Odisha Mining Corporation Limited (A GOLD CATEGORY STATE PSU) TENDER CALL NOTICE NO. 193/OMC/S&M/2014 FOR IRON ORE Sealed tenders are invited for sale of various grades of Iron Ore lying at Paradip Port Trust Prohibited area, Paradip, (Odisha) with specifications, terms and conditions as detailed below. The bidders are required to submit their sealed quotations on 28.02.2014 by 1:00 PM in the Tender Drop Box in Sales & Marketing Section, OMC, Bhubaneswar. The sealed quotations are required to be submitted in two separate sealed envelopes as Technical bid envelope and Price bid envelope in the prescribed format. 1. TECHNICAL BID ( Technical Bid Envelope) The Technical Bid sealed envelope containing Technical Bid Format duly filled in along with the following documents (signed legible/clear copies to be submitted) i) ii) Memorandum and articles of Association of the Company or/and DIC Registration. Copy of Sales Tax Registration Certificate (VAT/CST/TIN). iii) In case of trader, Valid Trading License of respective region from concerned Dy. Director of Mines/Mining Officer for trading of Iron Ore. Or In case of end using plants (Sintering/Pelletisation Plants), the clearance/ consent of State Pollution Control Board/ MOEF should be enclosed. (or else the bidder shall be considered as a Trader). iv) IBM Registration Certificate under Rule 45 of MCDR (Amendment) 2011 v) Tender Notice signed in each page (with seal) as token of acceptance of terms & conditions. EMD for requisite amount in shape of DD.(separate DD for each item quoted). vi) (All the bidders must submit above documents positively failing which the bid shall be rejected) (B) Price Bid: Price bid sealed envelope shall comprise of the price quoted (item wise per WMT) by the tenderer for each desired item only in the prescribed format. The entire information including the technical bid and price bid should be type written. Any deviation from the above in submission of bids, the same will be subject to rejection. Both the technical bid and price bid will be opened in presence of the participants or their authorised representatives. In case of more quantity is found actually available, successful tenderer can be allowed to lift the surplus quantity at the approved price subject to approval of OMC. 3. ELIGIBILITY CRITERIA: (a) Sponge Iron Plant/Pig Iron plants/Steel Plants/Sintering / Pelletisation Plants.. (b) Trader (for Iron Ore Fines i.e. item No. A only). Iron Ore lessees are not allowed to participate in this tender. 3: EARNEST MONEY DEPOSIT (EMD): The bidder has to deposit EMD in shape of DD for each item grade of Iron Ore separately drawn on any Nationalized / Scheduled Bank operating at Bhubaneswar in favour of OMC Ltd., Bhubaneswar, payable at Bhubaneswar. No interest shall be paid for EMD. EMD has to be submitted separately for each item or grade Iron Ore along with the technical bid in order to facilitate scrutiny and quick refund of EMD amount to the unsuccessful bidders. In the event, the H1 bidder fails to lift the available quantity limiting to the tendered quantity or minimum 90% of the allotted quantity (base quantity) against the above tender participation, within the stipulated time in conformity with the tender norms, the EMD deposited with OMC by the buyer will be forfeited. However, if the reason of non-lifting/ shortfall in lifting is found to be not attributable to the buyer, then OMC may decide to refund the EMD. The bidder will put the seal of Company at the rear side of each DD deposited towards EMD. In order to facilitate refund of EMD by hand to the unsuccessful bidders on the date of opening of tender, the bidders may submit an authorization letter through the bearer to take back the DD of unsuccessful bidder by hand, otherwise, the EMD of unsuccessful bidders shall be refunded within 30 days after opening of tender by post. 4: VALIDITY OF OFFER. The bidders may keep their offer valid at least for 30 days from the opening of tender. 5: PLACE & MODE OF DELIVERY: Ex- plot of OMC Ltd. at Paradip port (Mechanical Iron Ore Plot situated between idler No. 310-410 of 3AB Conveyor Line) situated within Port Prohibited area. The buyer shall keep the seller indemnified for any liability which may arise during the contract or thereafter on account of loading, transport and such other matters as are thereto to their exercise. As per “The Environment Protection Act - 2006” and guidelines, the buyer should ensure that the loaded trucks are to be covered with tarpaulin during transport. 6. CONSUMPTION: The End Use Plants buyer will consume Iron Ore in their own factory & shall not dispose off or sale it to any other party. If this condition is contravened or violated, the supply order will be liable to be cancelled at the discretion of OMC Ltd. 7: DELIVERY PERIOD: 4 Months from the date of contract. 8: SAMPLING & ANALYSIS: Sampling & Analysis shall be carried out by a reputed public analyst. The report of public analyst will be binding on both buyer and seller. 50% of the analysis charges will be borne by the buyer. The buyer may depute its representative for supervision of sampling & analysis and stock of ore to be supplied to the buyer to avoid any complicacy regarding quality and physical specification during the process. The responsibility of OMC Ltd. ceases once the product is loaded in to the carrier and no complaint in this regard shall be entertained. 9. PRICE: The buyer has to quote the price per WMT (Wet metric tonne) on ex-plot Pardip Port basis for each desired item (Clause–1) separately, including royalty, Wharfage charges, weighment charges & service tax thereon in the Price Bid format i.e. the buyer may quote price for one item or multiple items/all items. The price may be offered on percent of Fe basis and actual price shall be calculated on pro-rata basis. OMC management reserves the right to either accept the quoted price or canell the same.. 50% analysis charges and other Govt. /Statutory duties will be charged extra. The buyer has to arrange loading and transportation etc. of their own. 10: PAYMENT TERMS: The buyer has to lift the material against deposit of 100% payment in advance covering approximate cost of material plus sales tax, 50% analysis charges and other expenses as mentioned in Price Clause No. 9 in shape of Demand Draft drawn on any Nationalised /Scheduled Bank operating at Bhubaneswar in favour of OMC Limited payable at Bhubaneswar. The payment has to made at Head Office of OMC Ltd. at Bhubaneswar within 20 days from the date of contract failing which the contract issued to the buyer shall be cancelled and the EMD deposited by the buyer shall be forfeited without further correspondence. 11. SALES TAX: Sales Tax/VAT as applicable shall be charged extra. To avail concessional rate of sales tax, required forms duly filled in shall be deposited in due time with OMC without delay, failing which sales tax in full rate will be recovered from the buyer. 12: WELFARE CESS: Instead of OMC paying Labour Welfare Cess to buyers of ore separately, applicable labour welfare cess, as payable by OMC to the buyers of ore shall be deducted from the sales invoice of each buyer. The buyer shall deposit the cess duty with the welfare commission in due time and produce documentary evidence in support of such payment to OMC Ltd., Bhubaneswar every month. Any deviation to the above shall be liable for cancellation of the supply order by OMC Ltd. 12. WEIGHMENT: For the purpose of payment, Weighment as recorded in OMC’s nominated weighbridge /Govt. weighbridge/weighbridge of Paradip Port Trust shall be final. 13: DISPUTE: The decision of the Chairman cum Managing Director, OMC shall be final on any dispute arising out of the above deal. 14: SPECIAL CONDITION: The highest quoted price (H1) for different grade / type/ item of ore received through this tender shall be scrutinized by OMC Ltd., as per prevailing price of OMC Ltd. OMC reserves the right to accept or reject the highest quoted price received through this tender for any grade/ type/item of ore tendered, if such price is considered as not commensurate with the prevailing price of OMC Ltd. In case of more quantity is found actually available, successful tenderer can be allowed to lift the surplus quantity at the approved price subject to approval of OMC. In case the eligible highest bidder is a new buyer to OMC, he will not have the right to be enlisted as a regular buyer and allotment of the tendered quantity shall be made subject to successful plant inspection. Successful Plant inspection includes subsequent compliance and clarification, if necessary, relating to submission of additional information/ documents to prove bonafideness and authenticity of the unit apart from documents asked for prior to supply of Iron ore as successful H1 bidder. In such case, if the compliance of the H1 bidder agency is not upto the satisfaction of OMC, the supply of tender quantity of Iron ore to the said H1 bidder can not be made and OMC Ltd. shall have the right to be free of its tender obligations and take further suitable decision. The buyer shall carry out loading and transporting of materials and comply strictly with all provisions of Mines Act – 1952, Rules – 1955, Metalliferous Mines Regulation – 1961, MMRD Act, Payment of wages (Mines Rules), Maternity benefit Act of 1961, Industrial dispute Act – 1947, M.V. Act, Contract Labour (R&A) - 1970 etc. and “other government / statutory regulations, decisions, recommendations prevailing and applicable from time to time. The buyers allotted ore /material, shall submit a true copy of the said contract with signature in each page to AGM (S&M), OMC Ltd., Bhubaneswar prior to execution of SO (Sales Order), as a token of acceptance of terms and conditions of contract. Before delivery of material to the buyer, Shipment Office, OMC Ltd., Paradip shall ensure the following: a) Approval from port Authority (PPT) for lifting of cargo from Paradip Port to the plant of the buyer. b) Permission from DDM, JK Road for stock removal, transit pass and way bill. 15: AUTHORISATION OF AGENTS / REPRESENTATIVES: For the bid submitted by agent/representatives, the name of their principal is to be furnished along with a letter of authority issued by the Principal authorizing the agent / representative to participate on their behalf. 16. TENDER PAPER. This Tender Notice along with Technical and Price Bid format is to be downloaded from OMC website to file tender documents. No provision exists for sale of Tender paper 17.
