algemene verkoopsvoorwaarden
1.
Wanneer een rechtspersoon of een al dan niet natuurlijk persoon een bestelling plaatst via brief, telefoon of fax, email, via deze
website of zelfs mondeling, dan aanvaardt hij of zij van rechtswege de volledige, onderhavige algemene verkoopsvoorwaarden.
Onderhavige verkoopsvoorwaarden zijn van toepassing op alle artikelen en elke aankoop die de koper plaatst. De koper
aanvaardt tevens dat onze verkoopsvoorwaarden als enige van toepassing zijn, met uitsluiting van zijn eigen
verkoopsvoorwaarden, zelfs indien deze zouden bedingen dat de verkoopsvoorwaarden van de koper als enige van toepassing
zijn. Er kan alleen schriftelijk van worden afgeweken.

Alle prijzen van de producten vermeld op de website en in deze folder zijn prijzen consument uitgedrukt in Euro, inclusief BTW.
en afgehaald in ons magazijn of winkel. Foto’s en informatie inzake de producten die wij aanbieden zijn louter informatief en
decoratief en kunnen afwijken.

De door de koper opgegeven informatie tijdens het plaatsen van een bestelling zijn voor hem bindend. In geval van fouten in de
adresgegevens van de bestemmeling, kan de verkoper niet aansprakelijk gesteld worden voor de onmogelijkheid om de bestelde
producten te leveren.
4.
De bestellingen worden pas definitief wanneer deze bevestigd zijn door de betaling van de verkoopprijs door de koper. Betaling
contant of via bankoverschrijving. Bankkosten voor overschrijving vallen altijd te laste van de koper. Al onze aanbiedingen
gelden zolang de voorraad strekt en kunnen geen aanleiding geven tot een verkoopverplichting. Met het oog op het zeldzame of
speculatieve karakter van bepaalde producten, kan er een hoeveelheidsbeperking toegepast worden.
5.
Alle producten die wij aanbieden zijn conform de Belgische wetgeving. Bestelling noch aankoop van alcoholische producten door
personen jonger dan 18 jaar, worden door ons niet aanvaard. Door het plaatsen van een bestelling bevestigd de koper
automatisch dat hij voldoet aan de wettelijke voorschriften inzake de aankoop en verbruik van alcoholische dranken.
6.
Levering van de wijnen, verpakt in houten kisten of kartonnen dozen van 6 of 12 flessen, kunnen wij leveren in België en Europa
mits het in rekening brengen van de transportkosten hieraan verbonden. De transportkosten zijn afhankelijk van het adres, het
aantal flessen en het aankoopbedrag. Gelieve ons te contacteren voor prijsopgave.De wijnen worden altijd geleverd aan de
ingang gelijkvloers.Wij verbinden ons ertoe om alles in het werk te stellen om de bestelling zo snel mogelijk te leveren binnen de
5 werkdagen. De levering wordt uitgevoerd binnen de voorziene termijn door de rechtstreekse overhandiging van het product
aan de opgegeven bestemmeling, of, ingeval van diens afwezigheid, door een bericht aan ons over te maken van
beschikbaarstelling. Eventuele vertraging in levering geeft de koper geen recht om zijn koop te annuleren, de goederen te
weigeren of schadevergoeding te eisen. Gevallen van overmacht waardoor de verkoper ontheven wordt van zijn
leveringsverplichting: oorlog, oproer, brand, staking, ongevallen en onmogelijkheid tot bevoorrading.
7.
De goederen reizen steeds op risico en verantwoording van de bestemmeling. Controleer altijd uw pakket bij aankomst. U
beschikt over een termijn van 24 uur om eventueel voorbehoud aan te tekenen in geval van ontbrekende goederen of
beschadigingen.
8.
Onze offertes worden steeds vrijblijvend aangeboden. Wij behouden ons het recht om onze verkoopprijzen te wijzigen bij een
nieuwe vintage, wijziging van de BTW tarieven, wisselkoerswijzigingen, accijnsrechten, wijziging van de prijzen opgelegd door de
overheid, door onze leveranciers ,gewijzigde kosten of andere parameters niet nader bepaald.
9.
Wij zijn niet aansprakelijk voor schade, in de ruimste zin, door het gebruik,misbruik of oneigenlijk gebruik van onze producten.
10.
De betaling van de producten geschiedt steeds netto en contant of via bankoverschrijving op voorhand tenzij schriftelijk anders
bepaald. Een korting voor contante betaling is in onze prijzen reeds verrekend. In geval van niet-betaling van een factuur wordt
vanaf de vervaldag van rechtswege en zonder ingebrekestelling een verwijlintrest toegepast van 1% per maand en hebben wij
het recht de verkoop ongedaan te verklaren en de geleverde goederen terug te nemen met de hieraan verbonden kosten te laste
van de in gebreke gestelde persoon.
Voorbehoud eigendomsrecht, wet van 12 mei 1980. Zolang de facturen niet in zijn geheel betaald zijn blijven zij eigendom van
maQUINZE. Het nog verschuldigde bedrag wordt verhoogd met een forfaitaire schadevergoeding van 10% met een minimum
van 50,00 euro onverminderd de gerechtskosten en de rente.
11.
Onze verkopen vallen onder het Belgische recht.Klachten of betwistingen worden altijd aandachtig onderzocht en dienen ons
binnen de 8 dagen gemeld te worden. In geval van geschillen, wordt de klant verzocht om zich bij voorkeur te wenden tot de
onderneming voor een minnelijke schikking. Zo niet is uitsluitend de rechtbank van onze vestigingszetel bevoegd, ongeacht de
plaats van levering en de betalingswijze.
