Page 10 PBBA News To: Local Association Executive Officers From: Mary Castetter, Sr. V.P. of Administration CC: M. Scott Norman, Jr. Date: 12/3/2013 Re: 2014 Lobbying Tax Deduction (REVISED) In 1993, the U.S. Congress enacted the Omnibus Budget Reconciliation Act that contained provisions affecting trade associations. The Act provided that taxpayers will no longer be able to deduct from their federal income taxes any portion of the association dues attributable to that association’s “lobbying activities” as an ordinary and necessary cost of doing business. For 2014, NAHB estimates that the non-deductible portion of national dues - the portion that is applicable to lobbying is 12%. Thus, for a member who pays their NAHB dues of $166 in 2014, 12% or $19.92 will not be eligible for deduction as a business expense. Similarly, for an affiliate member who pays their NAHB dues of $5.00 in 2014, 12% or $0.60 will not be eligible for deduction as a business expense. For 2014, The Texas Association of Builders estimates that the non-deductible portion of state dues, which is applicable to lobbying, is 68%. With dues of $120, the amount not deductible as a business expense will be $81.60. For an affiliate member who pays their TAB dues of $27.00 in 2014, 68% or $18.36 of their dues is not deductible as a business expense. Therefore, the total amount of 2014 state and national dues for a member that is not deductible as a business expense is $101.52, and for an affiliate member the amount is $18.96. Associations must inform members of the portion of their membership dues that go for lobbying activities. Significant taxes or penalties may be assessed by the IRS against associations that do not comply with this regulation. NAHB and TAB recommend that all invoices of member dues contain adequate disclosure. The following is an example from NAHB of a statement that can be shown on the face of a dues billing invoice: “Dues payments to (association name) are not deductible as charitable contributions for federal income tax purposes. However, dues payments may be deductible as ordinary and necessary business expense, subject to exclusion for lobbying activity. Because a portion of your dues is used for lobbying by NAHB, TAB and (local association name), XX% of the total dues, or $XXX.XX is not deductible for income tax purposes.” If you have any questions about the TAB portion of this calculation, please feel free to call me. For additional information on the NAHB lobbying tax deductions, contact Tracy Spatz at 800-368-5242, ext. 8152.
