IRON ORE AVAILABLE FOR SALE
Odisha Mining Corporation Ltd. intends to sell +62% Fe 10-40mm CLO
(basis 62% Fe) Iron Ore from Ex-Kurmitar/ Khandadhar Iron Ore Mines of
Koira Region in Sundargarh District for immediate sale at prevailing price i.e. Rs.
4250/ WMT (inclusive of royalty and exclusive of other taxes and duties as
applicable). Total quantity available for sale is only 3,00,000 MT (+20%) on
first-come-first-serve basis. The supply period shall be up to 30.09.2014. Iron
Ore will be sold only to end-use plants of Odisha and outside who are eligible as
per the documents given in detail in our website. In this connection the
application along with relevant documents should be addressed to the Addl.

Basis: 62% Fe at following mines for immediate sale at prevailing basic price mentioned below:

Apart from documents asked for, if necessary, submission of additional information/
documentary proof shall be asked for subsequently to ascertain authenticity and bonafideness of
the agency. In such case, if the compliance is not up to satisfaction of OMC Ltd., the supply of
ore cannot be made.
TERMS & CONDITIONS:
1.
Place & Mode of Delivery : Ex -
Kurmitar / Khandadhar Iron Ore Mines of Koira
Region in Sundargarh District. The buyer will arrange to lift material by Truck from mines on his
own arrangement. The responsibility of OMC Ltd ceases once the material is loaded into trucks.
The buyer shall keep the seller indemnified for any liability which may arise during the
contract or thereafter on account of loading, transport and such other matters as are incidental
to their exercise.
As per Environment Protection Act-1986 & guideline, the buyer should ensure that the
loaded trucks are to be covered with tarpaulin during transport.

The agency has to lift the material against advance DD covering
approximate cost of ore plus Sales Tax and 50% analysis charges and other Govt. duties (as
applicable). The mode of payment are as follows: In shape of Demand Draft/Banker’s cheque/
Direct credit to OMC Bank Account drawn on any nationalized /scheduled bank operating at
Koira in favour of M/s. Odisha Mining Corporation Ltd. The buyer has to deposit the above
Demand Draft/ Banker’s cheque/ Direct credit to OMC bank Account in advance with Regional
Manager , Koira.

Or
Payment can also be made through Letter of Credit (LC) at sight. However, 1% will be charged
over and above the price fixed from time to time as LC processing charge.
4.
LABOUR WELFARE CESS:
Instead of OMC paying Labour Welfare Cess to buyers of ore separately, applicable labour
welfare cess, as payable by OMC to the buyer of ore shall be deducted from the sales invoice of
each buyer.
The buyer shall deposit the cess duty with the Welfare commissioner in due time and
produce documentary evidence in support of such payment to OMC every month. Any deviation
to the above shall be liable for cancellation of the supply order by OMC Ltd.
5.
Sampling & Analysis:
Sampling and analysis shall be carried out by a reputed public analyst. The report of
public analyst will be binding on both buyer and seller. 50% of the analysis charges will be borne
by the buyer. The agency may depute its’ representative for supervision of sampling & analysis
and stock of ore to be supplied to the buyer to avoid any complicacy regarding quality and
physical specification during the process. The responsibility of OMC Ltd, ceases once the product
is loaded into the carrier and no complain in this regard shall be entertained.
6.
QUALITY CONTROL:
The ore will be supplied by the seller to the buyer on ex-mines basis . The pre-stack
analysis will be carried out by the public analyst. The buyer may depute his authorized
representative for inspection of ore which is pre-stacked before dispatch in order to avoid
complicacy in quality after the ore is dispatched (Loaded into truck).
7.
CONSUMPTION:
The ore will be supplied from Kurmitar/Khandadhar Iron ore Mines of Koira Region in
Sundargarh District to the sponge Plants/ Pig Iron Plants/ Steel Plants (end users) of the State
and outside state directly. The buyer has to consume process Iron ore purchased against the
above allotment in their own factory/plant.
8.
PRICE:
The buyer has to agree the basic price (inclusive of royalty) as indicated in the notice.
The price will be on 62% basis & for unit scale fraction prorata. 50% analysis charges & other
Govt. duties as applicable shall be charged extra. The agency has to arrange loading &
transportation etc, at their own cost. Unitage shall be charged on unit scale fraction prorata
basis.
9.
SALES TAX:
Sales Tax/VAT as applicable shall be charged extra. To avail concessional rate of sales
tax, buyers are required to deposit required form duly filled in, with OMC failing which sales tax
in full rate will be recovered from the buyer.
10.
WEIGHMENT:
Weighment as recorded in OMC weighbridge or decided weighbridge of OMC in case
OMC’s weighbridge is not available shall be final for the purpose of payment.
11.
DISPUTE:
The decision of the Chairman cum Managing director, OMC Ltd, shall be final on any
dispute arising out of the above deal.
12.
PROCEDURE FOR APPLICATION:
Format for application is enclosed with this Notice separately which is to be down loaded
for submission of application as per above schedule, terms & conditions of this notice (websitewww.odishamining.com). The agency should also furnish this Notice with signature in
each page as a token of acceptance of the schedule, terms & conditions.
13.
SPECIAL CONDITION :
(a)
This notice has been published primarily for liquidation of iron ore available at Kurmitar/
Khandadhar iron ore mines of Koira Region in Sundargarh district. OMC Ltd will allot iron ore
following allotment procedure of the Corporation. Therefore, after allotment of the
quantity to respective agency (in case the agency is a new customer & willing to use Iron Ore in
their own plant, ore will be supplied after successful plant verification by the Regional Office,
Koira). They will not have the right to be enlisted as a regular customer. However, OMC
management reserves the right either to continue or discontinue further supply in future to such
agencies.
(b)
The supply of material/ore shall be made on first come first serve basis.
(c)
After allotment of quantity, the buyer has to execute sales order (by depositing advance
towards cost of allotted quantity as follows at concerned Regional Office, as per the advice of
Regional Office, Koira.

The buyer has to depute one of their authorized staff / representative (not
representatives of transporters, in writing to Regional Office, Koira, who shall co-ordinate the
sales process/lifting of material against their allotment.

The buyer shall carryout loading and transporting of materials and comply strictly with all
provisions of Mines Act – 1952, Rules-1955, Metalliferous Mines Regulation-1961, MMRD Act,
Payment of Wages (Mines Rules), Maternity benefit Act of 1961, Industrial dispute Act-1947,
M.V. Act etc, and all other government/statutory regulations, decisions, recommendations
prevailing and applicable from time to time.

Further, the buyer should ensure registration of his establishment u/s 7 of the Contract
Labour (R&A) Act, 1970, so that the contractors engaged by you for loading and transportation
work possess valid license u/s 12 of the Contract Labour (R&A) Act, to avoid any legal
complicacies in the matter. The above statutory requirement should strictly be adhered to and a
copy of the valid license should be deposited with respective Regional Manager and Manager
(Mining) of the concerned mines prior to executing loading and transportation work of
ore/minerals allotted to you, failing which supply of ore shall not be allowed.

The buyers are expected to maintain peace and tranquility during the course of lifting of
iron ore under a Sales contract. Any buyer found to have creating trouble resorting to coercive
measure including threatening of staff and officer of the mines and undertaking violent action
shall be liable for cancellation of ore allotment, sale order and delivery order. Besides
above,
action as per the law shall be taken against the above actions of errant customer.
14.
OMC management reserves the right to defer/accept/cancel the whole or part of the
notice without assigning any reason thereof.
