avenue from GI
(General Industrial) to GI (General Industrial) subject to an appropriate
special condition to permit a flea market and professional offices as
additional permitted uses and certain special zoning regulations be
approved generally in accordance with the comments contained in the
above-noted Report and that the necessary by-law be passed; and,
3.
That in accordance with Section 34(17) of the Planning Act and

Application for Removal of “h-14” Holding Symbol – Phase 3A of Draft Plan of

Recommendation
Whereas on April 27, 2009 Council passed By-law 29-2009 which delegated the
approval of applications to remove “h” holding symbols to the Development
Services Committee subject to the conditions for lifting the holding symbol being
fulfilled to the satisfaction of the Commissioner of Development Services and the
necessary by-law being presented to Council for approval; and,
Whereas the Minto Metropia (Windfields) LP intends to develop single detached
dwellings (10 units), back-to-back townhouses (90 units), street townhouses (81
units) and provide a parkette block and part of a separate elementary school site
in an approved subdivision (S-O-2006-02) on the site (see Attachments 1 and 2);
and,

Whereas the site is zoned R1-E(21)/R3-A(8)”h-14” (Residential), R1-E(21)”h-14”

CIN/R1-D(3) “h-14” (Community Institutional/Residential) which permits single
detached dwellings, street townhouses, back-to-back townhouses and an
elementary school; and,
Whereas the “h-14” holding symbol is in place to ensure appropriate
arrangements are made for the provision of adequate sanitary, water, storm, and
transportation services and facilities to serve this development and a subdivision
agreement is executed; and,
Whereas Minto Metropia (Windfields) LP has submitted an application to remove
the “h-14” holding symbol to advance the issuance of building permits
immediately after the subdivision is registered; and,
Whereas a subdivision agreement will be executed; and,
Whereas the Commissioner of Development Services is satisfied that the
conditions for lifting the holding symbol will be satisfied;
Therefore be it resolved that the application submitted by Minto Metropia
(Windfields) LP to remove the “h-14” holding symbol from the lands located east
of Simcoe Street North and north of Britannia Avenue East for Phase 3A of Draft
Plan of Subdivision S-O-2006-02 to facilitate the development of single detached
dwellings, back-to-back townhouses, street townhouses a parkette block and an
elementary school site be approved and the necessary by-law be passed.

Recommendation
Whereas on April 27, 2009 Council passed By-law 29-2009 which delegated the
approval of applications to remove “h” holding symbols to the Development
Services Committee subject to the conditions for lifting the holding symbol being
fulfilled to the satisfaction of the Commissioner of Development Services and the
necessary by-law being presented to Council for approval; and,
Whereas The Pentecostal Assemblies of Canada the owner of 428 Taunton
Road West intends to develop additional parking on the site for the existing
church at 416 Taunton Road West (see Attachment 1); and,
Whereas the site is zoned, in part, SI-A(1) “h-39” (Select Industrial) which
permits a church use with accessory parking; and,
Whereas the “h-39” holding symbol is in place to ensure the following conditions
are satisfied:

Appropriate provisions have been made for municipal servicing, including
stormwater management issues, and transportation facilities and services;
and
b)
Site plan approval is obtained from the City; and,
Whereas the owner has submitted an application to remove the “h-39” holding
symbol to permit the proposed development; and,
Whereas a site plan agreement has been executed; and,
Whereas the Commissioner of Development Services is satisfied that the
conditions for lifting the holding symbol have been satisfied;
Therefore be it resolved that the application submitted by The Pentecostal
Assemblies of Canada to remove the “h-39” holding symbol for 428 Taunton
Road West to facilitate the development of additional parking for the church at
416 Taunton Road West be approved and the necessary by-law be passed.

Recommendation
Whereas on April 27, 2009 Council passed By-law 29-2009 which delegated the
approval of applications to remove "h" holding symbols to the Development
Services Committee subject to the conditions for lifting the holding symbol being
fulfilled to the satisfaction of the Commissioner of Development Services and the
necessary by-law being presented to Council for approval; and,
Whereas Tribute Communities intends to develop single detached dwellings
(101 units), semi-detached dwellings (2 units) and provide a separate elementary
school site, in an approved subdivision (S-O-2012-01) on the site (see
Attachment 1); and,
Whereas the site is zoned R1-E(24) “h-14” “h-61” (Residential), R2(10) “h-14” “h61”(Residential) and CIN/R2(10) “h-14” “h-61” (Community
Institutional/Residential) which permits single detached dwellings, semi-detached
dwellings and an elementary school; and,
Whereas the “h-14” holding symbol is in place to ensure appropriate
arrangements are made for the provision of adequate sanitary, water, storm, and
transportation services and facilities to serve this development and a subdivision
agreement is executed; and,
Whereas the “h-61” holding symbol is in place to ensure that a Master
Environmental Servicing Plan (M.E.S.P.) is completed; and,

Whereas the Tribute Communities has submitted an application to remove the
“h-14” and “h-61” holding symbols to advance the issuance of building permits
immediately after the subdivision is registered; and,
Whereas a subdivision agreement will be executed and the M.E.S.P. has been
finalized; and,
Whereas the Commissioner of Development Services is satisfied that the
conditions for lifting the holding symbol will be satisfied;
Therefore be it resolved that the application submitted by Tribute Communities to
remove the “h-14” and “h-61” holding symbols from certain lands located west of
Simcoe Street North and north of future Britannia Avenue West for Phase 1B of
Draft Plan of Subdivision S-O-2012-01 to facilitate the development of single
detached dwellings, semi-detached dwellings and a separate elementary school
be approved and the necessary by-law be passed.

Recommendation
That the Development Services Committee recommend to City Council:
That pursuant to Report DS-14-171 dated September 3, 2014, Mr. Howiel Weir,
owner of 91 Bruce Street, be advised that the City of Oshawa respectfully denies
his request for an encroachment to use the Court Street boulevard (west side)
abutting 91 Bruce Street for parking.

Amendments to Industry Canada Procedures for Telecommunications Antennas,
Towers and Related Structures
(See Pages 191 to 204)
Recommendation
That the Development Services Committee recommend to City Council:
1.
That pursuant to Report DS-14-173 dated September 3, 2014, the City’s
Telecommunication Policy be amended as follows to be consistent with
Industry Canada’s new procedures:
(a)
That Section 3.1 be amended to add a new definition of “Height” as
follows:
Height shall mean the height of an antenna system measured from
the lowest ground level at the base, including the foundation, to the
tallest point of the antenna system. Depending on the particular
installation, the tallest point may be an antenna, lightning rod,
aviation obstruction lighting or some other appurtenance. Any

attempt to artificially reduce the height (addition of soil, aggregate,
etc.) will not be included in the calculation or measurement of the
height of the antenna system.
(b)
That Section 4.2 be amended to also require the submission of a
public notification package that includes the information required by
Industry Canada’s Public Consultation Process.
(c)
That Section 4.3(a) be appropriately amended to delete the current
Industry Canada’s exemptions and to specify that the City’s policy
does not apply to the following types of installations, based on
Industry Canada’s exemption criteria:
(d)
(i)
New Antenna Systems: where the height is less than 15
metres above ground level. This exclusion does not apply to
antenna systems proposed by telecommunications carriers,
broadcasting undertakings or third party tower owners;
(ii)
Existing Antenna Systems: where modifications are made,
antennas added or the tower replaced, including to facilitate
sharing, provided that the total cumulative height increase is
not greater than 25% of the height of the initial antenna
system installation. No increase in height may occur within
one year of completion of the initial construction. This
exclusion does not apply to antenna systems using purpose
built antenna supporting structures with a height of less than
15 metres above ground level operated by
telecommunications carriers, broadcasting undertakings or
third party tower owners;
(iii)
Non-Tower Structures: antennas on buildings, water towers,
lamp posts, etc. may be excluded from consultation provided
that the height above ground of the non-tower structure,
exclusive of appurtenances, is not increased by more than
25%;
(iv)
Temporary Antenna Systems: used for special events or
emergency operations and must be removed within three
months of the start of the emergency or special event; and
(v)
No consultation is required prior to performing maintenance
on an existing antenna system.
That Section 4.3(b) be appropriately amended to:

Require the notice to be clearly marked, making reference to
the proposed antenna system, so that it is not misinterpreted
as junk mail and that the face of the package must clearly
reference that the recipient is within the prescribed
notification radius of the proposed antenna system.

That the notification radius be measured from the outside
perimeter of the supporting structure. For the purpose of this
requirement, the outside perimeter begins at the furthest
point of the supporting mechanism, be it the outermost guy
line, building edge, face of the self-supporting tower, etc.

That the notice of the public meeting and notification
package be provided a minimum 30 days before the public
meeting date; and,
That a new Section 4.5 Time Limit for Construction be created to
implement a three (3) year time limit for constructing an antenna
system after the consultation process has concluded in accordance
with Industry Canada’s requirements subject to any extension from
the City.
Proposed Request for Proposal Process for Potential Disposition of 485 and 501
Normandy Street

Recommendation
That the Development Services Committee recommend to City Council:
That pursuant to Report DS-14-175 dated September 3, 2014, staff be directed
to: proceed with the three-stage Request for Proposal process for the potential
disposition of the City owned lands at 485 and 501 Normandy Street, Oshawa;
issue a Request for Expression of Interest in general accordance with
Attachment 2 to said Report; and report back to Development Services
Committee and City Council with the results thereto.

to implement a revised draft plan of subdivision (File: S-O-2012-01), which
proposes block townhouse dwellings, back-to-back townhouse dwellings,
apartments and a community institutional block or Phase 2 on lands and a
revision to allow an alternative residential lot pattern of School Block B in
Phase 1 on lands west of Simcoe Street North and north of Britannia
Avenue West be approved subject to the currently approved Council
conditions set out in Attachment 7 of the above noted report, with the
following revisions:

That the following condition be added as Condition 34(a):
“34.(a) That prior to the first submission or site plan and/or
engineering drawings, the subdivider shall engage an urban design
and landscape architect, satisfactory to Planning Services, to
prepare and submit urban design guidelines to Planning Services
for approval for the lands north of Britannia Avenue West, east of
Blocks L and M and west of Simcoe Street North. The guidelines
should consider pedestrian connections from Street T to Simcoe
Street North and vistas/view corridors to the Windfields Stone
House.”

That condition 42 be deleted and replaced with the following:
“42. That a reserve block be provided along the frontage of
Blocks 1 and S to restrict driveway access to Britannia Avenue
West.”

That Condition 51 be deleted and replaced with the following:
"51. The subdivider shall construct all required bike lanes on
Britannia Avenue West, Street T and part of Street O and bike
routes on Streets A, J, and part of Street O to the satisfaction of
Engineering Services."

That the following condition be added as Condition 70(a):
“70.(a) That the subdivider pay the City an appropriate amount to
satisfy the parkland dedication requirements of the Planning Act for
Blocks S, U, V and X north of Britannia Avenue West and west

That the residential lots shown on the Elementary School
Block(s) only be permitted to be registered after it is proven
to the Planning Services satisfaction that the block is not

Request from the Region of Durham for a Sanitary Easement over City Lands to

Recommendation
That the Development Services Committee recommend to City Council:
Whereas the Region of Durham has requested that the City grant it an easement
over City land (Part 7, Plan 40R-28362) to protect an existing Regional sanitary
sewer to the east of 953 Farewell Street (see Attachment 1); and,
Whereas it is appropriate that the City convey the easement to the Region for a
nominal sum;

to the City Solicitor.

Recommendation
That the Development Services Committee recommend to City Council:
Whereas by letter dated December 4, 2013 A. B. Gil Management Inc. submitted
a request to purchase City owned land adjacent to 1464 Harmony Road North
and north of Missom Gate (DS-13-287); and,
Whereas on December 9, 2013 the Development Services Committee referred
the correspondence to staff for a report; and,
Whereas on June 18, 2014 A. B. Gil Management Inc. advised that it is no longer
interested in purchasing the City owned land;
Therefore be it resolved that the request from A. B. Gil Management Inc. dated
December 4, 2013 be removed from the Development Services Committee’s
Outstanding Items List.
