The Public Grievance Committee meeting for the month of March and April 2014 was held as scheduled on 24.04.2014 at 16.00 hrs, in the Office of the Commissioner of Central Excise, Pune-I Commissionerate. The meeting was chaired by Shri. Rakesh Kumar Sharma, Commissioner, Central Excise, Pune-I Commissionerate. 2. The following PGC members and Departmental Officers attended the meeting. The Chairperson welcomed the members attending the meeting and explained to the members the role of PGC. He emphasized that PGC is a forum, mainly to discuss specific grievances pertaining to Pune-I Commissionerate, such as situations where prescribed procedures are not being followed or departmental work being held up beyond prescribed time or beyond reasonable time. The issues regarding anomalies of law, simplification of procedures may be taken up with higher bodies viz. in the RAC meeting, etc. 4. One point, received from the Association of EOUs & SEZs , Pune, was taken up for deliberation in the meeting. POINT : The representative of Association of EOUs & SEZs, have raised the point that a number of DTA suppliers are supplying the goods to EOU Unit under CT-3. Prior to 15th March, 2013 they were entitled for claiming Refund of TED from RA of DGFT. However, vide Policy Circular No.16 (RE-2012/2009-14) dated 15-03-2013, DGFT has discontinued the said practice. DTA suppliers filed Refund Claims to Central Excise Department under Rule 5 of CENVAT Credit Rules, 2004. The Department has rejected the claims stating DEEMED Exporters are not entitled to get Refund under provision Rule 5 of CENVAT Credit Rules, 2004. As a result, DTA units are facing problem of huge accumulation of CENVAT Credit. In this regard the member has forwarded CESTAT Order No.A/412 to 416/WZB/2007/SMB/C-IV in the case of M/s.Precision Tool Room & Moulding House v/s Commissioner of Central Excise Pune-III in which Tribunal has allowed the Refund under Rule 5. 5. The Chairperson explained to the members that this is a policy matter, as the DGFT has modified the policy of granting the refund of TED and the provisions of Central Excise does not allow such refund. If the member desires, they may make reference to DGFT / CBEC, highlighting the problems faced by their Industry / Sector due to the policy change. The Chairperson future informed that the CESTAT Order relied upon by the member does not relate to this issue – as the same relates to refund of Modvat Credit and hence is not applicable to this issue. 6. The Chairperson again invited views from members of any problems faced by them or their industry in the day-to-day functioning or interactions with the department. Shri Vinod Patkotwar, Representative of the All India Rubber Industries Association, informed that his grievance raised in the last meeting has been properly -3attended to and he thanked the Chairperson for the same. He also requested that telephone numbers of key officials of Pune-I Commissionerate may be circulated to them. Accordingly, list of telephone numbers of all the senior officers of Pune-I Commissionerate is given in the Annexures I & II. 7. Shri Aspi Kolah, Director-FM Group, M/s.Forbes Marshall Pvt.Ltd., Pune, enquired about changes in export procedure particularly in respect of stuffing and sealing procedure. The Chairperson explained that the existing Self-Sealing procedure are very liberal and simplified and assessee’s should opt for the same. This will also help save time of departmental officers as the department is presently facing shortage of staff. Shri Aspi Kolah thereafter requested for notifying the existing simplified export procedure. The Chairperson agreed to look into the matter and directed the Joint Commissioner (Technical) to issue the Trade facility / Notice reiterate the instructions issued by the Board in this regard. 8. No other members came up with any problems or grievances. The Chairperson emphasized to the members that if any problem is faced, they need not wait for the next PGC Meeting to present it. They may contact their divisional Deputy / Assistant Commissioner for immediately resolving the issue and if the same is not resolved at that level within a reasonable time i.e. about 15 days they may approach the Commissioner, Central Excise, Pune I, for redressal. 9. The Chairperson concluded the meeting after thanking the members and informed that the next meeting would be held in the third week of June 2014, for which the due intimation will be issued by 31.5.2014. 10.
