TOWN OF DIX – REGULAR MEETING – JUNE 23, 2014 The Regular Meeting of the Town of Dix Board was held on Monday June 23, 2014. The Meeting was called to order by Supervisor Harold Russell at 7:00 PM. PRESENT: Supervisor Harold Russell Councilman Robert DeNardo Councilman Scott Yaw Councilman Frank Hammond Town Clerk James A. McMahon Bookkeeper to Supervisor Kristi Pierce Supt. of Highways Richard Richtmyer Code Officer Richard Husted Attorney David English Chairman Planning Board Mike Pierce ABSENT: Councilman Jeff Meehan Chairman Zoning Board of Appeals ALSO PRESENT: 2 Town of Dix Residents and Vicki Flynn the Dix Town Assessor. VISITORS: ADDITIONS TO AGENDA: Executive Session PUBLIC COMMENTS: James Switzer requested clarification of the Town’s expectations in reference to the maintenance of the Moreland and Townsend Cemeteries. He was told that mowing every other week would be OK and he could charge $300.00 per week. The Board also confirmed that the cemetery maintenance was going out for bid next year. Kristi Pierce getting quotes on removal of trees in Moreland Cemetery. Stan Fuller a used car dealer requested clarification of his Code Violation. The Code Enforcement Officer said he would contact Fuller and work out details of violations. Vicki Flynn was in attendance to give her Town Assessor’s quarterly report, and reported there were no complaints. REPORTS: Deputy Supervisor DeNardo reported that Pump Station was struck by lightning and getting an estimate on electrical repair. Bookkeeper to the Supervisor Kristi Pierce informed the Town Board that she set up financial binders for each Board member containing monthly reports of all funds, and monthly abstract and Supervisor’s report; also reported that the Trust and Agency Fund corrections were made as result of audit. The Highway Department reported that they had cleaned ditches on both sides of Pearl Street, hauled in ice control sand, graded and raked dirt roads, chip sealed 4 ½ miles of road, gravel on Templer and Wollet roads, 1 tractor mowing grass, spent 10 days working on storm damage with more to do, repair to loader and trucks, gravel on Pearl Street, paved 6 tenths of a mile on Beaver Dams Moreland Road, paved 4 ½ tenths of a mile on County Line Road and paved(cold mix) on Price Road. The Board discussed the need for stones stored at the Highway Barn. RESOLUTION # 75 SPEED LIMIT ON BENNETT ROAD On motion by Councilman Yaw, seconded by Councilman DeNardo, the following Resolution was APPROVED: AYES - 4 NAYES - 0 RESOLVED, that an application be made to Department of Transportation for establishing a speed limit on Bennett Road. Code Officer Husted reported that he had issued 5 Building Permits, 3 Notices of Violation were issued, 4 Construction inspections completed, 0 Demolition permit issued, 0 Stop Work Order issued, 0 Fire Prevention & Property maintenance inspections completed, 0 Violations corrected, 0 Court appearance tickets issued, 3 Projects completed and permits issued, 0 Certificates of Occupancy issued, 0 Certificate of Compliance issued, and 0 violation complaints are still not corrected, and 0 Building permits remain uncompleted, 0 tent installation inspections were completed, 0 cases are pending in Court, 0 Building permit for new manufactured home, 0 annual mobile home park operating permits issued, and 0 Water & Sewer connection completed. The Planning Board had no report but having a meeting in June. No report was received from the Zoning Board of Appeals. However, because of a resignation the Town Clerk is authorized to place an ad in the Review & Express for a new member. The Town of Dix Court had no report. The Landfill Commission had no report. RESOLUTION # 76 APPROVE MINUTES On motion by Councilman DeNardo, seconded by Councilman Yaw, the following Resolution was APPROVED: AYES - 4 NAYES – 0 RESOLVED, that the minutes of the Regular meeting on May 29, 2014 are hereby approved. RESOLUTION # 77 APPROVE TOWN CLERKS REPORT On motion by Councilman DeNardo, seconded by Councilman Yaw, the following Resolution was APPROVED: AYES - 4 NAYES - 0 RESOLVED, that the Town Clerk’s Report for the month of May 2014 is hereby approved. RESOLUTION # 78 APPROVE SUPERVISOR'S REPORT On motion by Councilman DeNardo, seconded by Councilman Yaw, the following Resolution was APPROVED: AYES - 4 NAYES - 0 RESOLVED, that the Supervisor's Report for May 2014 is hereby approved. RESOLUTION #79 APPROVE AUDIT On motion by Councilman DeNardo, seconded by Councilman Yaw, the following Resolution was APPROVED: AYES – 4 NAYS – 0 RESOLVED, that the Audit is approved as follows: General Fund-Townwide Claims A134 – A150 7,136.55 General Fund - Outside Village Claims B151 – B153 428.85 Highway Fund - Town wide Claims 68 -77 5,913.97 Highway Fund - Outside Village Claims 78-84 119,372.53 Trust & Agency Claims 13-14 9,418.21 Special Water Fund Claims SW26 5,552.05 Special Sewer Fund Claims SS25 7,133.61 Beaver Dams Fire Department Claim 154 910.87 Watkins Glen Fire Department Claim 156 982.78 Montour Falls Fire Department Claim 155 503.37 CORRESPONDENCE: Landfill Commission meeting minutes for May 7, 2014. First quarter 2014 Schuyler County Sales Tax distribution. OLD BUSINESS: The Board tabled discussion of the change to Zoning Law Wind Energy Facilities, Local Law for Junk Cars, Local Law NYS Fire Prevention and Building Code, new Town offices, Planning Board Member, Zoning Board of Appeals Member and Assessment Review Board Member. NEW BUSINESS: Attorney English provided the Board with revised Wind Energy Facilities Article to add to Zoning Law and said a SEQR was required. Board requested to review changes. The Town Clerk is authorized to run advertisements in Review & Express for members of Planning Board and Zoning Board of Appeals. RESOLUTION # 80 ADJOURN TO EXECUTIVE SESSION On motion by Councilman Hammond, seconded by Councilman Yaw, the following Resolution was APPROVED: AYES - 4 NAYES - 0 RESOLVED, that the Dix Town Board will go into Executive Session for litigation matters. RESOLUTION # 81 ADJOURN TO EXECUTIVE SESSION On motion by Councilman Hammond, seconded by Councilman Yaw, the following Resolution was APPROVED: AYES - 4 NAYES - 0 RESOLVED, that the Dix Town Board will return to regular meeting.
