LIMITED TENDER NOTICE:
The Education Officer(District Panchayat), Dadra and Nagar Haveli, Silvassa on
behalf of the President of India hereby invites sealed Limited Tenders from the
Manufactures/Suppliers for supply of fresh Branded Cream Biscuits on occasion of 26th
January – Republic
Day-2015
so as to reach to the undersigned on or
before 13-01-2015 by RPAD or to be deposited in the tender box kept in the office of the
Primary Education Office (DP ), up to 15.00 hours along with samples. The tender will be
opened on the same day at 16.00 hours if possible.

Right to accept or reject any or all tenders in part or whole without assigning any
reason thereof is kept reserved with the tender inviting officer.

TERMS AND CONDITIONS FOR SUPPLY OF BISCUITS.
Tender Notice No.DP/EDN/STR/Sweets/2012/91
Dtd. 08/01/2014.
1. The rate (s) quoted shall imply free delivery of the materials at Central Primary
Schools, situated in entire Territory of Dadra and Nagar Haveli under the
Department of Primary Education including Transportation, loading/unloading
etc. The rate will be valid and operative for one year from the date of issue of supply
order.
2. Tender for supply of Biscuit is two bid system.(1) Technical bid and (2) Commercial
bid. All requisite document should put in Technical bid except price bid. Price bid should
put in Commercial bid. Two separate envelops for supply of Biscuits should put
together in one envelop super scribed the words. “ Tender for supply of Biscuits due on
13-01-2015.”
3. The Technical bids will be opened in presence of Tender Opening Committee and
tenderers or their authorized representative. The Commercial bid will be opened only if
the technical bid is successfully fulfilled in all respect and found eligible.
4. The Earnest Money Deposit for an amount of Rs.5,200/- (Rupees Five thousand two
hundred only) in form of Fixed Deposit Receipt from any Nationalized /Scheduled
Bank drawn in favour of “ Education Officer, District Panchayat, D. & N.H., Silvassa
“ should be enclosed with the tender. Tender without E.M.D. or E.M.D. in other form
will not accepted and summarily be rejected.
5. Sample of Biscuits are compulsory. Tender without sample of Biscuit as desired will
not be considered and summarily be rejected.
6. The rate should be quoted only for the items specified in the schedule of requirements.
7. The decision of the Tender Inviting Officer for acceptance / rejection of any articles
supplied including the decision for equivalent specifications, standard and quality etc. of
articles shall be final.
8. The successful bidder will have to pay Security Deposit of an amount equal to 10% of
the total value of the articles within ten days from the date of demand, failing which
order for supply will automatically be cancelled without any intimation.
9. The E.M.D. / S.D. paid will be refunded only on satisfactorily completion of the supplies
ordered for and on payment of bills of the supplies as to be admitted for payment.
10. No. Form ‘D’ will be issued.
11. No extra charges for packing , forwarding or insurance etc. will be paid on the rates
quoted.
12. In case of failure to supply the Biscuits, ordered for as per conditions and within
stipulated time, the same will be procured if required, from the bidder who offered next
lowest or from any other sources as may be decided by the Tender Inviting Officer and
the loss to Government on account of such purchase(s) shall be recovered from the
former supplier’s E.M.D. / S.D. or bills payable. The supplier shall have no right to
dispute with such procedure.
13. If at any time, after the order placed for supply of Biscuits, for any reason whatsoever
not require the whole or part of the quantity thereof as specified in the order, the Tender
Inviting Officer shall give notice in writing to the supplier. The supplier shall have no
any claim for compensation by reason of any alterations which shall involve any
curtailment or the supply originally contemplated.
14. The supply of inferior quality / standard or of different specifications other than that
ordered specified and or incomplete or broken articles will not be accepted. The supplier
will have to replace the same at his own cost and risk. Intimation of non acceptance of
any Biscuits materials and equipment etc. will be sent to supplier within 10 days from
the date or receipt of the materials and same will be returned to the supplier at his own
cost and risk if he so desires and intimates accordingly with 15 days from the date of
dispatch of intimation of the non-acceptance . However, if no communication is received
within 15 days from the date of communication the Tender Inviting Officer will not be
responsible for any damage , loss etc. of such rejected articles.
15. If any time, after the order placed for supply of Biscuits, for any reason whatsoever not
require the whole or pat of the quantity thereof as specified in the order, the Tender
inviting officer shall give notice in writing to the supplier. The supplier shall have no any
claim for compensation by reason of any alterations which shall involve any curtailment
or the supply originally contemplated.
16. The extension of time limit for supply of Biscuits can be granted upon circumstances for
maximum of 2 (two) days only. Beyond that request for extension can be considered up
to a maximum of 50% of the original stipulated time with levy of compensation for delay
in execution of supply order up to 5% of the cost of supplies, ordered for at the discretion
of the authority competent to grant extension upon the circumstances and such decision
in the matter will be final.
17. If the supplier whose tender is accepted, fails to execute the supply order within the
stipulated time, the EMD / SD of such tenderer will stand forfeited to the Government
and the contract for the supply shall stand terminated with no further liabilities on either
part to the contract.
18. Subject to Silvassa jurisdiction for any dispute.
19. Right to accept or reject without assigning any reason, any or all tenders in part or whole
is reserved with the Tender Inviting Officer and his decision(s) or all matters relating to
acceptance or rejection of the tenders as a whole or in art will be final and binding to all.
