AGC CHAPTER LEADERS MEET IN WASHINGTON
AGC of America chapter leaders, including CAWV Senior Vice President Dan Cooperrider, WV
Paving, Inc., Dunbar, and CAWV Vice President C.R. Neighborgall, The Neighborgall
Construction Company, Huntington, joined chapter leaders in Washington, D.C. this week to
discuss best practices and to meet with Congress to address AGC’s top legislative issues. The
annual AGC National and Chapter Leadership Conference included speakers from Capitol Hill
and breakout sessions to discuss the industry’s most pressing issues, including federal
initiatives for infrastructure funding, multi-employer pension plan reform, environmental
regulatory issues and immigration reform.
Speakers included Charlie Cook, editor and publisher of The Cook Political Report, who
handicapped House and Senate races, Rep. Chris Gibson, R-NY, who spoke on a bi-partisan
bill to provide funding for infrastructure investment, and Dr. Edward Gordon, a noted author of
Future Jobs: Solving the Employment and Skills Crisis. The chapter leaders also reviewed best
practices for membership retention, state infrastructure initiatives, and BIM and LEAN
curriculum. Much time was spent on determining how to develop future construction workforces.
CAWV officers also attended a number of breakout sessions with their counterparts from other
states.
TANK REGISTRATION DEADLINE OCTOBER 1
Owners of above ground storage tanks continued to register with the state Department of
Environmental Protection in order to meet the October 1 deadline. DEP officials said there were
45,452 tanks registered. Another 1,174 were in the process of registering. A CAWV member
who has five tanks reported it took him one and a half hours to register one tank. Early in the
process it was anticipated as many as 70,000 to 80,000 tanks would need to be registered with
the state and originally all of them needed to be inspected by a certified professional. An
adjustment by the Tomblin administration eased the inspection requirement and divided the
tanks into three different categories depending on whether they were in a zone considered
critical and a potential threat to a drinking water source. The draft interpretive rule for SB 373 is
out for public comment through Oct. 9, the same day as a 6:30 p.m. public hearing is scheduled
at DEP headquarters in Kanawha City. Comments on both drafts can be emailed to

JASON PIZATELLA NAMED ACTING ADMINISTRATION SECRETARY
Gov. Earl Ray Tomblin announced Tuesday he’s appointed Fairmont native Jason Pizatella as
Acting Secretary of Administration. Pizatella has been Tomblin’s deputy chief of staff. “Jason
has been an integral part of my team and has earned the trust and respect of the Legislature
and leaders from across the state. I’m confident Jason will do well in this new position, and I
look forward to working with him in this new role,” Gov. Tomblin said in a news release. Former
acting secretary Ross Taylor is returning to his role as comptroller in the state Division of
Finance. Pizatella also served as chairman of the Governor’s Blue Ribbon Commission on
Highways and the WV Parkways Authority.
CAWV EDUCATION COMMITTEE MEETING TO MEET OCTOBER 8
CAWV Education Chairman Matthew Bourne, March-Westin Company, has scheduled a
meeting of the CAWV Education Committee for 3:00 p.m. on Wednesday, October 8, at the
CAWV headquarters. The committee will focus on developing future topics for the CAWV/
BrickStreet webinar series. Members will also discuss topics and speakers for seminars and

YOUNG CONTRACTORS COMMITTEE MEETING – OCTOBER 8
It’s time once again to get together for the Young Contractors’ Committee annual planning
session. Chairman Josh Booth will hold the event on Wednesday, October 8, from 5:30 to 7:00
p.m. at Buffalo Wild Wings located at 2501 Mountaineer Boulevard at the Southridge Shopping
Center in Charleston. The meeting will be held in the private room in the restaurant. “This is a
great time to bring new faces from your companies whom you see becoming more involved in
the CAWV and the industry,” said Chairman Booth. “YCC is a great networking and educational
opportunity for young men and women in the association.” Appetizers and drinks will be
provided in exchange for your good ideas for this year’s social events, education training, and

YCC TO HOST TOYS FOR TOTS GOLF SCRAMBLE - OCTOBER 31
The Young Contractors Committee will host the second annual Toys For Tots fall golf scramble
on Friday, October 31, at 10:00 a.m. at Berry Hills Country Club, Charleston. YCC Chairman
Josh Booth would like to invite all members to participate regardless of age (limit 72 total
golfers). In addition to the registration fee of $85, box lunch and beverages included, members
are asked to bring an unwrapped toy to benefit Toys For Tots. A registration form is attached

CARRICO APPOINTED STATE FIRE MARSHAL
The West Virginia Fire Commission named Anthony Carrico, 46, state fire marshal Monday. He
has been serving as acting state fire marshal since Sterling Lewis Jr. retired in April 2013. A
Scott High School graduate, Carrico attended West Virginia University and graduated in 1990
with a bachelor’s degree in political science and history. He was looking for a full-time job when
he saw a job posting for the State Fire Marshal’s Office. He started with the agency in July
1992. “It matched my credentials (and I) thought it would be interesting to see what it was all
about and I haven’t left,” Carrico said. He said working in the fire marshal’s office is different
than fire service as the marshal’s office focuses more on prevention through fire and building
codes and reviewing architectural plans and building inspections. In the fire service the goal is
suppression and education. “I realized very quickly that it was vitally important to the citizens of
this state that this function continues and is available,” he said of the fire marshal’s office.

Hearing Safety
Noise is unwanted sound. It can have different effects on you. Psychological effects mean that noise can
startle you, annoy you, and disrupt your concentration. Noise can interfere with your communications
when you are talking to someone. As a consequence, it interferes with your job performance and your
safety. Physiological effects mean that you can lose your hearing. Noise can cause pain and even
nausea when the exposure is severe. Ear protectors, in effect, reduce noise levels at the inner ear. Ear
protection is particularly important when noise exposures cannot be controlled adequately by
environmental changes. Ear protectors may be either ear plugs or ear muffs.
Many times workers resist wearing hearing protection more than any other type of personal
equipment. One of the most common reasons that they give is that they don't think they really need it.
But hearing loss is so gradual, even in intense exposures, that by the time you realize that you can't hear
as well as you used to, the damage has been done and can't be reversed. Another common reason
workers give for not wearing hearing protectors is that they are uncomfortable. Evidence of this attitude
can be found in such practices as springing muffs so they don't seal against the head, clipping off the
inner end of plugs and leaving only the outer end tab to fool the supervisor, and indifferent molding and
insertion of malleable-type plug materials. Good protection depends on a good seal between the surface
of the skin and the surface of the ear protector. A very small leak can destroy the effectiveness of the
protection. Protectors have a tendency to work loose as a result of talking, chewing, etc., and they must
be reseated from time to time during the workday. Some initial discomfort is sometimes experienced in
obtaining a good seal.
There will be no adverse reactions as a result of the use of ear protectors if they are kept reasonably
clean. Ear plugs should be made of soft material such as neoprene, as hard fixed material can injure the
canal. Skin irritations, injured ear drums, or other harmful reactions are exceedingly rare. A properly
designed, well-fitted and clear ear protector will cause no more difficulty than a pair of safety goggles.
The use of ear protection will not make it more difficult to understand speech or to hear warning signals
when worn in a noisy environment. Most of the available ear protectors, when correctly fitted, provide
about the same amount of protection. The best ear protector, therefore, is the one that you can wear
properly.
Three factors may be used to determine the level of noise:
1. If it is necessary for you to speak in a very loud noise or shout directly into the ear of a person in
order to be understood, it is likely that the exposure limit for noise is being exceeded.
2. If you have heard noises and ringing noises in your ears at the end of the work day, you are being
exposed to too much noise.
3. If speech or music sounds muffled to you after leaving work, but sounds fairly clear in the morning
when you return to work, there is no doubt about your being exposed to noise levels that can
eventually cause a partial loss of hearing that can be permanent.
If any of these conditions exist, a safety professional, using a sound level meter, should measure the
noise level at various work areas. They can then determine whether the exposure is great enough to
require personal protection.

FUNDING WOULD CONNECT 200 ALUM CREEK HOUSES TO WATER SYSTEM
About 200 households in Alum Creek in Kanawha County that now rely on well water or hauling
in water are one step closer to getting connected to West Virginia American Water Company’s
system after Rep. Shelley Moore Capito announced $225,000 in federal funding for the project
on Wednesday. The money will fund the project’s engineering design, which will take three to
five months, and will determine things like what size and kind of pipes will be used and how
many booster stations will be needed. After the design is done, it will take about $3.5 million
more to actually build and install the project, said Kent Carper, president of the Kanawha
County Commission. While the initial phase of the project uses federal dollars, latter stages will
likely be jointly funded by federal money and Kanawha County. The money comes from a
section of the federal Water Resources Development Act that allocates money for water and
sewer projects. “It is hard to believe that there are still areas of the country, and certainly, West
Virginia, where you don’t have access to clean drinking water,” Capito, R-W.Va., said.
The Army Corps of Engineers identified and approved the project as one worthy of funding, but
the engineering will be carried out by Kanawha County in conjunction with West Virginia
American. Carper said he expected that by the end of the year they would be announcing
funding to complete the project, but did not offer more specifics. County Commissioner Hoppy
Shores estimated that the entire project would be done in about a year. The project will bring
miles of pipe to Alum Creek and Olcott between Corridor G and Kanawha State Forest, primarily
along Brounland Road. Capito’s office estimated that 204 households would be newly linked to
the water system, while West Virginia American put the number at 186. Carper estimated that at
least 600 to 700 people live in those houses.
CONGRESS PASSES CONTINUING RESOLUTION FOR CLEAN WATER AND SAFE
DRINKING WATER SRFS
Both the U.S. House of Representatives and the U.S. Senate passed the “Continuing
Resolution of 2015” which authorizes appropriations for federal Fiscal Year 2015 through
December 11, 2014. The measure will provide funds for all federal programs at the federal FY
2014 levels. This is good news for the Clean Water and Drinking Water SRF construction
programs.
Leading up to Congressional action to pass the Continuing Resolution of 2015, the House
Appropriations Committee and the Obama Administration set 2015 federal funding levels for
Clean Water SRF at $1.018 billion and Safe Drinking Water SRF at $757 million. For federal FY
2014 Clean Water SRF was capitalized at $1.448 billion and the Safe Drinking Water SRF was
funded at $906 million. The House and the Obama Administration’s proposal will result in
funding cuts of $430 million (29.69%) to the Clean Water SRF and $150 million (16.55%) to the
Safe Drinking Water SRF.
Following the House Appropriations Committee’s actions, the Senate Appropriations Committee
released its federal FY 2015 Interior Appropriations bill. The Senate measure restores full
funding for the Clean Water SRF at $1.448 billion and Safe Drinking Water SRF at $906 million.
As in previous years, the Senate’s annual appropriations have prevailed.

AS NEW FEDERAL FISCAL YEAR BEGINS, THE CLOCK TICKS TOWARD ANOTHER
HIGHWAY TRUST FUND CRISIS
With October 1 marking the beginning of fiscal year 2015, the 31-member organization
Transportation Construction Coalition (TCC) urged Congress to find a way to pay for, and pass,
a new long-term surface transportation measure as soon as possible. They cautioned that
failure to act would lead to another self-imposed funding crisis that would undermine vital road,
highway and transit repairs. "We worked hard to build broad consensus within a deeply-divided
Congress for investing in the nation’s aging roads, bridges and transit systems," said Stephen
E. Sandherr, the chief executive officer of the Associated General Contractors of America and
the Coalition's co-chair. "Members of Congress can either take advantage of that momentum or
add transportation funding back to an already-long list of self-created crises threatening our
economic vitality."
Coalition officials noted that in July, despite overall partisan gridlock, Congress overwhelmingly
extended authorization for the surface transportation program and enacted a temporary funding
patch for the Highway Trust Fund (HTF). That patch ensures federal highway, bridge and transit
investments will continue through next May. However, it was the fifth time in the past seven
years Congress took that approach, requiring nearly $65 billion in supplemental funding to avoid
significant cuts to transportation investments. On average, the HTF provides 52 percent of the
funding for highway and bridge capital investments made by nation’s state transportation
departments each year, Coalition officials added.
"Congress needs to 'keep the horse before the cart' and address the trust fund's long-term
revenue problem as was done in the 1997 and 2004 tax bills. Then it can develop and properly
fund a six-year program bill early in 2015," TCC Co-chair Pete Ruane, president and CEO of the
American Road & Transportation Builders Association, says. "And 'status-quo' funding levels
would simply perpetuate worsening traffic congestion and the inadequate physical condition of
the nation’s highway and transit network." The latest Congressional Budget Office projections
indicate Congress will need to identify an additional $7 billion just to preserve highway and
transit funding for the last four months of fiscal year 2015. Federal data also show maintaining
current program funding beyond 2015 will require an average of $16 billion in additional
revenues each year. That, Coalition officials point out, is the revenue equivalent of a 10-cent
increase in the federal gas tax.
Despite widespread desire for a multi-year federal surface transportation program
reauthorization bill to boost economic competitiveness and job creation, such legislation cannot
move forward until a long-term transportation funding solution is in place. Coalition officials are
urging Congress to identify and pass a funding HTF revenue fix to ensure Americans and the
U.S. economy continue to benefit from a world class transportation network.
DOT RELEASES DBE RULE REVISIONS
US Department of Transportation (DOT) officially released a final rule that amended its
disadvantaged business enterprise utilization (DBE) rules. The new rules were first proposed in
September 2012 and, while considered by DOT to be “minor” adjustments, there are some
significant changes that will significantly impact the highway construction industry. Among the
changes originally proposed by DOT was a requirement that prime contractors on Federal-aid
highway contracts with DBE goals would have to submit with their bid a list of all DBE
subcontractors to be used on the project, including the scope of work to be performed, the value
of the subcontract and a letter from the DBE verifying these facts. In addition, if the prime
contractor did not meet the contract goal, information on all quotes from both DBE and non-DBE
subcontractors would have to be submitted with the bid to demonstrate “good faith efforts.” AGC
objected vocally to these proposed changes, submitted extensive written comments for the
record in 2012, provided additional comments in 2013, participated in a stakeholder listening
session and held several meetings with top DOT officials to explain the real world impact of
these changes if adopted. AGC and ARTBA members also responded and submitted over 100
letters on the proposal.
The final rule acquiesced to AGC’s and ARTBA’s opposition and amended the requirement to
submit DBE commitments with the bid and instead allows a 7 day window following bid opening
for the apparent low bidder to submit the list of proposed DBE subcontractors that will be used
on the project. This time limit will be reduced to 5 days in January 2017. There are numerous
changes in other sections of the DBE Utilizational rules. DOT has provided a summary of the
