This seminar is chaired and moderated by Nigel Margetson of Margetson Van ‘t Zelfde & Co and consists of four workshops. In each workshop the speaker will discuss an important recent development that is of significant importance for parties that contract in the offshore energy industry. The seminar will be of interest to commercial managers, business developers, lawyers, risk and insurance managers and any others who are involved or interested inf contracts in the offshore energy industry. Lonneke Holierhoek will present a paper in which important aspects of international anti bribery laws are discussed whereby the main focus will be on the UK Bribery Act 2010. She will further discuss what contractors can do to ensure that the comply with the requirements of modern anti-bribery and corruption laws. The purpose of Lonneke’s presentation is to raise awareness amongst contractors about the ever increasing importance of anti-bribery laws and the real danger of criminal prosecution of contractors who fail to comply with legal requirements. 11.00 - 12.00 AM WORKSHOP: LIABILITIES, INDEMNITIES AND INSURANCE IN THE OFFSHORE INDUSTRY - A PERFECT FIT OR IS THERE ROOM FOR IMPROVEMENT? Nico de Wit, Intramar & Nigel Margetson, Margetson Van ‘t Zelfde & Co The usual system of contracting in the offshore industry is based on the knock for knock liability and indemnity system. This system is supported by a complex system of insurances such as H&M, P&I, property insurance, workmen compensation / employer’s liability, general liability and construction all risk insurances. The speaker will discuss the interrelationship between the various liabilities, indemnities and insurances, whereby the question will be raised if the existing insurance policies offer full cover or if some risks remain uninsured, regardless of an extensive insurance package. 12.00 - 13.00 PM WORKSHOP: BIMCO TIME CHARTER SUPPLYTIME 2005 TIPS AND TRICKS Tom Adams, Stephenson Harwood On 9 May 2014 Bimco reported that it has earmarked the SUPPLYTIME 2005 for revision by its Documentary Committee. We consider this a good opportunity to highlight some important aspects of the Supplytime 2005 from the Owners’ and the Charterers’ perspective, whereby we will also discuss various clauses which the BIMCO Documentary Committee may wish to give some attention. 13.00 - 14.00 PM WORKSHOP: DISPUTES IN THE OFFSHORE CONSTRUCTION INDUSTRY: A CASE STUDY Remko Luyten, Offshore Independents Claims and disputes in offshore construction projects are commonplace but often complex in nature. An independent professional can provide valuable early assistance to ensure adequate records are kept, notifications are sent, evidence (including witness statements) is collected and mitigating measures are taken. In a later stage of the dispute, an independent professional can provide the relevant technical review of the background of your dispute, provide high level technical comments and can prepare a formal expert report to support your cause. Remko Luyten is an experienced expert witness. In his workshop Remko will discuss a case that the Offshore Independents were involved in. The case study is intended to make the role of an expert witness in an offshore dispute clear.
