The Fish and Game Department is proposing to adopt Fis 1106.07 to govern the online
purchase and issuance of voluntary hike safe cards pursuant to RSA 206:26-bb, I, as amended
by Chapter 230:1 of the Laws of2014 (HB 256-FN), which becomes effective January 1, 2015.
A hike safe card is one of the documents whose possession exempts a person from liability to
the Department for the reasonable cost of a search and rescue response due to the person's
negligence.

This rule affects persons seeking to purchase voluntary hike safe cards.

6. (a) Summary of what the rule says and of any proposed amendment:
Env-Wq 1700 establishes surface water quality standards that apply to any discharge to New Hampshire waters and
that form the basis for National Pollutant Discharge Elimination System (NPDES) permits issued by EPA. NPDES
permits are required for all point source wastewater discharges such as from wastewater treatment plants, which
typically are owned by municipalities. EPA has asserted that it cannot incorporate compliance schedules into
NPDES permits it issues for discharges to New Hampshire waters unless New Hampshire's surface water quality
standards specifically authorize such compliance schedules. In the absence of this authority , EPA issues NPDES
permits that contain standards the permittees cannot meet and then enters into separate consent decrees with the
permittees to establish interim limits and compliance schedules.
The Department has statutory authority to include compliance schedules in state discharge permits under RSA
485-A: 13, I(a)*, and believes it is in the best interests of New Hampshire dischargers for EPA to have the same
authority for NPDES permits for discharges to New Hampshire surface waters. The Department thus is
proposing to adopt a rule that explicitly authorizes a compliance schedule to be included in any NPDES permit
issued or renewed for a discharge to New Hampshire surface waters.
* " ... Such permits may contain, in the case of sources not in compliance with such effluent limitations at
the time the permit is issued, compliance schedules, including interim requirements necessary or desirable
in order to fulfill the purposes or requirements of this chapter, and any such compliance schedules may be
imposed without regard to the time limits for abatement of pollution referred to in RSA 485-A: 12, II and
shall be consistent with the purposes and requirements of applicable federal law .... "

To the extent a political subdivision or independently owned business holds a federal National Pollutant
Discharge Elimination System (NPDES) permit, they may have a decrease in costs when the NPDES
permits are renewed as the U.S. Environmental Protection Agency will be able to include a compliance
schedule in the permit itself instead of in a separate consent agreement.

The proposed rule creates an option for EPA when issuing federal NPDES permits for discharges to state
surface waters, which is expected to reduce costs to political subdivisions that have or must obtain a federal
NPDES permit. The rules thus do not mandate or assign any new, expanded, or modified programs or
responsibilities to any political subdivision in such a way as to necessitate additional local expenditures by
the political subdivision, and so do not violate Part I, Article 2S-a.

Summary of what the rule says and of any proposed amendments:
This rule establishes procedures and criteria for permits for movement of non-divisible
vehicles, objects, or vehicles and loads having weight, width, height, or length greater than
allowed under RSA 266. The former rule expired in January, 2008 and is being adopted again
with amendments. The proposed rule differs from the expired rule as follows: the proposed
rule reflects the current practice for permit applications, the process utilized in reviewing and
issuing applications, and the requirements for moving the referenced loads; the rules were
changed for purposes of consistency and clarity, including the addition of a definition section,
so that these complex regulations are more readily understandable; the types of permits were
expanded; and the rules now reflect the electronic permitting system that was implemented by
the Department.

Any individual or business that wants to move a non-divisible vehicle, object or vehicle and
load on the state highway system in New Hampshire when the weight, width, height, or length
is greater than allowed under RSA 266.

6. (a) Summary of the subject matter, or summary of the rule if drafted, and the effect on those regulated:
The Site Evaluation Committee rules address the organizational structure and operation of the
Committee, practice and procedure before the Committee, and the process for applications to and
approval by the Committee of proposed energy facility projects. Legisla,tion enacted in 2014
included substantial changes to the composition, organization, administration and funding of the
Committee, and also requires the Committee to adopt specific rules regarding the siting of energy
facilities, including criteria particular to the siting of wind energy facilities. See Senate Bill 245
and House Bill 1602 of 2014; see also Senate Bill 99 of 2013.
The Committee seeks input in the form of proposed specific rules language from a diverse group of
stakeholders, including project developers, environmental advocates, regional organizations,
municipal governments, and citizens groups. This input is expected to be helpful to the Committee
in developing an initial proposal for readoption of its rules with the substantial amendments
required by the recent legislation. Submissions by electronic mail are strongly preferred.

The rules affect applicants for Committee approval of proposed energy facilities, including electric
generation facilities with a nominal capacity of 30 megawatts or more, natural gas pipelines, and
certain high voltage transmission lines. The rules also affect interveners and other public
participants in matters pending before the Committee, including host municipalities, abutting
landowners, and other local and regional stakeholders.
