原稿種別:原著論文(2005 年 6 月) タイトル：The costs of medical malpractice litigation in Japan： The payment at the stage of bringing the complaint （日本における医療訴訟の費用：提訴時の支出額） 著 者 :Shoichi Maeda1), Kazuki Sakaguchi2), Etsuko Kamishiraki 3) 1) Center for Biomedical Ethics and Law, Graduate School of Medicine, the University of Tokyo 2) Department of Health Services Coordination, Graduate School of Medical Sciences, Kyushu University 3）Department of Social Welfare, Graduate School of Integrated Human Studies and Social Sciences, Fukuoka Prefectural University 【概 要】 本研究は、医療訴訟（民事）提訴時における原告の支払額（着手金＋印紙代） を明らかにしたものである。 研究の対象は、1995 年から 2004 年までの過去 10 年間に、東京地方裁判所が 判決した判決文（公刊）である。 上記の費用は、平均 289 万円であった。また、この費用は、患者の年齢に反 比例して高額になっていることが明らかになった。例えば、患者の年齢が 10 歳 未満の場合、その額は 400 万円であった。 なお、訴えを提起するにあたり、原告は、必ずしも代理人に事件の処理を依 頼する必要はないが、本研究においては、92,8%の事件において、原告患者側に 代理人が選任されていた。
