The Marshall County Commission met in regular session on Wednesday, April 9, 2014 at 10:00
a.m. in the Marshall County Commission Chambers.

Chairman Hutcheson called the meeting to order and asked Phillip Cody, Pastor The River
Church of God, to deliver the invocation. He then asked Commissioner Bill Stricklend to lead the
Pledge of Allegiance.
CONSENT AGENDA
A motion was made by Commissioner Martin, duly seconded by Commissioner Kelley, all
members voting affirmatively and so carried to approve the consent agenda as read by Chairman
Hutcheson. The consent agenda includes the minutes from the March 26, 2014 commission
meeting and the claims docket for March 22, 2014 – April 7, 2014 in the amount of $831,338.05.
APPROVE PROCLAMATION FOR APRIL AS SARCOIDOSIS AWARENESS MONTH
A motion was made by Commissioner Stricklend, duly seconded by Commissioner Hale, all
members voting affirmatively and so carried to approve April as Sarcoidosis Awareness Month.
PROCLAMATION
WHEREAS, once thought to be a rare disease, sarcoidosis is now known to affect people of all ages, races and genders; and
WHEREAS, sarcoidosis is an inflammatory disease that can affect almost any organ in the body and causes heightened immunity, a
condition that results in overreaction of the immune system, resulting in damage to the body’s own tissues; and
WHEREAS, the classic feature of sarcoidosis is the formation of granulomas, microscopic clumps of inflammatory cells that group
together, interfering with organ function; and
WHEREAS, in the United States, sarcoidosis most commonly targets the lungs and lymph nodes, but can also affect the skin, eyes,
liver, salivary glands, sinuses, kidneys, heart, the muscles and bones, the brain and nervous system; and
WHEREAS, though the exact cause of sarcoidosis is not known, current research indicates that in individuals who are genetically
susceptible to sarcoidosis, exposure to bacteria, viruses or chemicals might trigger the disease; and
WHEREAS, while progress has been made in understanding the symptoms and better diagnosing the disease, there is still much to
learn about sarcoidosis, but with increased research, the goal of discovering the cause, improving treatment and finding a cure is
attainable:
NOW, THEREFORE, I, James Hutcheson, Chairman of the Marshall County Commission and in such capacity, do hereby proclaim
the month of April 2014, as SARCOIDOSIS AWARENESS MONTH in Marshall County, Alabama.

APPROVE DIRECT SUPPORT PAYMENT TO BOAZ CHAMBER OF COMMERCE FOR FIRST
ANNUAL “ALABAMA FARM & POULTRY EXPO”
A motion was made by Commissioner Hale, duly seconded by Commissioner Kelley, all members
voting affirmatively and so carried to approve direct support payment in the amount of $1,000 for
First Annual “Alabama Farm & Poultry Expo”. This will be paid from contingency fund.
EMA – APPROVE XEROX COPIER CONTRACT; $219.70 MONTHLY – 36 MONTH LEASE
A motion was made by Commissioner Hale, duly seconded by Commissioner Kelley, all members
voting affirmatively and so carried to approve Xerox copier contract in the amount of $219.70
monthly for a 36 month lease.
JUVENILE PROBATION – APPROVE CONTRACT BETWEEN MARSHALL COUNTY
COMMISSION AND YOUTH ADVOCATE PROGRAMS, INC.
A motion was made by Commissioner Martin, duly seconded by Commissioner Stricklend, all
members voting affirmatively and so carried to approve contract between Marshall County
Commission and Youth Advocate Programs, Inc. This is a standard annual contract using funds
from a DYS grant.
APPROVE EMPLOYEE VEHICLE USE POLICY
A motion was made by Commissioner Hale, duly seconded by Commissioner Kelley, all members
voting affirmatively and so carried to approve employee vehicle use policy.
VEHICLE USE POLICY
Marshall County Commission provides employees holding certain positions a vehicle to perform business duties. The
Elected Official may require an employee to commute in the county-provided vehicle due to the need for the
employee to be available outside normal business hours or to have access to equipment on the vehicle/truck.
It is the policy of the Marshall County Commission that county-provided vehicles are not to be used for personal
purposes other than for commuting or de minimis personal use (such as a stop for a personal errand on the way
between the work location and the employee’s home). Personal use of a vehicle is all use that is not for business
related purposes.

APPROVE SELL, TRADE OR SCRAP OF FIXED ASSETS
A motion was made by Commissioner Stricklend, duly seconded by Commissioner Martin, all
members voting affirmatively and so carried to approve sell, trade or scrap of fixed assets.

APPROVE BID INVITATION FOR PIER AT PARK 1
A motion was made by Commissioner Martin, duly seconded by Commissioner Kelley, with
Commissioner Stricklend voting nay, Commissioner Hale voting nay and Chairman Hutcheson
voting yay and so carried to approve bid invitation for T Pier at Park 1.
APPROVE BID INVITATION FOR COVERED PICNIC PAVILION(S) FOR PARK 1
A motion was made by Commissioner Martin, duly seconded by Commissioner Hale, with
Commissioner Stricklend voting nay and Commissioner Kelley voting yay and so carried to follow
recommendation of County Engineer Pirando and approve the bid invitation for covered picnic
pavilion(s) for Park 1.

APPROVE RECORDS REQUEST FORM
A motion was made by Commissioner Stricklend, duly seconded by Commissioner Martin, all
members voting affirmatively and so carried to approve records request form. As calculated by
the County Attorney, the charges for records research are tied to the lowest level of the pay scale
in the commission office for the employee doing the research. The amount for research is
$10/half hour and copies are $.25 per copy.
APPROVE REQUIRING CONTRACTORS TO HAVE INSURANCE WHEN PERFORMING
WORK FOR THE COUNTY
A motion was made by Commissioner Stricklend, duly seconded by Commissioner Hale, with
Commissioner Martin voting nay and Commissioner Kelly voting yay and so carried to approve all
contractors performing work for the county have general liability insurance in the amount of one
million dollars, workers compensation insurance, the appropriate business license and the ability
to be bonded.
ANNOUNCE PALS “DON’T DROP IN ON ALABAMA” DAY – APRIL 26, 2014
Chairman Hutcheson announced PALS “Don’t Drop in on Alabama” Day will be April 26, 2014
with a spring cleanup week being April 19-26, 2014.
APPROVE VOLUNTEER FIRE DEPARTMENT AND RESCUE SQUADS PLANS AND
PROCEDURES
A motion was made by Commissioner Stricklend, duly seconded by Commissioner Kelley, all
members voting affirmatively and so carried to approve Marshall County Fire Department and
Rescue Squads Plans and Procedures for the Formation, Evaluation, Funding and Dissolution of
Volunteer Fire Districts.
APPROVE FIRE DISTRICTS FOR MARSHALL COUNTY FIRE & RESCUE SQUAD
A motion was made by Commissioner Hale, duly seconded by Commissioner Stricklend, all
members voting affirmatively to remove this item from the table.
A motion was made by Commissioner Hale, duly seconded by Commissioner Martin, all members
voting affirmatively and so carried to approve four (4) fire districts for Marshall County Fire &
Rescue Squads. Georgia Mountain and Four C Volunteer Fire Departments for District 1. Hebron
and Sweargin Volunteer Fire Departments for District 2.
APPROVE BID FOR TRUCK
A motion was made by Commissioner Stricklend, duly seconded by Commissioner Martin, all
members voting affirmatively to remove this item from the table.
A motion was made by Commissioner Stricklend, duly seconded by Commissioner Hale, all
members voting affirmatively to follow recommendation of County Engineer Pirando and approve
bid for 4WD truck to Gilbert & Baugh in the amount of $28,896. This is the third lowest bid. The
lowest bid did not meet specifications. The second lowest was outside of the county.
Commissioner Stricklend envoked the 3% preference for in-county and approved acceptance of
Gilbert & Baugh bid for truck.

There being no further business; a motion was made by Commissioner Stricklend, duly seconded
by Commissioner Hale and so carried to adjourn.
