Bahraich district is situated in the state of Uttar Pradesh, India, located on the Saryu river a tributary river of Ghaghra. Bahraich is 125 km north east of Lucknow, the state capital. The towns of Barabanki, Gonda, Balrampur, Lakhimpur and Sitapur share local boundaries with Bahraich. A factor which makes this town important is the international boundary shared with the neighbouring country Nepal. According to government of India, the district Bahraich is one of the minority concentrated district in India on the basis of the 2001 census data on population, socio –economic indicators and basic amenities indicatory. Bahraich district has many places of religion and historical value. Through evidences and facts we came to know that in the 11th century the nephew of Mahmood Ghaznavi invaded this city. The Dargah of Syed Salar is 7 situated 3 km north of Bahraich city. It was built by Firoz Shah Tughlaq. Next is Chittaura Jheel that is situated at around 8 km between Bahraich and gonda road. It is 126 meters (413 feet) above sea level. Bahraich borders Nepal districts Bardiya to the northwest and Banke to the northeast. The rest of Bahraich is surrounded by other districts in Uttar Pradesh: Lakhimpur and Sitapur on the west, Balrampur to the southwest, Gonda to the southeast, and Shravasti to the east. District Bahraich is situated in north eastern part of Devipatan division. It is situated between the 28.24 and 27.4 latitude and 81.65 to 81.3 eastern longitude. The area of district Bahraich has a international border with Nepal on the northern part. The electoral roll is a list of all people in the constituency who are registered to vote in Indian Elections. Only those people with their names on the electoral roll are allowed to vote. The electoral roll is normally revised every year to add the names of those who are to turn 18 on the 1st January of that year or have moved into a constituency and to remove the names of those who have died or moved out of a constituency. An analysis of number of voters with EPIC cards showed that on an average only about 40 % of the population had EPIC cards throughout Uttar Pradesh. Many eligible voters did not have voter ID cards. The Election Commission of India has held meetings since July 2011 with all divisional level and District level officers in order to improve these ratios. In order to increase number of voters of Bahraich district special drives were undertaken by the District administration to improve the EP ratio and Gender Ratio. All eligible voters upto age 18 as on 1 jan 2014 were made voters. The EP ratio of Bahraich district has improved from 58.64 % to 62.29 % and Gender ratio has improved from 822 to 845 as on May 2014. A copy of the revised electoral roll has been received to all Political parties of district . Continuous updation is still going on.The updating of the Electoral Roll only stops during an election campaign, after the nominations for candidates have closed. Subsequently supplymentary copy with all additions, deletions and corrections will be given to all political parties. Polling stations are usually set up in public institutions, such as schools and community halls. To enable as many electors as possible to vote, the officials of the Election Commission try to ensure that there is a polling station within 2km of every voter, and that no polling stations should have to deal with more than 1600 voters. In such cases where voters are >1600 then auxillary polling booths are set up. Each polling station is open for at least 10 hours from 7am to 5pm on the day of the election. On entering the polling station, the elector is checked against the Electoral Roll, and allocated a ballot paper. The elector votes using EVM in the polling booth. All pooling booths have voters <1600. Other reasons for making new polling stations include • • • Need to reduce the distance required to be traveled by voters. At each polling station, Infrastructure, road, approach road, building, drinking water and ramp facilities are provided and is physically verified by going through three levels of checking. First level checking- The first level checking is of basic level. The activity of first level checking is performed by Lekhpals and Panchyat secretries. After getting the feedback report of first level checking a meeting is held with concern officers like DPRO, BSA, DIOS, EE PWD, EE RES, ZILA PANCHYAT, DD MANDI, JAL NIGAM etc and the feed report is discussed. The officers were instructed to complete all the requirements such as, Infrastructure, approach road, building, drinking water and ramp facilities. Second level checking- After getting report of instructions given to the above said officers the second level checking took place. The activity of second level checking is performed by Sector officers from 25th to 30th August 2014. All relevant particulars like Name, Sex, Place (constituency) of residence, work place, Home Constituency, Designation, Office and Department/Institutions has been entered. The database contains all the State Govt. employees data including teachers etc. who can be employed as polling personnel. The polling parties shall be formed out of the State Govt. employees mostly teachers, town areas staff, departments staff etc. The Central Govt. employees including PSUs and Banks, etc.has been fed to be utilized for selecting suitable persons as Micro Observers. Presiding Officers and Polling Officers have been classified on the basis of scale of pay and their post and rank. Gazetted Officers will be deployed as Presiding Officers. The existing database has 12483 persons which is sufficient to manage elections internally. Special permission has been requested to ECI to include shikshamitr to be deployed as polling personnel in this regard. From this full database of officers, a list of 120% of the required number of polling persons should be generated (including reserve) randomly, using the software. This is the first of the three-stage randomization process. Presence of observers is not required at this stage. It should be noted that this randomized list is DEO-wise and not at any other level like subdivision, tehsil, block, assembly constituency etc. This is only to identify and select the officials that would be given training for poll duties as presiding and polling officers in whichever constituency of that district. In no case, at this stage, the identity of the assembly constituency to which the polling personnel are likely to be deployed will be known. All that the 47 polling personnel will know at this stage is whether he (or she) is a presiding officer or a polling officer and the venue and time of trainings. The second stage of randomization exercise should be done in the presence of the Observers deployed in the constituency. At this stage actual polling parties shall be formed on random basis using the randomization software. The Observer must be present at this stage. At this stage though the actual polling station will not be known, however, the Assembly Constituency and the team composition may be known. This randomization should not take place before 6 or 7 days from the day of poll. For the purpose of serving the appointment letters, the DEO can use the services of the sponsoring departments/ authority and/or organize a training programme of poll personnel in team formation on that date when final briefing can be given and appointment letters issued to them. It will also facilitate Postal Balloting.The third stage of randomization exercise shall take place at the time of dispersal of polling parties when the allocation of polling stations to the poling parties will be done. Among the polling materials, special attention would be given to EVMs, ballot papers (for tendered ballot) and the marked copies of the electoral roll. Items like EVMs, ballot papers for fixing on EVM and for tendered votes, voting compartments, indelible ink, strip seal, paper seal, sealing wax, arrow cross mark, metal seal etc. would be supplied by office of the CEO, while the remaining items (for distribution to polling parties, counting arrangements etc) shall be procured locally by tender committee and handed over to Material Cell for distribution to polling parties. The local procurement shall be done by the Election Branch observing all the required formalities. 7.6 BALLOT PAPERS The number of ballot papers required for the AC would be around ----------. One Assistant Returning Officer will be entrusted at the appropriate time to collect the ballot papers from the Govt. Press. Sorting and scrutiny of ballot papers will take place on receipt under his supervision after which the same shall be stored appropriately. On the day of EVM setting, the ballot papers would be handed over to the I/C, EVM Cell for preparation of EVMs and also to I/C Material Cell for packing the same P.S. wise (for tendered ballots). The postal ballot paper for all the ACs would be printed by locally by the Ballot Paper Cell including envelops (Form 13B, 13C) and sent for issue. 7.7 EVMS An Electronic Voting Machine consists of two Units – a Control Unit and a Balloting Unit – joined by a five-meter cable. The Control Unit is with the Presiding Officer or a Polling Officer and the Balloting Unit is placed inside the voting compartment. Instead of issuing a ballot paper, the Polling Officer in-charge of the Control Unit will press the Ballot Button. This will enable the voter to cast his vote by pressing the blue button on the Balloting Unit against the candidate and symbol of his choice.The EVMs were devised and designed by Election Commission of India in collaboration with two Public Sector undertakings viz., Bharat Electronics Limited, Bangalore and 53 Electronics Corporation of India Limited, Hyderabad. The EVMs are now manufactured by the above two undertakings.EVMs were first used in 1982 in the by-election to North Paravur Assembly Constituency of Kerala for a limited number of polling stations (50 polling stations) The EVM requirement was calculated with 35% reserve and 5 % training requirements in mind. Special training will be imparted to those involved in EVM setting. Concerned Zonal Officers shall also be involved in the process. The EVMs shall be kept in the strong rooms after preparation at RO level. This is expected to be done in the second week of September 2014. These EVMs would be issued for polling and after receipt shall be kept again in the strong rooms. The Zonal Officers shall give a certificate to the effect that the EVMs for their zones have been set properly. 7.10 MARKED COPY OF ELECTORAL ROLL Electoral roll will be used for the ensuing election. The Dy Election Officer and ADEO will ensure preparation 4 (four) sets of marked copies of electoral rolls per polling station. Three copies shall be handed over to the polling parties, while one copy shall be kept reserved for carrying by Zonal Magistrates/Zonal Officers. 54 7.11 DESPATCH AND RECEIPT OF POLLING MATERIALS All the polling parties shall be despatched on 12 september 2014. At first, all polling personnel would report at Mandi samiti Bahraich and shall be despatched from there to different polling stations accordingly. Allotment of polling stations to polling parties shall be done by the Personnel Cell. This information shall be displayed prominently on Boards at the despatch centre. The receipt of polling materials parties shall be done at Mandi Samiti. However, the number of counters would be increased to at least 15 at the time of receipt of polling materials. The venue for the recieve would be Mandi Samiti, bahraich. All parties shall report to the Transport Cell which will arrange for their transport for sending them to their respective polling stations. Payment of remuneration at the prescribed rates would be made to the polling personnel when they receive the polling materials. The distribution and receipt of materials would be done by Material Cell. Payment of remuneration shall be done by Bill Cell while Refreshment Cell will provide them refreshment coupons for lunch and dinner. Construction Cell shall construct the required counters. Consequent upon receipt of EVMs and specified materials from the receipt counters, the sealed EVMs along with Form No 17C, paper seal a/c covers will be safely stored in serially numbered earmarked spaces in the strong room. Construction Cell shall ensure floor marking/ rack marking etc in advance to streamline the proper storage of sealed EVMs AC wise. Immediately after all the EVMs are received and stored, the strong room will be locked and sealed as per procedure. The Officer in Charge, Strong Room Cell will ensure this. DHWO 9452181204 58 8 MOVEMENT PLAN 59 Movement plan – Before commencement of polls 8.1 Movement Plan Polling parties and the security persons will be dispatched from concerned distribution centers and sufficient vehicles have been arranged for their dispatch. Vehicles required will be engaged for this purpose. Security cover for dispatching and receiving polled election materials are being arranged. Movement of the polling parties from respective distribution centers to the concerned polling stations will take place on the before day of polling. There will be one route officer for every vehicle who will be very familiar with the area assigned to him. The route officer will drop the party at the concerned polling station location. In cases where the buses are not having road access it will be connected by jeep so as to reach them at the door step of the polling location. The transportation vehicles will halt at the last destination by dropping all the polling personnel. The return journey of the vehicle will be from the last halt point and scheduled in such a way that the last dropped will be alighted at first. Vehicles will be guarded by the armed Police through its scheduled journey. There will be 14 tables and each table containing two persons (1 counting supervisor & 1 assistant) in addition to the Static Observers. Counting will be taken place in the presence of Observers. During the previous election number of officers drafted for counting duty was 60 Lok Shabha election now the expected number of official is 60. Officers from the Central & State government will be deployed for the purpose. This may be subjected to change as per the decision of the Observers. Infrastructure and logistics arrangements (refreshment, stationary, Counting hall arrangements and communication facilities) will be made in due course. Arrangements will be made for issuing passes for accredited media persons. Sufficient security will be arranged for counting stations. Arrangements are made for online updating of data from the counting centers to the Election Commission website. COUNTING PLAN 10.1 Legal provisions The counting of votes at an election where voting machines are used is regulated by the provisions of Rule 66A of the Conduct of Elections Rules, 1961 (Amendment of 1992). Rules 55C, 56C and 57C provide for the scrutiny and inspection of voting machines before the counting, actual counting of votes recorded in the voting machines and sealing of voting machines after the counting. The provisions of Rules 50 to 54 relating to time and place for the counting of votes, appointing of counting agents and revocation of such 67 appointments, admission to the place fixed for counting and maintenance of secrecy of voting are also applicable as in the case of counting of votes where the system of ballot papers and ballot boxes is followed. Rules 60 to 66 providing for continuous counting, re-commencement of counting after fresh poll, recount of votes, declaration of result of election, counting at two or more places and grant of certificate of election to returned candidate shall also apply in relation to voting by voting machines and any reference in those rules to ballot paper shall be construed as including a reference to the voting machine. Rule 54A provides for the procedure for counting of votes received by post 10.2 Storage of polled voting machines Polled voting machines will be stored in the newly constructed strong room on the same floor at 16.9 metres from the counting hall. This strong room will house only the polled EVMs and the election papers connected with the current elections. 10.4 Appointment of counting personnel Sufficient officers have been earmarked for appointment as Counting Supervisors and Counting Assistants. One Counting Supervisor and one Counting Assistant per table and sufficient Group D staff to carry the voting machines to and from the counting tables will be deployed. Intensive training of counting personnel will be given in time. 10.5 Security arrangements A three-tier cordoning system will be set up in all counting centers to prevent the entry of unauthorized persons inside the counting centre. No counting agent without proper identity card having the photograph, duly displayed on its person, will be allowed to cross the first cordon of the counting centre. The identity of all candidates, their election agents and of all the counting staff will also be thoroughly verified with reference to their identity cards at the first cordon. The first cordon will be set up at the main entrance to the office building. A metal detector will be installed at this location. CPMF personnel from the 68 day of poll till the sealing of the voting machines and election papers are completed after counting of votes. 10.6 Deployment of CPMF at counting hall/ strong room One Company of CPMF will guard the Strong Room/Counting Hall round the clock w.e.f. 13 september 2014 till the completion of counting and final announcement of the election result. The Force will remaining position till withdrawal order is given. 10.7 Barricading of counting tables A Barricading about five feet high made of strong yet transparent material, such as wire mash or PVC netting will be put up around the counting table and the counting personnel. One entrance will made for taking in and bringing out the voting machines. The door of the entrance is proposed to be lockable only from the inside by the counting supervisors. 10.8 Communication facilities within the counting hall One telephone line without STD facility will be placed at the ROs table. One telephone line with STD facility and fax machine will be placed in the observer's room/cubical. One telephone line with STD facility and fax machine will be placed at the data manager table adjacent to the RO's table. 10.9 Room for the observer inside the counting hall A separate room /cubical with tables and chairs, a telephone with STD and a fax and a toilet attached to it will be provided inside the counting hall for the use of the Observers. The communication facilities will be reserved for the exclusive use of the Observers for there communication with the Commission, in strict confidentially. The number of this telephone will be obtained from the BSNL authorities at lest 15 days a head of the counting and made known to the Chief Electoral Officer and the Commission. 10.10 Data Management The Data Management Cell will be located adjacent to the Returning Officer's table. One computer, printer, UPS, telephone attached with a fax machine, 69 internet and sufficient stationary will be provided. The following Officers and staff will main the Data Management Cell1- Shri Vidya Shanker Singh, Dy. DEO/ ADM, Bahraich. 2- Shri Syed Ansar Rizvi, DIO, NIC, Bahraich. 10.11 Seating arrangements for counting agents Counting agents will be seated at each counting table in the following order1) Candidates of National Recognized Political Parties 2) Candidates of Recognized State Parties 3) Candidates of Recognized State Parties of other state who have been permitted to use their reserved symbols in the Constituency. 4) Candidates of recognized- unrecognized Political Parties. 5) Independent Candidates. Counting agents will be seated out side the barricades which enclose the counting personnel and the counting tables, in such a way that they have a clear view of the counting process but are not in a position to reach out and handle the control unit. 10.12 Number of counting agents Each candidate will be allowed to appoint as many counting agents there are counting tables and one more to watch the count at the Returning Officer's Table. 10.13 Sequence of counting Firstly, all person who are allowed to enter in the counting hall will be given adequate warning about maintaining secrecy of votes as provided under Section 128 of the representation of the people act 1951. The postal ballots received in time will be counted first at the RO's table and the particulars will be entered in the working sheets Constituency 70 wise and candidate wise. Male and female voters will be indicated as these particulars will be required for entry in the Index Card later. While the postal ballot paper of constituency are being counted. the control unit of the electronic voting machine of constituency will be distributed to the 14 (fourteen) counting table in serial order of the polling station. Only after the postal ballot paper have been counted and results tabulated will the counting of votes polled in the control begin. Since there will be only one counting hall the counting of votes will be taken up in ascending order of the constituency number. the counting of votes for each assembly constituency will be completed in two rounds of counting. The later round of counting in respect of each constituency will be the final round of counting. That being so, announcement of the details of votes in each second round would indicate the final result of constituency. Therefore, details of votes in the second round of counting shall not be announced until and unless necessary entry in the final result sheet is completed, sign by the Returning Officer and thereafter counter singed by the Observer. Only then would the details of votes be announced by the Returning Officer. However, in the event of the Observer not being readily available, the process of data flow will be carried on. Notwithstanding anything above, the final result of the counting of votes should be sent to the commission and the CEO by fax or through VSAT/ dial up connection using GENESYS Software, if required as soon as counting of the votes of the constituency is completed. 10.14 Media Centre The media centre is proposed to be set up in the Mandi. A television, Telephones intercom and internet facilities will be provided at the media centre. The result of each round of counting will be announced by the officer in charge in media center or any of his assistant, to be designated by the in charge. 71 10.15 Entry into counting hall & maintenance of discipline No person other than those mentioned under Rule 53 (1) of the conduct of Elections Rules, 1961 will be allowed inside the counting hall. Only the following persons can be allowed inside the counting hall(1) Counting supervisors and counting assistants, (2) Persons authorized by the Election Commission. (3) Public servants on duty in connection with the election; and (4) Candidates, their election agents and counting agents. However, entry of persons other than officials engaged in the counting of votes will be regulated by the Returning Officer in such a manner as may be required for maintaining discipline in the counting hall. Smoking carrying of cellular phones, cordless phones and wireless sets will not be allowed inside the counting hall. 10.16 Refreshments Adequate refreshments will be provided for all counting personnel, candidates, their election agents, counting agents, security personal, media persons, officers and staff on duty on the day of counting. Krishi Utpadan Mandi Samiti assisted by sufficient number of staff will be in-charge of provision of refreshment. 10.17 Fire tender The services of the uttar pradesh police fire organization will be requisitioned to keep watch over any event of fire in and around the counting centre. 10.18 Medical Duty The services of the health department will be requisitioned to be on medical duty at the counting center on the day of poll. 72
