U bent van harte welkom. Titel van het doctoraat: “Resolving Conflicts between Human Rights: A Legal Theoretical Analysis in the Context of the ECHR". De promotor van het proefschrift is prof. dr. Eva Brems. De heer Smet licht zijn doctoraat als volgt toe: “As a result of its expansive interpretation of the European Convention on Human Rights (ECHR), the European Court of Human Rights is increasingly confronted with cases that appear to entail a conflict between human rights, for instance between one person's freedom of expression and another's right to private life. My doctoral thesis aims to improve the Court's legal reasoning in such cases. To that end, I offer a comprehensive legal theoretical argument on conflicts between human rights in the ECHR context. I first argue in favour of a certain conception of the ECHR's rights, under which these rights are able and liable to conflict in specific cases. I then present a definition of genuine conflicts between Convention rights, as well as a double test to correctly identify them. I go on to detail an elaborate, yet workable framework for the judicial resolution of conflicts between human rights, which ‐ if applied ‐ would greatly enhance the Court's legal reasoning.” U verneemt meer op de openbare verdediging.
