NATIONAL GARNISHEE ASSIST
National Garnishee Assist (NGA) is a company owned by four black registered
debt counsellors in terms of the national Credit Act of 2005. These are Marilyn
Williams, Reginald Matjokana, Keystone Sono and Randall Adams. Their
experience in the credit market prompted the establishment of the venture with
the view to providing a full scale and assessment service to employees who may
be victims of over-indebtedness and unlawful activities by credit providers.
National Garnishee Assist’s key objective is to effectively assist with Debt
Clearing Solutions and Debt Relief Programs for organized institutions and
consumers to understand the importance of employee and consumer Self
Responsibility and keeping Financial Credibility for the employees within
organized institutions and consumers.
We pursue to protect and create positive financial attitudes within the South
African credit market so as to relieve consumers of undue financial pressure and
be able to contribute to a healthy South African Economy. Our main focus is to
promote accessibility to Asset Based Loans to consumers ensuring they become
Organized, Disciplined and Responsible, thus enhance the quality of lives in
respect of financial decisions and the quality of loans the credit provider’s
advance.
Overall, it is the NGA’s primary objective to contribute to a stabilised financial
environment and economy, through reducing the risk of credit and eradicating
instruments that inhibits challenges as debt relief mechanisms for the benefit of
the South African credit market.
With the introduction of the National Credit Act of 2005, personal loans were no
longer easily accessible due to the affordability assessments credit grantors are
obligated to do. This left consumers feeling as there was nowhere to turn as
Loans were now being declined! and the only solution was to approach
unsecured lenders, which move has led to escalating numbers of over-indebted
consumers, default judgments, garnishee orders and administration orders.
We at NGA felt obligated to develop programme that will systemically assist
consumers towards financial freedom.
The founders of NGA have gained a lot of experience and expertise in the
credit industry by being in the executive committee of the black debt
Counsellors Forum and are members of the Credit Industry Forum.

To empower individuals/consumers within organisations, institutions and
communities through innovative and customised programmes and leverage
their collective expertise for enhancing effective financial management
through the provision of quality service
CAPABILITY STATEMENT
NGA offers the following customised interventions for individuals within
institutions, organisations, departments, and companies:
1– OVER-INDEBTEDNESS
We conduct a full scale assessment of the consumer/member/employee’s
financial situation with regard to their income, living expenses and debt
obligations. We also establish the method which is used to repay creditors, i.e
cash payment or debit order.
We stop debit order payments so as to effectively restructure obligations.
The process also entails drawing the employee’s credit profile so as to determine
and confirm any blacklisting recorded with a view to intervening in an informed
manner.
Consumers who are over-indebted are placed under debt review and their
assets are protected from being repossessed by credit providers.
2– GARNISHEE ORDER RESCISION
Both employers and employees are currently inundated with the pressures of
EAO (emolument attachment orders) & garnishee orders – NGA is offering value
added services by assisting with these orders:

We verify the authenticity.
Nullify unlawful garnishee orders.
Rescind garnishee orders in court.
We also assist consumers, who have overpaid, to claim what is due to them.
3- ADMINISTRATION ORDER RESCISION
Prior to the enactment of the National Credit Act (NCA), the Law commission
was inundated with the abuses and prejudice of the effect of Administration
orders had on employees.
The Law commission embarked on reviewing the Magistrate’s Court Act in so far
as it relates to Administration orders.
However, unsuspecting consumers were still lured into applying to be placed
under Administration.
NGA has since been assisting consumers/ employees in the South African credit
industry to rescind the Administration orders and pay their credit providers
directly to circumvent the inundated problems plaguing the Administration
related challenges.
Rescinded Administration orders enable over-indebted consumers to be assisted
through debt review.
4- CREDIT BUREAU PROFILES
NGA, after drawing the consumer’s credit profile with their consent, is able to
clear all adverse listings and judgments in terms of the provisions and regulations
of the amended National Credit Act.
This will enable the consumer to access credit without paying high interest and
charges.
