of partnerships for success

Oceania’s International Basketball Federation (FIBA) secretary general David Crocker
has emphasized the importance of Oceania federations to partner with their National Olympic
Committees (NOCs), schools and governments
in order to further develop basketball in the
region.
Crocker, newly elected to the post, was in the
territory last week for the first time for a site visit
and meet with executives of the American Samoa
Basketball Association and other officials. He
also took time out during his 9-hour stay in the
territory for a Samoa News interview, after he
visited three other Oceania member countries.
He said that Oceania FIBA is taking a different approach when it comes to its relationship
with its member countries “by understanding
what they want to help develop basketball in
their country and not what we want from them.”
Asked what type of resources — including
financial assistance — that is available to
American Samoa and other Oceania federations, Crocker first pointed out that “we don’t
have a lot of money, but we have different types
of resources —people” available to assist each
Oceania federation.
For example, Crocker says that Oceania
FIBA has on their staff a former Olympian,
who is a development officer, and this individual will soon meet with Oceania members
to discuss a number of issues and share some of
her experiences playing in regional and international games.
Asked if the female development officer,
would make it easy for Oceania FIBA to develop
women basketball in the region, he responded
that this is “a big issue, having women participate not only in the game but also officiating the
game and other matters. So it’s something that
we are conscious of.”
As part of his visit to the territory as well
as other Oceania member countries, Crocker also
inspects facilities, such as the basketball court at
Tafuna High School gymnasium used by ASBA.
He explained that facilities continue to be a
challenge for federations in Oceania.
For example, having access to the facility
when its time to play, and another challenge is
having quality venues because some facilities in
Oceania need improvement.
For the Tafuna High School court, he said
that the basketball rims had to be taken off
when there are no games and put back on when
there is a game. “This is a beautiful court — at
Tafuna High School — and the local federation
has made a great contribution into the redevelopment and maintenance of it,” he said. “But it
still needs to go to the next level if basketball in
this country is to reach its potential.”
Asked specifically about the type of financial
resources available, Crocker said Oceania FIBA
has a couple of initiatives “that we run that
come into federations. One of them is a basketball development officer program. Currently we
have ten development officers in the Pacific and
we partner with each Oceania member country,
the NOC or the federation itself of each country.
So the federation has some paid hands to do the
work, while the federation members and executives focus attention on other matters.”

LOS ANGELES (AP) — Embattled Los Angeles Clippers
owner Donald Sterling lost his attempt to block the $2 billion
sale of the team to former Microsoft CEO Steve Ballmer.
In allowing the deal to go forward, Superior Court Judge
Michael Levanas sided Monday with Sterling’s estranged wife,
Shelly Sterling, who negotiated the record sale after the NBA
banned the 80-year-old billionaire for making offensive remarks
about blacks.
Shelly Sterling sought the probate judge’s approval to ink
the deal after taking over the family trust that owns the team
because doctors found Donald Sterling had signs of Alzheimer’s
disease and couldn’t manage his affairs.
The judge said Shelly Sterling had negotiated a good deal and
the removal of her husband as a co-trustee was in good faith and
not part of a secret plan to seize the team.
Shelly Sterling hugged her lawyer and wept after the judge
explained his ruling from the bench.
“I can’t believe it’s over,” she said. “This is the best thing.”
An unusual provision of the ruling bars Donald Sterling from
seeking a court-ordered delay of the sale as he appeals. His lawyers
plan to seek permission from an appellate court to file an appeal.
Sterling was not in court for the ruling. Bobby Samini, one of
his lawyers, said Sterling reacted calmly to the news and told his
lawyers they had to keep battling on other fronts. Sterling testified during the case that he would fight the NBA until his death.
With lawsuits pending in state and federal courts, the ruling
in Los Angeles County Superior Court is unlikely to put an end
to the bizarre saga that began in April when a recording surfaced
of Sterling scolding his young girlfriend for bringing black men
to Clippers games.
The NBA moved quickly to ban Sterling for life and fined
him $2.5 million.
Sterling was apologetic after the audio recording went viral,
but his mea culpa backfired when he criticized Lakers great
Magic Johnson, who had been photographed with Sterling’s
girlfriend, as a bad role model for kids because he had HIV.
Sterling was roundly condemned from locker rooms to the Oval
Office, where President Barack Obama called Sterling’s remarks
“incredibly offensive racist statements.”
With the NBA threatening to seize the team and auction it,
Sterling initially gave his wife of 58 years permission to negotiate a sale but then refused to sign the $2 billion Ballmer deal,

LAS VEGAS (AP) — Derrick Rose says he feels old.
The 25-year-old point guard’s rigorous play on Monday
during the U.S. basketball team’s first practice dictated otherwise.
“I was joking with Kyle Korver, I told him ‘I’m getting old,
man. I’ve got to stretch, I’ve got to use rollers and stuff.’ He
looked at me kind of weird,” Rose said laughingly. “But I feel
a lot more mature. I’ve been preparing for this for a long time.
I’ve dedicated my whole summer to this. I think I’ve sacrificed
a lot for this moment.”
Rose, the Chicago Bulls star who is coming off two knee injuries
that kept him out for much of the last two seasons, said he played
roughly nine minutes of the team’s scrimmage during a two-hour
practice. He added he was excited about how he felt physically.
Coach Mike Krzyzewski was elated with Rose’s play, saying
he was most impressed with his defensive pressure and tenaciousness. “I think Derrick was a great excitement for us, because you
hear about how he’s worked out, but to see him today, I mean,
he put it all out,” Krzyzewski said. “He was playing to exhaustion. That was a big plus for today, to see him. I was pleased that
he didn’t hold anything back. He played his butt off.”
Rose, who played just 10 games last season before his season
was ended by a torn meniscus in his right knee, said he’s spent
much of the summer in Chicago working out, other than a few promotional days in Los Angeles for adidas. He was happy to be back
on the court, playing against and alongside other NBA players.
“I work out a couple hours a day (and) I know how much

Browns put on pads,
get physical in camp
BEREA, Ohio (AP) — Behind his stylish
sunglasses, Browns first-year coach Mike Pettine stayed cool and showed little outward emotion on a day he had been looking forward to for
months.
On the inside, Pettine was glowing.
The Browns practiced in full pads. Real football— at last.
For the first time since training camp opened,
the Browns weren’t just running around the
manicured fields behind their training headquarters in helmets, jerseys and shorts. They wore
shoulder pads, thigh pads, hip pads, knee pads
and whatever other protective padding NFL
players decked out in these days.
Pettine was eager to “hear” practice, and
afterward said he was satisfied with the popping, crunching, hard plastic-on-plastic sounds
that also delighted another overflow crowd of
Browns fans. “I was pleased,” Pettine said. “For
the first day in pads, I thought our guys were
solid. I thought they did a good job of taking
care of each other.”
Pettine had warned his players not to take
things too far. During an inside running drill,
he told his defensive players only to “thud” the
running backs before turning them loose and
allowing them to continue down field.
Several times, coaches yelled “Stay up!” as
they reminded players to remain on their feet
and off the ground.
Once, defensive back Johnson Bademosi got
a little carried away and came up and blasted
wide receiver Nate Burleson near the helmet
after a reception, spinning his teammate around.
Pettine quickly waved his hand under his chin,
signaling for Bademosi to “cut it out” before
someone got hurt.
“It’s football, and sometimes, instincts just
take over to kind of drop the shoulder, but we
don’t want to do that to each other,” Pettine
said. “That still falls to competitive not combative. That stuff’s not going to help them make
the team. We want to be tough. We want to be
nasty, but we want to play within the rules, and
we certainly want to protect each other when
we’re practicing.”
Later this week, the Browns will replicate
game conditions by allowing their defensive
players to tackle runners to the ground.
Pettine wants the Browns to be tough, an
essential characteristic for any team in the AFC
North, home of the Baltimore Ravens, and Pittsburgh Steelers, two of the league’s most notoriously rough teams. And it’s not as if the Cincinnati Bengals are lightweights either.
Pettine, a former defensive coordinator with
the Jets and Bills, wants a team of tough guys
— not just a couple rugged characters. That’s
why the Browns will have a period of the inside
running drill from here on out.
“It’ll be let’s line up and see who can play,”
Pettine said. “To me, it’s the counterpart of when
we do seven on seven. That’s usually advantage
offense — clear pass rush, no throwing lanes
— whereas that inside drill should be advantage defense. It’s more of a mentality thing. We
want to come off. We want to block people. We
want to get off blocks. We want to knock people
back. If we want to establish that mentality, we
have to do that drill.”
Inside linebacker Karlos Dansby loves it.
Signed as a free agent in March, Dansby
is Pettine’s kind of player. He’s big (6-foot-3,
251 pounds), experienced (11 years) and he’s
got the reputation of being a little mean. Pettine
is hoping guys like Dansby and safety Donte

Commonwealth Games get royal audience
GLASGOW, Scotland (AP) — His family may have castles to
choose from, but Prince Edward, alas, is a man without a pingpong table.
The prince was among several members of the royal family to
attend the Commonwealth Games on Monday. Prince William
and his wife, the Duchess of Cambridge, watched gymnastics and
boxing with William’s younger brother, Harry.
Prince Edward, son of Queen Elizabeth II, brought his family
to table tennis, among other events. They watched Nigeria beat
India 3-1 in a men’s team bronze-medal match.
The prince calls the sport “a game that you need to sit close to
in order to appreciate the speed and the skill.”
He adds that he does not have a table at home and that was
one reason he brought his children there. He wanted to “introduce
them to a couple of sports that they might not otherwise have
known.”

LeBron’s homecoming show
AKRON, Ohio (AP) — LeBron James’ Ohio hometown says
fans quickly claimed the thousands of tickets available for the
homecoming event expected to be his first public appearance in
the state since announcing his return to the Cleveland Cavaliers.
The free tickets for the Aug. 8 show at InfoCision Stadium in
Akron were released Monday and were gone within hours.
Akron spokeswoman Stephanie York won’t divulge how
many tickets were offered but says demand was overwhelming.
She says organizers hope to make more available.
York says the event is more of a show than a party or rally.
The stadium holds more than 27,000 people, but it’s unclear how
much space will be used for the event.
James has created big buzz by returning to Cleveland four
years after leaving for the Miami Heat.
Commonwealth Games lifter
faces sex assault charge
GLASGOW, Scotland (AP) — A weightlifter from Papua
New Guinea who competed at the Commonwealth Games faces
trial over an alleged sexual assault at a Glasgow supermarket.
The Glasgow Sheriff Court says Toua Udia pleaded not guilty
and will go on trial Friday. Police say the 22-year-old lifter was
arrested after officers received a report of an incident last Monday
at a supermarket near the athletes’ village.
Udia was quoted as telling Australia’s Fairfax media that “it
was an accident. I don’t want to spoil my reputation.”
Commonwealth Games Federation chief executive Mike
Hooper says the criminal case against Udia “certainly didn’t
impact on his ability to compete because there was no condition
placed upon him.” Hooper adds “there is a presumption of innocence which we all enjoy.”
Udia competed Sunday in the 77-kilogram division, finishing
ninth.
Tax fraud case against
Lionel Messi goes ahead
MADRID (AP) — A Spanish judge on Monday rejected a
prosecutor’s request to drop charges of tax fraud against Lionel
Messi and ordered the investigation into three cases of suspected
unpaid taxes to proceed.
A court statement said there was “sufficient evidence” to
believe the Barcelona and Argentina star “could have known and
consented” to the creation of a fictitious corporate structure to
avoid paying taxes on income from his image rights.
The statement was issued by the court in Gava, Barcelona, that
was initially called on by prosecutors to investigate if there was a
case for Messi and his father to answer.
In June, Messi’s public relations firm said a prosecutor had
agreed to drop the tax fraud case against the player and his father.
Messi’s father, Jorge Horacio Messi, is under investigation for
an alleged 4 million euros ($5.3 million) in unpaid taxes from
2007-09. Messi’s father made a payment of more than 5 million euros ($6.6 million) in August 2013 to cover alleged unpaid
taxes, plus interest.
Jaguars G Beadles donates
$750,000 to alma mater
JACKSONVILLE, Fla. (AP) — Jacksonville Jaguars guard
Zane Beadles, who signed a five-year, $30 million free-agent contract in March, is giving back to his alma mater.
Beadles pledged $750,000 to Utah’s football program Monday,
the largest gift given to the school by a former player.
Of his commitment, $500,000 will go to the sports medicine
center and $250,000 to a scholarship endowment in his name.
Beadles says “It’s something I knew I wanted to do since I got
into the league if I ever got to the position where I was able to do
something like that. I’m in that position now.”
A second-round draft pick by Denver in 2010, Beadles got
$13 million guaranteed to leave the AFC champion Broncos for
Jacksonville.

The 41-year-old Colon (10-8) retired the first
20 batters in his last outing Wednesday against
Seattle, eventually allowing two runs on three
hits in 7 1-3 innings in a 3-2 win. He wasn’t as
dominant Monday. But staked to a big lead, he
was never in much trouble either, scattering 10
hits over 7 2-3 innings.

ST. PETERSBURG, Fla. (AP) — Jake
Odorizzi won his third consecutive start and
James Loney had two RBIs to lead Tampa Bay
past Milwaukee.
Odorizzi (7-8) allowed one run and three hits
in seven innings to beat the team that took him
32nd overall in the 2008 draft.
Tampa Bay took a 2-1 lead in the sixth when
Loney drove in two with a two-out, basesloaded single off Kyle Lohse (11-5), who gave
up two runs and four hits over six innings.

The nonjury trial held over several weeks focused mainly
on whether Shelly Sterling properly removed her husband as
a trustee and whether her actions carried any weight after he
revoked the trust. Donald Sterling claimed his wife had deceived
him about the medical exams. His lawyers argued Monday that
Shelly Sterling’s lawyers were in cahoots with the doctors who
examined him and that his wife conspired with NBA Commissioner Adam Silver to remove him from the trust.
“There’s no evidence, I’ll repeat that as loudly as you allow,”
attorney Maxwell Blecher said during closing argument, his
voice rising. “There’s no evidence that Mr. Sterling was incapable of carrying out his duties as a co-trustee.”
The ruling was tentative until the judge files it in writing.
NBA spokesman Mike Bass said in a statement that the league
was pleased and looked forward to the transaction closing as
soon as possible.
At the conclusion of his lengthy ruling, Levanas envisioned
what might happen if Donald Sterling remained the owner.
Citing testimony of Clippers interim CEO Richard Parsons,
he said the team would go into a “death spiral.” Sponsors would
withdraw, players would quit and coach Doc Rivers would leave.
“The Clippers would suffer a massive loss of value if the
team survived at all,” Levanas said.
The judge was adamant that a team owned by Donald Sterling
would not draw a price anywhere near the “stunning” $2 billion
pledged by Ballmer. Sterling, a lawyer who made a fortune as a
landlord, bought the team in 1981 for $12 million. “Ballmer paid
an amazing price that can’t be explained by the market,” he said.
On the witness stand, Shelly Sterling was more credible than
her husband, who was more evasive, gave inconsistent answers
and presented wild fluctuations of damage estimates, Levanas
said. He noted that the couple presented genuine professions of
love for each other despite Donald Sterling’s outburst calling his
wife a “pig” after she testified.
Outside of court, his wife said she thought her husband would
be happy with the ruling. She said she thinks he will ultimately
drop his antitrust suit in federal court against the NBA and the
lawsuit he filed in state court against her, Silver and the league.
Her lawyer wasn’t so sure. Asked what might stop the deal,
Pierce O’Donnell said: “Donald.”
“He never met a lawsuit he didn’t like,” he quipped.
Bruce Givner, a Los Angeles tax attorney who handles
celebrity cases, said he thinks Sterling’s lawsuits will fail and
an appeals court won’t care about the probate case. “I think the
sale is going to go through,” Givner said. “I suspect the NBA is
ready to move very quickly. They want to get rid of Sterling like
a canker sore. Nobody wants him around except the people that
are charging legal fees to continue this charade.”

ARLINGTON, Texas (AP) — Derek Jeter remembers the
playoff games in Texas — the good and the bad. Now the
Yankees captain has another milestone to go with them there.
In the opener of his last series in Texas on Monday night,
Jeter took over seventh place on the MLB career hits list after
three hits of Rangers ace Yu Darvish.
Jeter got a standing ovation in the first inning, then singled
on the first pitch Darvish threw him. Jeter added a groundrule double in the third for his 3,419th career hit to match Carl
Yastrzemski for seventh on the MLB career list, then broke
that tie with a single in the seventh.
Next on the MLB career list is Honus Wagner with 3,430
hits.
Jeter’s rookie season in 1996 ended with the Yankees winning the World Series after clinching their opening playoff
series in Texas, just like they did in 1998 and 1999.
Then, in 2010, the Rangers got their first AL pennant with
a home win over New York in Game 6 of the AL championship series.
“We’ve had some battles here in the postseason,” Jeter said
before Monday night’s game. “We played some tough Texas
teams. On the way to the World Series, we had to go through
some Texas teams. There was a team in particular that stopped
us in our quest to go.”
The Rangers will honor Jeter in a pregame ceremony before
the series finale Wednesday night.
The Yankees captain has 103 hits in 71 regular-season

hopes her gold medal in squash at the Commonwealth Games
can offer a “bit of a boost” for her home country after the anguish
from two airline tragedies. David dashed from the court to greet
Malaysian fans celebrating their country’s 50th gold medal in
Commonwealth Games history. David defeated Laura Massaro
12-10, 11-2, 11-5 in the final. She hopes her victory “can play
a role in bringing a little bit of a boost for our country because
we have gone through a tough time.”
Based in Amsterdam, David had flown the same MH-17 route
to Kuala Lumpur in which a Malaysian Airlines jet shot was
down this month over Ukraine. Malaysia was already struggling
with the loss of MH-370, which vanished after takeoff in March.
FIFA seeks investigation
of Tavecchio remarks
ZURICH (AP) — FIFA wants the Italian soccer federation to
open an investigation into alleged racist comments by presidential
candidate Carlo Tavecchio. FIFA said Monday it has written to
the Italian group “asking it to take the appropriate steps to investigate and decide on this matter and report to FIFA.”
The international governing body also reminded the Italian
federation that “the fight against racism is a top priority for FIFA.”
Amateur leagues president Tavecchio sparked outrage Friday
when he discussed the presence of foreign players in Italy.
Using a hypothetical name, he said: “In England they select
players based on professionalism, whereas we say that ‘Opti
Poba’ is here, he was eating bananas before and now he’s starting
for Lazio and that’s OK.”
Thiem beats Souza in Kitzbuehel opener
KITZBUEHEL, Austria (AP) — Fifth-seeded Dominic Thiem
defeated Joao Souza of Brazil 7-6 (4), 3-6, 7-5 in a rain-soaked
first-round match at the Bet-at-Home Cup on Monday. The 50thranked Austrian converted his fourth match point as he broke
Souza for a third time in the final set. After the second set, the
match was interrupted for nearly an hour due to heavy rain.
In the second game of the match, Souza walked off the court
after being warned by the umpire for taking too much time
between his serves.
The Brazilian, who broke Thiem in the opening game, sat
on his chair for several minutes but decided to play on after the

Notah Begay charity event
VERONA, N.Y. (AP) — Tiger Woods is returning to play in
Notah Begay’s charity event. It will mark the fifth time Woods
will take part in the NB3 Foundation Challenge put on annually
by his former college roommate at Stanford. This year’s event at
Turning Stone Resort is Aug. 27.
Woods will be paired with Begay at the resort’s Atunyote (ahDUNE’-yote) Golf Club. Jason Dufner and Jimmy Walker will

ZURICH (AP) — FIFA has extended the sanctions imposed
on Kevin Sammut and Mark Edusei for match-fixing to prevent
them from playing anywhere in the world. Sammut was found
guilty by UEFA of colluding with a fixing syndicate in June
2007 to help manipulate Malta’s Euro 2008 qualifier in Norway.
Malta lost 4-0. His life ban by UEFA was reduced to 10 years
by the Court of Arbitration for Sport in May. Ghanaian player
Mark Edusei was suspended for three years and six months by the
Italian football federation in May for his role in fixing a match in
2009. Edusei’s team, Bari, lost 3-2 to Salernitana.

dies in car accident
CORDELE, Ga. (AP) — Former University of Georgia 400meter standout Torrin Lawrence died Monday morning in a car
accident as he made his way home to Jacksonville, Florida. He
was 25. Crisp County Sheriff Billy Hancock said Lawrence was
traveling along Interstate 75 about 1:40 a.m. when a tire blew out.
Lawrence got out of the car to make a phone call when a tractortrailer came over the crest and struck the car, knocking the vehicle
into Lawrence.
Hancock said Lawrence was on his way to Jacksonville after
training in Athens, where he won an NCAA indoor title for the
Bulldogs in 2010. The accident happened about 90 miles from
the Georgia-Florida state line.

“Rare storm” at California
beach hard to see coming
LOS ANGELES (AP) — A thunderstorm
formed so rapidly over a Southern California
beach that experts said Monday it was impossible
for anyone to predict a lightning strike would
turn a day of carefree fun into one of terror.
The phenomenon so rare that lifeguards lack
an emergency warning system struck Sunday
afternoon at Los Angeles’ popular Venice
Beach, killing a 21-year-old man and injuring a
dozen others.
Along the beach, famous internationally for
its jugglers, skaters, medical marijuana dealers
and boardwalk preachers and hucksters, panic
instantly set in.
“All of a sudden, there was a huge explosion
and everyone dropped to the ground. I thought,
‘Is there a bomb? Are there fireworks?’ The sky
got black and then it started downpouring,” said
Sam Solomon, a 24-year-old outdoor marketer
from Los Angeles.
Although a commonplace in many other parts
of the country, lightning rarely ever strikes the
sand along the beaches of the Western U.S., climatologist Bill Patzert said. As a result, Southern
Californians were completely unprepared.
“In Florida, under similar conditions, they
might have asked people to clear the beaches.
But not here,” said Patzert of NASA’s Jet Propulsion Laboratory.
Although lightning had struck a man on a golf
course on nearby Santa Catalina Island earlier in
the day, Patzert said the storm that materialized
over the beach did so rapidly and was so isolated
that he couldn’t say anyone was to blame for not
predicting it.
“It’s hard to find fault. I’d say impossible,
actually,” he said. “It was a small, isolated
system, and it just hit. It’s not as if it moved up
the coast and kept repeating itself. It was tragic,
but it was a one-shot deal.”
Killed was Nick Fagnano, 21, who was scheduled to attend the University of Southern California’s Sol Price School of Public Policy in the
fall as a transfer student from a nearby community college. His mother, Mary, told the Whittier
Daily News that her only son had been sitting
on the beach with friends when he decided to go
into the water to rinse off sand just as the lightning hit.
Nine other people were taken to hospitals
and three more were treated at the scene. Of
the nine hospitalized, one was listed in critical
condition. On Catalina Island, the picturesque
Channel Island 26 miles west of Los Angeles,
the man struck on a golf course was listed in
stable condition.
Before the lightning hit, the National Weather
Service issued a statement noting the chance of
thunderstorms off the Southern California coast
Sunday. But lightning from such storms usually
stays out over the ocean and doesn’t make it to
shore, said the agency’s Bonnie Bartling.
Southern California’s lifeguards receive the
alerts and going forward will be looking at them
more closely, said Capt. Kyle Daniels, although
he stopped short of saying they’d broadcast
storm alerts like they do shark alerts.
“The first knowledge they had was when the
lightning hit,” Capt. Danny Douglas said of his
lifeguard crew. In his 30 years as a lifeguard,
he had never seen lightning strike a Southern
California beach — he’d rarely even seen it rain
during the summer.
Other authorities were skeptical of what good
broadcasting alerts would do.
“Southern California surfers are Southern
California surfers,” said Capt. Brian Jordan
of the Los Angeles County Fire Department.
“Nothing will drive them out of the water.”
The storm came out of a front of warm, subtropical air from Mexico that usually doesn’t
make it as far west as California. When it did,
that front collided with the cooler marine layer
that normally envelopes Southern California’s
beaches during much of the year, keeping them
cloudy and cool, even during the afternoon.
The result was a ferocious lightning strike
and thunderclap that set off car alarms, showered
the local lifeguard station with sparks and shook
the building.
In more thunderstorm-prone parts of the
country, golf tournaments and baseball games
have sometimes been delayed when thunderstorms are seen approaching. But, Patzert noted,
that never happens in California because lightning strikes don’t often happen except in the
mountains and deserts.
“The probability of getting hit by lightning
in California is one in seven to 10 million,
depending on where you live,” Patzert said. “In
Florida, the lightning capital of the country, it’s
one in a million.”
As people returned by the thousands to Venice
Beach on Monday afternoon, some like Laurent
Mahuegt of France were counting on those odds
holding.
He, his wife and three children had left the
beach Sunday just 30 minutes before the storm
struck, but they were quickly back in the water.
“If I see dark clouds, I’ll leave,” he said.
FBI defends search
for 1995 Oklahoma
City bombing video
SALT LAKE CITY (AP) — The FBI thoroughly searched its
archives and found no evidence that more videos of the Oklahoma
City bombing exist, agency employees told a judge Monday in a
trial that has rekindled questions about whether any others were
involved in the 1995 attack. Additional searches for videos that
Salt Lake City lawyer Jesse Trentadue believes are being withheld would be burdensome and fruitless, FBI attorney Kathryn
Wyer argued during the first day of a bench trial.
Trentadue says the agency is refusing to release videos that
show a second person was with Timothy McVeigh when he
parked a truck outside the Oklahoma City federal building and
detonated a bomb that killed 168 people. The government says
McVeigh was alone. The 30 video recordings the FBI has released
don’t show the explosion or McVeigh’s arrival in a rental truck.
“The plaintiff has refused to accept that the 30 tapes he got are
the only tapes,” Wyer said. The FBI already has provided videos
and paper documents that correspond with Trentadue’s Freedom
of Information Act request, she said.
But unsatisfied by the FBI’s previous explanations and citing
the public importance of the tapes, U.S. District Judge Clark Waddoups has ordered the agency to explain why it can’t find videos
that are mentioned in evidence logs. Linda Vernon, a longtime
FBI employee who became the point person for the collection of
evidence after the bombing, said she is “completely confident”
the agency has found every video of the bombing that exists.
The trial continues Tuesday and will run at least through
Wednesday before the judge makes a ruling. He could wait until
a later date to decide. If Trentadue wins at trial, he hopes to be
able to search for the tapes himself rather than having to accept
the FBI’s answer that they don’t exist.
Trentadue believes the presence of a second suspect explains
why his brother, Kenneth Trentadue, was flown to Oklahoma several months after the bombing, where he died in a federal holding
cell. Kenneth Trentadue bore a striking resemblance to a police
sketch based on witness descriptions of the enigmatic suspect
“John Doe No. 2,” who was never identified.
Trentadue is acting as his own attorney and tried to show that
the FBI has not adequately followed up on information that could
lead to the discovery of other videos.
He asked Monica Mitchell of the FBI about why the agency had
not done more to search for a tape mentioned in a Secret Service
log. It describes security video footage of suspects — in plural —
exiting the truck three minutes before the bomb went off.
“Didn’t it come to your mind that that tape may exist?” Trentadue asked.
Mitchell said she didn’t know the authenticity of the Secret
Service document and that Vernon told her she didn’t know of the
existence of such a tape.
Trentadue asked if Mitchell had asked FBI headquarters about
the tape, citing documents that show it had one tape and 300 pages
of documents. She acknowledged she had not asked headquarters
about those items as part of the FOIA request.
A Secret Service agent testified in 2004 that the log does exist,
but its information was pulled from reports that were never verified, said Stacy A. Bauerschmidt, who was then the assistant to
the special agent in charge of the FBI’s intelligence division.
Several investigators and prosecutors who worked the case
told The Associated Press in 2004 they had never seen video like
that described in the Secret Service log.
Mitchell and Vernon described how employees searched
automated systems and by hand. Vernon said she spent 85 hours
searching three computer databases created to track all the evidence.
Trentadue wasn’t the only one asking tough questions of FBI
witnesses. The judge at one point asked Mitchell why the FBI
never responded to a letter from Trentadue asking about a video
that seemed to be incomplete.
“You basically did nothing?” Waddoups asked.
“We did nothing because we were confident in our search and
what we located,” Mitchell said.
Later, he questioned why Vernon neglected to send several
documents to Trentadue that mentioned videos, despite her previous claim that she erred on the side of inclusivity if she wasn’t
sure whether something fell under his request.
Trentadue’s 44-year-old brother, who was a convicted bank
robber and construction worker, was brought to the U.S. Bureau
of Prisons’ Federal Transfer Center in Oklahoma City after being
picked up for probation violations while coming back to the U.S.
at the Mexican border, Jesse Trentadue said.
Kenneth Trentadue’s death was officially a suicide. But his
body had 41 wounds and bruises that his brother believes were the
result of a beating. In 2008, a judge awarded the family $1.1 million for extreme emotional distress in the government’s handling
of the death. The amount was reduced to $900,000 after an appeal.

Annoying little floods are
increasing on U.S. coasts
WASHINGTON (AP) — Along much of America’s coasts,
the type of flooding that is more annoying than dangerous has
jumped more than fivefold in the last 50 years, the federal government reported Monday.
Scientists blame rising seas, saying this is one of the ways
global warming is changing everyday lives. The National Oceanic and Atmospheric Administration studied coastal trends in
what it calls nuisance flooding, where no one is hurt but people
have to deal with flooded roads and buildings.
While scientists and the public spend a lot of time dealing
with giant events, such as a hurricane, it is minor floods that
people feel more often, though not as severely, said NOAA’s
Margaret Davidson. “It’s the stuff that keeps you from conducting your business or picking up your kids from school,”
Davidson said. “It is clear that changing climate and weather
patterns will cause us to be increasingly inconvenienced and
challenged in our everyday lives.”
Oceanographer William Sweet looked at coastal sites across
the nation, focusing on 25 places with records that go back
beyond 1950. Fifty years ago the 25 sites averaged about 2.5 days
of minor flooding a year. Now those places average about 14
days a year. All 25 of those locations saw increases in the number
of minor flood days; 22 of them saw more than doubling of nuisance flooding since the late 1950s and early 1960s. Those 25
cities have also seen sea level rise nearly half a foot since 1963.
The biggest increases are in the mid-Atlantic region.
Charleston, South Carolina, San Francisco and Port Isabel,
Texas, also showed more than four-fold increases in flooding.
Annapolis, Maryland, had the biggest percentage increase.
From 1957 to 1963 it averaged 3.6 minor flood days a year;
now it averages more than 39 a year. In 2011, Maryland’s capital had 66 minor flood days.
University of Maryland environmental scientist Donald
Boesch, who wasn’t part of the report, said this type of event
is probably more meaningful to people than the bigger and
less frequent storms. He noted that sea level has risen about 8
inches in Annapolis since 1971. “Simply stated, the cause of
the increase in inundation frequency is sea level rise attributable to global warming,” Boesch said in an email.
Sweet said sinking land and building construction are factors in the increased flooding, but not nearly as much as rising
seas. “It’s going to become the new normal,” Sweet said. “That
is how we can identify with the impacts of sea level rise.”

Abuse suspect dead; two
marshals, policeman hurt
NEW YORK (AP) — A California man who skipped town
after being accused of molesting a boy was killed and three law
enforcement officers trying to arrest him were wounded in a daytime shootout inside a small smoke shop in one of New York’s
most bustling neighborhoods, officials said Monday.
The man, Charles Richard Mozdir, was recently featured on a
CNN show about fugitives. He was wanted in a San Diego case
and was charged with lewd acts upon a child younger than 14, a
criminal complaint said.
The shootout between Mozdir and members of the New
York/New Jersey Regional Fugitive Task Force happened just
after 1 p.m. in Greenwich Village not far from New York University in a highly trafficked tourist area bounded by jazz clubs,
restaurants, a subway station and a basketball court.
Mozdir’s handgun was recovered at the scene, and 20 extra
rounds of ammunition were found in his pocket, Police Commissioner William Bratton said.
A detective first entered the narrow smoke shop and identified Mozdir, who apparently was alone, Police Commissioner
Bratton said, before leaving and returning with the U.S. marshals.
The detective was shot at least twice, in the stomach below
his protective vest and in the right chest, which could have been
deadly were it not stopped by the vest, Bratton said at a hospital.
One U.S. marshal was shot in the elbow and another in his
buttocks, he said.
All three were in stable condition and had been visited by city
and federal officials.
The detective didn’t fire his weapon, but the federal agents
fired multiple rounds, authorities said.
Oahu to connect ocean’s
wave energy to power grid
HONOLULU (AP) — Oahu could become
the first place in the United States to connect
the energy harvested from ocean waves to a
power grid. Northwest Energy Innovations, a
private company, will start testing a prototype
in September, the Honolulu Star-Advertiser
reported. During peak wave conditions, the
device could generate up to 20 kilowatts from
the wave energy, which is enough to power several homes. “It’s a relatively small ... but important step” in the nascent wave energy industry,
said Patrick Cross, senior project specialist at
UH-Manoa’s Hawaii Natural Energy Institute.
If tests go well, the company hopes to test
larger, more cost-effective models in deeper
waters. Officials at the University of Hawaii say
the Navy provided $9 million in support. Using
that funding, up to four other companies could
begin testing at the site in Kaneohe Bay. The
50-foot-long device aims to harness power of
waves far enough offshore that they don’t break.
The push to use ocean waves as renewable
energy is about 30 years behind the wind power
industry, said Steve Kopf, founder and senior
partner with Northwest Energy Innovations.
Scientists believe they can get to the point
where wave energy is competitive with other
renewable-energy sources, Kopf said.
“Nobody’s quite there yet on wave, but
we’re chipping away at it,” he said.
Board denies challenges
to giant Hawaii telescope
HONOLULU (AP) — The Hawaii Board
of Land and Natural Resources has denied
requests to contest the approval of a sublease
for the Thirty Meter Telescope, allowing construction to move forward for what will be one
of the largest telescopes in the world.
The University of Hawaii leases land from
the state where the $1.3 billion telescope would
be built on the summit of the Big Island’s Mauna
Kea. The board last month approved the sublease between the university and TMT International Observatory LLC but deferred its going
into effect pending contested case requests.
Opponents raised questions about whether
land appraisals were done appropriately and
whether Native Hawaiians were properly consulted. They said that if the telescope is built on
Hawaii’s tallest peak, it will desecrate a place
held sacred by Native Hawaiians.
The board approved the staff recommendation to deny the contest case requests at a
meeting Friday. The sublease was the last major
bureaucratic hurdle for scientists, although the
project also faces the threat of lawsuits.
Construction is scheduled to start this year,
the telescope’s board of directors said in a news
release Monday. A site dedication ceremony is
planned for October. “TMT has worked for many
years to design an unprecedented telescope, but
also to work with the community to incorporate
respect for Mauna Kea in our stewardship,” said
project manager Gary Sanders. “It is an honor
and a privilege to now begin building our nextgeneration observatory in so special a place.”
The project was initiated by the University
of California, California Institute of Technology and the Association of Canadian Universities for Research in Astronomy. Universities and institutions in China, India and Japan
later signed on as partners.
If built, the Thirty Meter Telescope could
be the largest optical telescope in the world,
sporting a primary mirror that would be nearly
100 feet, or 30 meters, in diameter.
But that title could be usurped by a group
of European scientists who are working on the
European Extremely Large Telescope.
They plan to have a mirror that is 138 feet, or
42 meters, in diameter.
Senator Schatz keeps ballot
secret; votes early in Hawaii
HONOLULU (AP) — U.S. Sen. Brian
Schatz is keeping his ballot secret as he casts
his vote in Hawaii’s primary election.
Schatz voted Monday at Honolulu Hale, then
said when asked whom he voted for in other
races: “I’ll keep that to myself.”
The Democrat running against U.S. Rep. Colleen Hanabusa for U.S. Senate says he thinks
everybody is entitled to a secret ballot. The
Schatz family lives in the Makiki neighborhood
of Honolulu, meaning Schatz is voting in the
state’s biggest Democratic races besides his own.
Gov. Neil Abercrombie faces state Sen.
David Ige in a primary for governor. And seven
Democrats are seeking a House nomination in
Hawaii’s 1st Congressional District.
Schatz cast his ballot with his wife, Linda
Kwok Schatz, on the first day of early voting.
Officials address Big
Island hunting concerns
KAILUA-KONA, Hawaii (AP) — Officials
are trying to balance conservation with access
to hunting grounds as a federal agency prepares
a plan for designating 19,000 acres of critical
habitat in North Kona. Representatives from the
state Department of Land and Natural Resources
met with a group of Big Island hunters and lawmakers over the weekend to discuss the federal
agency’s plans for finalizing a proposal within
the next few months.
Hunters expressed concerns over shrinking
hunting area and some Native Hawaiians called
on the department to turn over management of
the land to those who historically draw subsistence from it, West Hawaii Today reported.
Federal and state officials will examine state
lands that are already under protection in the
area, in an effort to reduce the area that will be
under federal designation between Palani Road
and Waikoloa to protect three rare plant species.
Hunting opportunities have been reduced on
both federal and state lands and by private landholders fearing liability, he said.
u.s. Appeals court upholds
ex-B-2 engineer’s conviction
HONOLULU (AP) — A federal appeals
court on Monday upheld the conviction of a
former B-2 stealth bomber engineer who was
convicted of selling military secrets to China
and disclosing classified information to people
in other countries. The 9th U.S. Circuit Court
of Appeals said a lower court in Honolulu was
correct to admit as evidence information federal agents gathered while interviewing Noshir
Gowadia before they arrested him.
Gowadia’s attorneys argued the Maui resident was being detained during the interviews.
But the appeals court found Gowadia was free
to stop the interviews and that he willingly and
enthusiastically shared information.
The appeals court also found jurors received
correct instructions about the government’s
burden to prove the alleged classified information was technical data and not information in
the public domain. Gowadia’s attorney, Georgia
McMillan, said she was reviewing the ruling and
declined to comment. Gowadia, 70, is serving a
32-year sentence at a federal prison in Colorado.
He was convicted in 2011 on 14 counts,
including communicating national defense information to aid a foreign nation and violating the
arms export control act. Prosecutors said Gowadia
helped China design a stealth cruise missile to get
money to pay the $15,000-a-month mortgage
on his luxurious multimillion-dollar home overlooking the ocean on Maui. They say he pocketed
at least $110,000 by selling military secrets.
The jury also found Gowadia guilty of
attempting to sell classified stealth technology
to the Swiss government, and to businesses in
Israel and Germany.

DEAR PARENT: One way to help your son would be to stop other family members from making
fun of him and labeling him as a klutz. When people laugh and ridicule others, it makes them only
more self-conscious and more clumsy.
Another way to help would be to have him examined by an ophthalmologist and a neurologist.
His problem may be poor depth perception or a neurological or balance issue. And while you’re at
it, consider having him evaluated for a learning disability, which may be the cause of his academic
difficulties.
