PALOS VERDES PENINSULA UNIFIED SCHOOL DISTRICT MINUTES OF A SPECIAL MEETING OF THE BOARD OF EDUCATION May 5, 2014 The Board of Education of the Palos Verdes Peninsula Unified School District met OPEN in open session at the Malaga Cove Administration Center at 9:00 a.m. on SESSION Monday, May 5, 2014. The Special Session was held to discuss revisions to the PVPUSD Board of Education Board Policies and Administrative Regulations Manual. The president, Ms. LaMonte, called the meeting to order at 9:04 a.m. President LaMonte announced that the Board would recess to Closed Session to CLOSED SESSION discuss the following items: Conference with Legal Counsel - Anticipated Litigation Significant exposure to litigation pursuant to paragraphs (d)(2) and (e)(1) of Government Code Section 54956.9: 1 case The open session was reconvened at 9:55 a.m. RECONVENE ROLL CALL Members Present Erin G. It was moved by Dr. Collatos, and seconded by Ms. Lucky, that the agenda be approved, as presented. Ayes: Collatos, LaMonte, Lucky, Sharp; Absent: Vanden Bos. 1 MOTION AGENDA PVPUSD MINUTES OF A SPECIAL MEETING OF THE BOARD OF EDUCATION Monday, May 5, 2014 (A.R. H.1) The agenda report, PVPUSD Board Policies and Administrative Regulations Manual – BP/AR 6172.1, Concurrent Enrollment in College Classes – First Reading, was reviewed by the Board. Mitzi Cress (Palos Verdes Peninsula High, Principal) and Trista Ramirez (Palos Verdes High School, Assistant Principal) reviewed the proposed exhibit and answered questions from the Board. After discussion the following motion was made: It was moved by Dr. Collatos, and seconded by Ms. Lucky, that (1) staff revise BP/AR/E 6172.1, Concurrent Enrollment in College Classes, based on Board input; and (2) the proposed revisions be presented for Board review at the May 12, 2014 Special Meeting. Ayes: Collatos, LaMonte, Lucky, Sharp; Absent: Vanden Bos. MOTION BP/AR/E 6172.1, CONCURRENT ENROLLMENT IN COLLEGE CLASSES Departure of Board Member, Anthony Collatos, at 10:45 a.m. (A.R. H.4) The agenda report, PVPUSD Board Policies and Administrative Regulations Manual – CSBA Maintenance Update (December 2013, February 2014) – First Reading, was reviewed by the Board and the following motion was made: It was moved by Ms. Lucky, and seconded by Mr. Sharp, that the CSBA recommendation for Administrative Regulation 6159.4, Behavioral Interventions for Special Education Students, be presented for a second reading at a Regular Board meeting. Ayes: LaMonte, Lucky, Sharp; Absent: Collatos, Vanden Bos MOTION AR 6159.4, BEHAVIORAL INTERVENTIONS FOR SPECIAL EDUCATION STUDENTS (A.R. H.2) The agenda report, PVPUSD Board Policies and Administrative Regulations Manual - BP/AR/E 1330, Use of School Facilities – First Reading, was reviewed by the Board and the following motion was made: It was moved by Ms. Lucky, and seconded by Mr. Sharp, that (1) Exhibit(2) 1330, Use of School Facilities, be revised to add the Community Room at $15.00 per hour and a reference to the mandatory requirement to employ District personnel to operate certain specialized equipment, furniture or technology to the Schedule of Fees; and (2) the revised BP/AR/E 1330, Use of School Facilities, be presented for a second reading at a Regular Board meeting. Ayes: LaMonte, Lucky, Sharp; Absent: Collatos, Vanden Bos 2 MOTION BP/AR/E 1330, USE OF SCHOOL FACILITIES – SECOND READING PVPUSD MINUTES OF A SPECIAL MEETING OF THE BOARD OF EDUCATION Monday, May 5, 2014 (A.R. H.3) The agenda report, PVPUSD Board Policies and Administrative Regulations Manual – CSBA Maintenance Update (August 2013 and October 2013) – First Reading, was reviewed by the Board. (A.R. H.4) The agenda report, PVPUSD Board Policies and Administrative Regulations Manual – CSBA Maintenance Update (December 2013, February 2014) – First Reading, was reviewed by the Board. After discussion, the following motions were made: It was moved by Mr. Sharp, and seconded by Ms. Lucky, that AR 0420.4, Charter School Authorization, and BP/E 0420.41, Charter School Oversight, not be added to the PVPUSD Board Policies and Administrative Regulations Manual. Ayes: LaMonte, Lucky, Sharp; Absent: Collatos, Vanden Bos MOTION AR 0420.4 AND BP/E 0420.41, CHARTER SCHOOLS It was moved by Mr. Sharp, and seconded by Ms. Lucky that (1) the CSBA Recommendation for Board Bylaw 9010, Public Statements, be revised to add the following paragraphs as #2 and #3: MOTION BB 9010, PUBLIC STATEMENTS Before voting on any issue, all Board members shall be encouraged to present whatever evidence they may feel important to the matter at hand. The Board shall fully consider the implications and relevancy of all information so presented. All opinions, reactions, and positions shall be openly discussed, so that each member may understand all aspects of the issue before the Board makes its decision. Any Board member who may wish to criticize or oppose any specific Board actions should do so during the Board meeting. Once a Board decision has been reached, all Board members shall abide by that decision until it is amended or rescinded by subsequent Board action. When Board members express their opinions outside of the Board meeting, it is their responsibility to respect the democratic nature of Board decision-making and always identify personal viewpoints as such. 3 PVPUSD MINUTES OF A SPECIAL MEETING OF THE BOARD OF EDUCATION Monday, May 5, 2014 and (2) the revised CSBA Recommendation for Board Bylaw 9010, Public Statements, be presented for a second reading at a Regular Board meeting. Ayes: LaMonte, Lucky, Sharp; Absent: Collatos, Vanden Bos It was moved by Mr. Sharp, and seconded by Ms. Lucky, that (1) the CSBA recommendation for Board Bylaw 9250, Remuneration, Reimbursement, and Other Benefits, be amended to select Option #3 in the section titled Compensation, delete the paragraph related to District credit cards, select Option #1 in the section titled Health and Welfare Benefits for Current Board Members, and select Option #2 in the section titled Health and Welfare Benefits for Former Board Members; and (2) the revised CSBA Recommendation for Board Bylaw 9250, Remuneration, Reimbursement, and Other Benefits, be presented for a second reading at a Regular Board meeting. Ayes: LaMonte, Lucky, Sharp; Absent: Collatos, Vanden Bos MOTION BB 9250, REMUNERATION, REIMBURSEMENT, AND OTHER BENEFITS It was moved by Mr. Sharp, and seconded by Ms. Lucky, that Administrative Regulation 0420.43, Charter School Revocation, not be added to the PVPUSD Board Policies and Administrative Regulations Manual. Ayes: LaMonte, Lucky, Sharp; Absent: Collatos, Vanden Bos MOTION AR 0420.3, CHARTER SCHOOL REVOCATION It was moved by Mr. Sharp, and seconded by Ms. Lucky, that the CSBA recommendation for Board Policy 2210, Administrative Discretion Regarding Board Policy, be presented for a second reading at a Regular Board meeting.
