Remme Verkerk is gespecialiseerd op het insolventierecht en het burgerlijk procesrecht. Hij vertegenwoordigt cliënten zoals curatoren,
schuldeisers in faillissementen en financiële instellingen in (internationale) geschillen. Remme procedeert in feitelijke instanties en in
procedures bij de Hoge Raad. Remme publiceert regelmatig artikelen in nationale en internationale tijdschriften en schreef een
proefschrift getiteld "Fact-finding in Civil Litigation, A Comparative Perspective". Hij geeft geregeld lezingen op het terrein van het civiele
procesrecht en het insolventierecht.
Recente ervaring
Houthoff Buruma acted as trustees in bankruptcy of
KPNQwest N.V. in a law suit against Qwest, KPN and certain
directors of KPNQwest. The law suit was settled for EUR
260.000.000,- possibly the largest directors and officers
liability settlement on Dutch territory till today.
Houthoff Buruma is acting for the trustees in the bankruptcy of
KPNQwest in multibillion recourse proceedings against
shareholders, the former director and former supervisory
board members.
Houthoff Buruma is acting as trustee of the Touw Group. The
Touw Group was founded in 1908 and is renowned in the field
of damage-expertise in the marine and non-marine sector. Its
subsidiaries Binnendijk-Bree and Marinco Survey focus on
damage-expertise in the transport- and goods sector as well
as the on- and offshore industry. Tjarko Otten was appointed
trustee in bankruptcy.
Represented a bankruptcy trustee in a bankruptcy of an
individual who filed a claim against the trustee that had
liquidated parts of his estate at a low price. The Court of
Appeal ruled that the trustee was personally liable for
damages. The Supreme Court set aside the decision of the
Court of Appeal and ruled that a trustee, unless he is bound
by specific rules, has a large amount of discretion. The
trustee's conduct should be judged with reticence. The
Supreme Court ruled that it is a condition for personal liability
that the trustee realized or should have realized that his
