（目的）
第１
本要綱は、アジアヘッドクォーター特区内に新たに拠点を設ける外国資本法人に対し、拠点設立
等に必要な経費に関する補助金を交付することで、外国企業の誘致を促進することを目的とする。
（用語の定義）
第２
この要綱において、次の各号に掲げる用語の定義は、それぞれ当該各号の定めるところによる。
(1)
アジアヘッドクォーター特区
総合特別区域法に基づき東京都が申請し、平成 23 年 12 月 22 日に内閣総理大臣から指定を受け
た国際戦略総合特別区域
(2)
外国資本法人
外国法に基づき設立された法人等の出資割合が３分の１超の法人
(3)
設立等
法人の設立、支店の設置等、本補助金の対象となる拠点を設ける行為
(4)
高付加価値拠点
業務統括拠点又は研究開発拠点としての機能を有する拠点
(5)
業務統括拠点
２以上の国等に存在する被統括拠点に対して、被統括拠点の事業の方針の決定又は調整に係る業
務（事業の遂行上重要なもの（営業・販売・マーケティング、経営企画、財務・金融、人事・人材
育成、研究開発、生産管理、物流、法務等）とする。）を一括して行うための拠点

研究開発拠点
産業技術の研究から応用開発、試作、製品試験等による産業化等の研究開発を行うために必要な
機能を有する拠点
(7)
従業者
雇用保険の被保険者となる者
(8)
ビジネスコンシェルジュ東京
東京都が開設した、外国資本法人等の東京進出及び事業活動をサポートするための支援機関
(9)
ビジネス支援サービス申込書
外国資本法人が、ビジネスコンシェルジュ東京にビジネス支援業務を依頼する際に、提出する書
類
(10) 補助対象経費
東京都知事が適当と認めた補助金の対象となる経費であり、(11)から(13)までのうち、消費税及
び地方消費税相当額、官公署に支払う費用等、サービスの提供に該当しないものを除いた経費
(11) 在留資格取得経費
拠点設立等に係る企業活動において、在留資格の取得に係る申請代行等に要する経費
(12) 拠点設立及び各種届出経費
法人登記及び税務、社会保険等の届出に係る申請代行等に要する経費
(13) 人材採用経費
拠点を設ける際、職業安定法第 30 条第１項に定める有料職業紹介事業者からの紹介により、１
年以上雇用する人材を採用することに伴い当該事業者へ支払う経費
(14) 年度
ある年の４月１日から３月 31 日までの期間
（補助対象者）
第３
補助金の交付対象者は、次のいずれかに該当する法人とする。
(1)
申請日の属する年度内に、アジアヘッドクォーター特区内に高付加価値拠点を設ける外国資本法
人
(2)
東京都への相談時において日本未進出であり、申請日の属する年度内に、アジアヘッドクォー
ター特区内に拠点を設け、進出後に高付加価値拠点を設ける意思及び考え方が確認できる外国資本
法人

補助金の交付対象者は、以下の要件を全て満たす法人とする。
(1)
交付対象拠点において、代表者のほかに、前項(1)に該当する場合は３人以上、前項(2)に該当す
る場合は１人以上、従業者が常時勤務すること
(2)
拠点の設立等の計画確定前に東京都へ相談を実施していること
(3)
交付申請前に、ビジネスコンシェルジュ東京へ事業概要書（第１号様式）及びビジネス支援サー
ビス申込書を提出していること
(4)
交付申請前に法人格を有していること
(5)
法令等に違反する事実が無いこと
(6)
税金の滞納をしていないこと
(7)
公的機関等との契約における違反がないこと
(8)
公共の安全及び福祉を脅かすおそれのある法人でないこと
(9)
政治活動、宗教活動、選挙活動を事業目的とする法人でないこと
(10) 暴力団（東京都暴力団排除条例（平成 23 年東京都条例第 54 号。以下「暴排条例」という。
）第
２条第２号に規定する暴力団をいう。）に該当せず、法人その他の団体の代表者、役員又は使用人
その他の従業者若しくは構成員に暴力団員等（暴力団並びに暴排条例第２条第３号に規定する暴力
団員及び同条第４号に規定する暴力団関係者をいう。）に該当する者がないこと
(11) 主たる業務が、東京都が補助にふさわしくないと判断する業務に該当しないこと
（補助金額）
第４
１社当たりの補助金額は、補助対象経費の２分の１以内とし、5,000,000 円を上限とする。ただ
し、「在留資格取得経費」及び「拠点設立及び各種届出経費」については、次の金額を上限とする。
また、本件補助金の交付は東京都の予算の範囲内で行う。

算出された額に千円未満の端数が生じた場合には、これを切り捨てる。
（補助金の交付申請）
第５
補助金の交付を受けようとする事業者は、申請書（第２号様式）に誓約書（第３号様式）、次に
掲げる書類を添付して、東京都知事へ申請するものとする。
【共通】
(1)
申請者の法人格・代表者を確認できる資料（商業登記簿謄本等）
(2)
交付対象拠点の所在を確認できる資料（商業登記簿謄本等）
(3)
過去２年の事業実績を確認できる資料（決算関係資料等）
(4)
交付対象拠点における、交付日の属する年度及びその後２ヵ年度の各年度に関する事業計画を確
認できる資料
(5)
交付申請者が使用する印鑑が真正であることを確認できる資料（印鑑証明書等）
(6)
交付申請者の日本における納税状況を確認できる資料（納税証明書等）
(7)
従業者を規定数以上雇用していることを確認できる資料（雇用契約書等）
(8)
申請金額の根拠となる資料（領収書等）
(9)
その他東京都が必要と認めるもの
【人材採用経費】
当該経費に係る従業者を１年以上雇用することを確認できる資料（雇用契約書等）
（補助金の交付決定）
第６
第５の規定による交付申請が適切であり、補助金の交付が適当であると認められるときは、東京
都知事は交付の決定を行う。

前項の規定により交付決定を行った場合は、速やかに交付決定通知書（第４号様式）により、補助
金交付決定額その他必要な事項を交付申請者へ通知する。

交付決定に当たっては必要な条件を付する。

補助金の不交付を決定したときは、不交付決定通知書（第５号様式）により交付申請者へ通知する。
（事業の継続義務）
第７
交付を受けた者は、交付日から交付日の属する年度後２ヵ年度が終了するまでの間、交付対象拠
点で事業を継続しなければならない。ただし、特区内での移転及び東京都知事がやむを得ないと認め
る場合はこの限りではない。
（報告義務）
第８
交付を受けた者は、交付日の属する年度及びその後２ヵ年度の各年度に関する事業活動を、当該
各年度の末日から３ヵ月以内に、事業活動報告書（第６号様式）により東京都知事へ報告しなければ
ならない。
（変更の届出）
第９
交付を受けた者は、交付日から交付日の属する年度後２ヵ年度が終了するまでの間、次に掲げる
事項を変更するときは、変更後１ヶ月以内に、事項変更届出書（第７号様式）を東京都知事へ提出し
なければならない。

交付を受けた者及び当該交付対象拠点の名称の変更
(2)
交付を受けた者及び当該交付対象拠点の所在地の変更
(3)
交付を受けた者及び当該交付対象拠点の代表者の変更
（補助金交付決定の取消）
第 10
東京都知事は、交付を受けた者又は交付対象拠点が、交付日から交付日の属する年度後２ヵ年度
が終了するまでの間に、次に掲げる事項に該当した場合、交付を受けた者に対して補助金の交付決
定の全部又は一部を取り消すことができる。
(1)
偽りその他不正な手段により補助金の交付を受けたとき
(2)
補助金交付に当たり付した条件、その他法令に違反したとき
(3)
第３の規定にある要件を充足できなくなったとき
(4)
事業の継続が不可能となったとき
(5)
第８の規定にある報告を行わなかったとき
(6)
第９の規定にある届出を行わなかったとき

第１項の規定に基づき取消を決定した場合は、交付決定取消通知書（第８号様式）により交付を受
けた者へ通知する。
（補助金の返還）
第 11
交付を受けた者は、第 10 の規定により交付決定を取り消された場合、交付を受けた補助金を東
京都へ返還しなければならない。ただし、東京都知事がやむを得ないと認める場合はこの限りではな
い。

補助金の返還に係る事項は、東京都知事が返還請求書（第９号様式）により通知する。
（違約加算金及び延滞金）
第 12
東京都知事が、第 11 の規定により補助金の返還を命じたときは、交付を受けた者は、当該補助
金に加えて、当該命令に係る補助金の受領の日から納付の日までの日数に応じ、当該補助金の額（そ
の一部を納付した場合におけるその後の期間については、既納額を控除した額）に付き、年 10.95 パ
ーセントの割合（年当たりの割合は、閏年の日を含む期間についても、365 日当たりの割合とする。）
で計算した違約加算金（100 円未満の場合を除く。）を納付しなければならない。

第 11 の規定により補助金の返還を命じられた者がこれを納期日までに納付しなかったときは、納
期日の翌日から納付の日までの日数に応じ、その未納付額に付き年 10.95 パーセントの割合（年当た
りの割合は、閏年の日を含む期間についても、365 日当たりの割合とする。）で計算した延滞金（100
円未満の場合を除く。
）を納付しなければならない。
（延滞金の計算）
第 13
第 12 第２項の規定により東京都知事が延滞金の納付を命じた場合において、返還を命じられた
者が補助金の未納付額の一部を納付したときは、当該納付の日の翌日以後の期間に係る延滞金の計算
の基礎となるべき未納付額は、その納付金額を控除した額によるものとする。
（その他）
第 14
この要綱に定めるもののほか、補助金の交付に必要な事項については、東京都補助金等交付規則
（昭和 37 年東京都規則第 141 号）及び東京都補助金等交付規則の施行について（昭和 37 年 12 月 11
日付 37 財主調発第 20 号）の定めるところによる。
附則
この要綱は、平成 25 年４月１日から適用する。

アジアヘッドクォーター特区拠点設立補助金交付要綱第５の規定に基づく補助金等
の交付の申請を行うに当たり、当該申請により補助金等の交付を受けようとする者
（法人その他の団体にあっては、代表者、役員又は使用人その他の従業員若しくは
構成員を含む。）が東京都暴力団排除条例第２条第２号に規定する暴力団、同条第３号
に規定する暴力団員又は同条第４号に規定する暴力団関係者（以下「暴力団員等」
という。）に該当せず、かつ将来にわたっても該当しないことをここに誓約いたします。
また、この誓約に違反又は相違があり、同要綱第10の規定により補助金等の交付の
決定の取消しを受けた場合において、同要綱第11の規定に基づき返還を命じられたときは、

In the application for a subsidy as prescribed in section 5 of the Special Zone for Asian Headquarters Subsidy
Program Outline, it is hereby pledged that the Applicant (for corporations and other organizations, “Applicant”
includes the representative, executives, employees, and other members comprising the corporation or
organization) wishing to receive the subsidy through this application is not and will never be an organized crime
group as stipulated in the Tokyo Metropolitan Ordinance for Eliminating Organized Crime Groups Article 2,
item (ii), a member of an organized crime group as stipulated in item (iii) of said Article, or someone associated
with an organized crime group as stipulated in item (iv) of said Article (hereinafter referred to as “Organized
Crime Member, etc.”).
It is hereby pledged that if this decision to grant a subsidy is rescinded due to violation of or variance with this
pledge as prescribed in section 10 of the said Outline, and the return of the subsidy is ordered as prescribed in
section 11 of the said Outline, this order will be followed without any objection.
Consent is also given for inquiries to be made to the Metropolitan Police Department to confirm whether the
Applicant is or is not an Organized Crime Member, etc. when such confirmation is deemed necessary by the
Governor of Tokyo.

により報告して下さい。
