Ample Guitar エンドユーザー使用許諾契約書
本ソフトウェア、または付属のファイル（以下、総称して「本ソフトウェア」と言います）をインストール、コピーまたは使用することによって、
お客様は本使用許諾契約書（以下、
「本契約」と言います）の諸条項に同意したものとみなされます。
「お客様」とは本ソフトウェアを正規
にご購入されたオリジナル・エンド・ユーザー、及び本ソフトウェアを使用する権利を許諾されたユーザーの事ことです。本契約の条項に
同意しない場合、または本ソフトウェアを直接購入されていない場合は、本ソフトウェアをダウンロード、インストールまたは使用するこ
とはできません。もしお客様が法的組織体に代わって本契約に同意する場合、本契約において
「お客様」は当該の法的組織体を意味します。
ライセンスの許諾
Beijing Boshengyinyuan Tehcnology Ltd（中国名「北京博声音元科技有限公司」商号「Beijing Ample Sound Technology
Ltd.」以下、総称して「Ample Sound」と言います）は、本契約の各条項に従って本ソフトウェアを個人的、非独占的かつ譲渡不可能
な権利をお客様に許諾します。お客様は 1) 個人
（１ユーザー）で、コンピュータがお客様の所有であり、尚且つお客様以外が本ソフトウェ
アを使用しないことを条件に、本ソフトウェアを二台のコンピュータにインストールして使用することができます 2) 追加ロイヤリティを
Ample Sound へ払う必要なく、本ソフトウェアを使用し、商用目的で音楽制作ができる権利が許諾されます。3) サンプルセットの権
利所有者の許諾なしで、商用サンプルセットを使用し抜き出すことは禁止されています。
本ソフトウェアのアップデート有無、または時期を決める権限は Ample Sound が留保しています。Ample Sound はお客様に対して
なんらかの改訂版を提供する義務は一切負いません。
オーソライゼーション・コード
オーソライゼーション・コードを取得されたお客様は、本契約の条項に従い、本ソフトウェアを使用する権利が許諾されます。オーソラ
イゼーション・コード取得の際、お客様は情報を正確に偽りなく入力する義務があります。もしお客様の入力した情報に誤りや偽り、お
よび入力不足があった場合、または Ample Sound が上記のような不正に気づいた場合、Ample Sound はお客様のライセンスを無効
にすることができます。
保障と免責
本ソフトウェア及び付属書類は現状有姿のまま提供されており、一切の保証はされておりません。Ample Sound は当社 Web サイトに
おいて信頼性のある情報を提供する努力をしますが、誤り、エラー、不足箇所がないこと、またはウィルス、ワーム、トロイの木馬に感
染しないという保障はいたしません。またコンテンツがお客様の使用目的にふさわしいものであるか、またはコンテンツが最新版であ
るのかの保障もいたしません。Ample Sound はお客様への通知なしでいつでも情報を変更する権利を留保しています。
本ソフトウェアの使用もしくは使用不能に起因する利益の損失や営業中断、データの損失、必然的・偶発的・間接的・特殊・懲罰的な損
害を限りとせず、たとえ Ample Sound がそのような損害の可能性を示唆されていたとしても、責任は一切負いません。また、お客様
もこれに同意するものとします。

全般
本契約は中華人民共和国の法律に準拠し、裁判所が本契約に関する争議に対して判決を下す独占的な裁判権を有しており、故にお客様
は中華人民共和国にある裁判所の判決に従うものとします。本契約書の一部条件が無効または強制不可能とされた場合、その条項は最
大限に施行され、それ以外の条項に関しては引き続き完全なる効力を持ちます。
教育目的用ライセンス
本ソフトウェアが教育目的用で購入された場合、お客様の本ソフトウェアの利用は教育目的用ライセンス条項が追加された本契約に準
拠します。本契約の条項と教育目的用ライセンスの条項の間で矛盾が発生した場合、教育目的用ライセンス条項に従うものとします。お
客様は教育目的用ライセンスエンドユーザーとして裁判所で認められていない限り、本ソフトウェアの使用は許諾されません。お客様に
教育目的用ライセンスが適用されているかどうか Ample Sound へ問い合わせてください。
本契約において以下の条項に矛盾する定めがあろうとも、お客様は本ソフトウェアをコピーや譲渡することは禁止されています。またラ
イセンスを第三者へ譲渡することはできません。いかなる場合においても本ソフトウェアを商用目的や営利事業で使用することを禁止し
ます。本ソフトウェアは非商用環境でお客様個人の目的の為だけに使用する権利が許諾されます。
クリプトン・フューチャー・メディア株式会社（以下「当社」）は、本製品の契約原文（以下「契約原文」
）を日本語に翻訳したものである本契約について、翻訳の
完全性を保証するものではありません。もし本契約と契約原文に相違があったときには、契約原文を優先するものとします。また、その様な相違によって損害
が生じたとしても、当社は保障いたしません。契約原文および本契約は、変更することがあります。その場合当社は、本契約の最新版を当社 WEB サイトにて
公表するものとします。本契約に関してご質問がある場合、当社 (Fax:011-222-0707 / Email: [email protected]) までお問い合わせください。

Ample Guitar End User General License Agreement
By installing, copying, or otherwise using this software or any files provided with it, you agree to be bound by all of
the terms and conditions of this license agreement. If you are not the original purchaser of the Software, or if you
do not agree with the License Agreement, you must promptly remove the software from your computer, and cease
any and all use of it.
If you are accepting the License Agreement on behalf of another legal entity, the use of the terms "you" and "your"
in the License Agreement shall refer to such entity.
GRANT OF LICENSE
Regarding the full (legally purchased and registered) version of Ample Guitar: in consideration of payment of
your license fee, Beijing Boshengyinyuan Tehcnology Ltd (Chinese legal name: 北京博声音元科技有限公司 ; fictitious
name/DBA: Beijing Ample Sound Technology Ltd.), grants to you, the Licensee, a personal, nonexclusive, nontransferrable license of Ample Guitar as described here. With the right to use this copy of the Software as a single
person who uses the Software personally on two computer or workstation.
Once licensed, you are granted access to the full features of the registered version, and you are also granted with
the rights to commercially sell the music generated by the full version of Ample Guitar, without the need of paying
monetary royalty to Ample Sound Company.
Under no circumstances you may extract or use any sample from the product's included sample sets for any
sample-based commercial sampling product without acquiring the consent from the right-holder of the sample sets.
Ample Sound Company retains the right to decide when and for which specific packages new versions are released.
In no way can Ample Sound Company be obliged to release new versions.
AUTHORIZATION CODE
You will receive an authorization code upon completing the authorization code request procedure. Once your
authorization code is activated, you may use the product with the full rights granted in the above section.
You agree to follow the authorization code request procedure and will provide true, accurate and complete
information about yourself. If you provide any information that is untrue, inaccurate, not correct or incomplete, or
Ample Sound Company has reasonable grounds to suspect that such information is untrue, inaccurate, not correct
or incomplete, Ample Sound Company has the right to suspend or to revoke the license.
The termination of the license shall be without prejudice to any rights, whatsoever, of Ample Sound Company.
Warranty and Liability
All materials, including downloadable software, contained in the Ample Sound Company's web site is provided as is
and without warranty of any kind to the extent allowed by the applicable law; While Ample Sound Company will use
reasonable efforts to provide reliable information through its web site, Ample Sound Company does not warrant
that this web site is free of inaccuracies, errors and/or omissions, viruses, worms, Trojan horses and the like, or
that its content is appropriate for your particular use or up to date, and Ample Sound Company reserves the right
to change the information at any time without notice. Ample Sound Company does not warrant any results derived
from the use of any software available on this site. You are solely responsible for any use of the materials contained
in this site.
Ample Sound Company will not be liable for any indirect, consequential or incidental damages, including but not
limited to lost profits or revenues, business interruption, loss of data arising out of or in connection with the use,
inability to use or reliance on any material contained in this site or any linked site.
Ample Sound Company will not be liable for any content being produced by using Ample Guitar. The Licensee
aknowledges and agrees to take the sole responsibilty for all subsequent legal and moral issues that may derive
from the use of Ample Guitar.

GOVERNING LAW AND SERVERABLILITY
This Agreement will be governed by the laws of People's Republic of China (PRC) and will be interpreted as if the
agreement were made between PRC residents and performed entirely within PRC. If for any reason a court finds
any provision of this License unenforceable, that provision will be enforced to the maximum extent possible, and
the remainder of the License shall continue in full force and effect.
ACADEMIC/EDUCATION LICENSE ADDENDUM TO THE GENERAL LICENSE AGREEMENT:
1 If this Product purchased as an Academic, Education, your Use of this Product is governed by the terms of
the General License Agreement as modified by the terms of this Academic/Education License Addendum to the
General License Agreement. In the event of any conflict between the terms of the General License Agreement
and this Academic/Education License Addendum, the terms of this Academic/Education License Addendum to
the General License Agreement shall govern. You are not entitled to Use the Product unless you qualify in your
jurisdiction as an Academic End User. Please contact Ample Sound to find out whether you qualify.
Notwithstanding anything to the contrary in the General License Agreement, you may not transfer or assign the
Product or any copy thereof, or your License to Use the Product to a third party, and you may not use the Product
in any way for any commercial purpose or in any commercial enterprise or business whatsoever. The Product may
only be Used for personal purposes in a non-commercial environment.
