This permit is not required for vendors operating from fixed privately owned land but a Planning
permit may be required, please contact Council for more information
Ice cream vendors may stop whenever hailed by the public and are not permitted to
permanently stop outside schools
Mobile Vendors that fall under the description of ‘Mobile food vendor’ selling freshly prepared
‘while you wait, ready to eat food‘ must abide by the attached conditions;
*Operating without a valid and approved City of Maribyrnong permit may lead to
prosecution and non approval of future permit applications

28.
Persons Selling Goods
28.1
Unless permitted under an applicable Planning Scheme a person must not, without a permit, sell
or display any goods from - (b) a vehicle; (c) a caravan; (d) a trailer
standing or placed on: (j) a road; (k) a footway;
(l) Council land;
(m) vacant land; or (n) land which is not ordinarily occupied by the person.
Penalty: Twenty (20) penalty units

Public Liability Insurance
A current copy of the business Public Liability Insurance Policy or Certificate must
accompany each application. A minimum amount of 10 million dollars must apply.
This policy must remain valid for the length of the permit.
Please contact your insurance company and arrange for the following words under the
Public Liability clause:
“Interested Party: Maribyrnong City Council”, or “Maribyrnong City
Council are noted for their respective rights and interests”.
Mobile Food Vans (MFV) Permit Conditions
1.
All food activities must be conducted in accordance with the Food Act 1984, Meat Industry Act
1993, Seafood Safety Act 2003 and Dairy Act 2000
2.
Applicants are to provide Maribyrnong City Council’s Environmental Health services with a
‘Statement of Trade’ prior to applying for this permit, please contact Environmental Health Services
on 9688 0200 to obtain further information
3.
The operator must abide by all parking restrictions and must not create an obstruction on any road,
thoroughfare or footpath
4.
The operator must observe and maintain a safe environment for the public from street traffic.

5.
The operator is to follow reasonable directions by a member of the Victoria Police force or by an
Authorised Council Officer
6.
A copy of this permit must be presented for inspection by the operator, whenever requested by a
member of the Victoria Police force or by an Authorised Council Officer
7.
This permit is granted to the business and for a listed vehicle and is not transferable and if the
business is sold the new owners must re-apply
8.
The operator must not place any tables, chairs, portable generators, advertising frames or any
other item other than a Maribyrnong City approved litter bin on Council land (An approved litter bin is a
receptacle that deposited litter cannot escape from it without human assistance as per EPA)
9.
Litter must be cleared at all times from in and around the MFV site by the operator
a.
Appropriate litter bins must be provided by the operator to service the needs of patrons
and the operation
b.
Litter generated by the MFV operation is to be picked up and deposited within the
operator’s own bins.
c.
MFV litter must not be placed in public street bins
10. Unless the business is an ice cream van, no amplification of music or sound is permitted.
11. The operator is not to create a nuisance to nearby residents or adversely affect surrounding
businesses, a distance of 100 meters must be maintained from any fixed food operating businesses
12. Operators are not permitted to attend any Sporting, Festival or Community Event, without Council’s
written consent. A distance of 100m must be maintained from the reserve or site while the event is
taking place. This is to allow these groups to generate revenue from the associated event activities
13. Permits are granted on annual basis or alternatively as a one day event/festival permit
14. Operating MFV vehicles must be kept clean and not appear to be unsightly or contain graffiti
A maximum number of 25 MFV will be granted permits to operate within Maribyrnong
City Municipal District

Note: This permit is granted subject to the provisions of the MARIBYRNONG CITY COUNCIL General Purpose Local
Law. Part 12, Section 28 and must be produced upon request by an authorised officer. Failure to comply with the above
conditions may result in the permit being revoked and the permit holder liable to prosecution.
