Assumption of Municipal Services, Plan 65M-4220

PURPOSE:
To assume the internal and external above and belowground municipal services
associated with plan of subdivision fi le 19T(R)-95121 , to assume the related right-ofways, and to establ ish certain lands as public highways .
RECOMMENDATION(S):
a) That the assumption of the above and belowground services including
the stormwater management facility within Block 133 within Plan GSM4220, for lands known as subdivision file 19T(R)-95121, be approved;
b) That the assumption of the external above and belowground services
within the Merton Street, Humberland Drive, and Coon's Road road
allowances associated with subdivision file 19T(R)-95121, be approved;
c) That McMahon Court, Pheasant Drive, Verdi Road, Kellogg Crescent, and
Merton Street within limits of Plan 65M-4220 , be assumed as public
highways;
d) That the following reserve blocks be established as public highway to
become part of certain streets:

BACKGROUND:
The subject lands are located within the 19T(R)-95121 - Heathwood Homes (Tranquility
- West) Limited , plan of subdivision being Plan 65M-4220 . The subdivision is located
south of Humberland Drive and east of Bathurst Street as indicated on Map 1.
The developer has requested that the aboveground and belowground services for
subdivision file 19T(R)-95121 be assumed by the Town.
Staff recommends assumption based on fulfillment of the conditions from the
subdivision agreement, as summarized in Appendix A.
FINANCIAL/STAFFING/OTHER IMPLICATIONS:
The Town now assumes the maintenance responsibility for the subject assumed
services. The estimated annual maintenance cost for the assumed services is
$18,720.00
RELATIONSHIP TO THE STRATEGIC PLAN:
Assumption of municipal services demonstrates our responsibility to serve as a role
model for municipal management of our resources.
CONCLUSION:
Based on the above , staff recommends assumption of the above and belowground
municipa l services pertaining to subdivision file 19T(R)-07003 , as outlined in this report.

APPENDIX A
Section A.23- As-Built Drawings
David Schaeffers Engineering Ltd., consulting engineers to the developer, has
submitted a complete set of as-built eng ineering drawings fo r the services to be
assumed. These drawings have been certified by the engineer who supervised the
construction and have been reviewed by the Environmental and Infrastructure
Department's Design section .
Section A.24- Consu lting Engineer's Certificate
David Schaeffers Engineering Ltd. has provided an engineering certificate stating that
the services have been completed in general conformance with approved drawings .
Final inspection of the municipal services was carried out and comp leted as of July 19,
2013 with the Town's inspection staff. Accordingly, services have been constructed to
Town 's standards .
Section A.25 -Street Tree Planting
Street tree planting has been completed . Our Parks Section has concurred with the
assumption of the plan proceeding .
Section A.26 - Letter from Ontario Land Surveyor
Lloyd & Purcell Ltd. , Ontario Land Surveyors , have provided a letter certifying that the
standard iron bars (SIB's) as shown on the registered plan have been reinstated as of
November 15, 2012.
Section A.27 - Letter of Credit:

The retained letter of cred it will rema in in place for the duration of the maintenance
period which ends 24 months from the date of the assumption by-law.

Section A.28- Statutory Declaration
Statutory Declarations have been received from the developer, Heathwood Homes
(Tranquility - West) Limited , the contractor, Con-Drain Company (1983) Ltd ., and
engineering consultant, David Schaeffers Engineering Ltd. These declarations confirm
that all accounts related to services within Plan 65M -4220 have been paid in full.
Section A.29- House Connections
Houses have been constructed on 100% of the lots, satisfying the 80% minimum
requirement allowing assumption to proceed.
