FACT SHEET THE DEVELOPMENT PLAN OVERLAY A DPO ensures that the development of a large site or sites is well-coordinated and meets community aspirations and strategic goals for the area. The strategic goals for Highpoint are set out in the draft Highpoint Planning and Urban Design Framework. FREQUENTLY ASKED QUESTIONS What is a Development Plan Overlay? A Development Plan Overlay (DPO) requires a landowner to prepare an overall Development Plan to guide redevelopment of a site or area. A schedule to the DPO lists all the requirements for the plan, such as the location of pedestrian and road links and the design of new buildings. The proposed schedule for the DPO areas within Highpoint is Schedule 17, which will apply to Precincts 3, 5 and 6. See map overleaf. The Development Plan must generally be in accordance with the DPO Schedule, and changes to the requirements of the DPO Schedule can only be made through a planning scheme amendment. What about areas where the DPO isn’t proposed? In most other parts of Highpoint, a Design and Development Overlay is proposed. The DDO has the same goals of developing a walkable, liveable community. In determining which overlay to apply, Council followed the Victorian Government’s guidelines. How does the DPO work? Schedule 17 to the DPO clearly sets out the requirements for a Development Plan in Precincts 3, 5 and 6 in Highpoint. Applications for planning permits must then meet the comprehensive Planning and Urban Design Framework AND amendment C135 requirements of the approved Development Plan, including showing how the plan implements the Highpoint vision for a vibrant, mixed-use walkable community. Notice and review A Development Plan Overlay does not provide for notice and review of planning permits by third parties. In commercial zones and industrial zones, this does not affect third parties, as these zones normally do not provide for notice and review. However in a Mixed Use Zone, applying a DPO does make a difference, because this zone usually has notice and review provisions. In areas of Highpoint that will move to having a Mixed Use Zone and a DPO, the public exhibition process for Amendment C135 is the time to comment on the requirements for a Development Plan. Once the DPO is in place, the community has clarity about the expected form of development. Permit applications will then be assessed against the Planning Scheme, including the Development Plan which accords with DPO Schedule 17, without third party notice and review.
