ADMISSION TO INVOLUNTARY TREATMENT By Medical Certification MCL 330.1423-1431 Application executed within 10 days of filing With physician’s or psychologists certificate (within 72 hours before certificate filed) nd 2 exam by psychiatrist within 24 hours of hospitalization MCL 330.1430 By Petition Filed with the Court MCL 330.1434 Without physician’s or psychologist’s certificate With physician’s or psychologist’s certificate (within 72 hours of filing petition) Without physician’s or psychologist’s certificate Court orders final exam within 24 hours of hospitalization MCL 330.1428 & .1429 Court orders 2nd exam by psychiatrist within 24 hours of filing petition MCL 330.1435(1) Court orders first exam by psychiatrist and either of physician or psychologist within 24 hours of filing petition MCL 330.1435 (2) Once client is admitted for involuntary treatment the following time constraints apply (client may be admitted by either method outlined above): Advice of Rights (Within 12 hours of hospitalization) MCL 330.1448 Right to Legal Counsel (Meeting within 72 hours after filing of petition if hospitalized, otherwise, no less than 24 hours before the time and date of hearing) MCL 330.1454 Court Hearings Hearing within 7 days (excluding Sundays and holidays), MCL 330.1452 after receipt of any on the following: Application for hospitalization MCL 330.1452(a) Filing of Petition MCL 330.1452(b-e) A demand for notification that a hearing was deferred be convened or there is objection to periodic review finding requiring continuing hospitalization MCL 330.1452(f) Hearing held in Abeyance (A court hearing required under MCL 330.1452 above may be deferred) (The hearing may be deferred up to 60 days if client is hospitalized or up to 90 days if client is under alternative treatment or a combination of both) MCL 330.1455(5) 1. 2. 3. Deferred Hearing Convened By client request MCL 330.1452(f); or By hospital director or community mental heath director within 1 to 2 weeks of expiration of the 60 to 90 day period MCL 330.1455 (9) &(10); or If Client rejects treatment and the rejection is reported to the Court.
