TERMS AND CONDITIONS – DBS TREASURES PRIVATE CLIENT FESTIVE MEMBER GETS MEMBER PROGRAMME 1. The DBS Treasures Private Client Festive Member Get Member Programme ("Programme") is conducted by DBS Bank Ltd ("DBS") and is open only to eligible, existing DBS Treasures Private Client customers (each, a "Referrer") as may be determined by DBS at its sole and absolute discretion. 2. This Programme is valid from 1 December 2014 to 28 February 2015, both dates inclusive ("Promotional Period"). Only referrals received by DBS during this Promotional Period will qualify for the Programme. 3. The following persons are not eligible to participate and will be disqualified from participating in the Programme: a) Employees of DBS and its affiliates and their immediate families, the advertising agencies engaged by DBS and its affiliates, and any other parties which are directly involved in organising, promoting and/or conducting the Programme as determined by DBS; b) Self referrals; and c) DBS Treasures Private Client customers that are non-individuals. 4. The Referrer will receive an appreciation reward ("Reward") if (a) he/she refers a prospective customer (each, a “Referred Person”), (b) the Referred Person establishes an account (the “First Account”) with DBS Treasures Private Client within 1 month from the date of referral, and (c) the assets deposited with and managed ( “AUM”) in the First Account comply with the minimum AUM required under DBS Treasures Private Client, at the end of the third month from the date on which the First Account is established. 5. To qualify for the additional rewards (“Additional Reward”) in the Programme, the referrer must make at least 3 successful referrals to DBS Treasures Private Client (i.e. referrals that meet the requirements set out in clause 4a and 4b herein); For example, if at least 3 of the First Accounts is referred before 28 February 2015 and established by 31 March 2015, the Referrer will qualify for the Additional Reward. This is applicable to all successful DBS Treasures Private Client referrals made by the referrer during the Promotion Period. 6. Referrals where the Referrer becomes a joint account holder will not be eligible for the Reward. 7. Minimum AUM for DBS Treasures Private Client - Not less than S$1,500,000 (or equivalent in foreign currency) in deposits and/or investments. (For example, if the First Account is established on 1 December 2014, the Referrer will qualify for the Reward if the AUM as at 28 February 2015 is not less than S$1,500,000.) 8. For every First Account established with DBS Treasures Private Client, the Referrer will receive the Reward, based on the amount of AUM in that First Account as at the end of the third month of that First Account being opened: i. A S$1,000 Singapore shopping voucher if the amount of AUM is between S$1,500,000 to S$3,000,000; or ii. A S$1,500 Singapore shopping voucher if the amount of AUM is above S$3,000,000. 9. For 3 or more successful referrals between the Promotion Period, the referrer will also receive an Additional Reward of S$1,000 Singapore shopping voucher, which may not be from the same merchant as the Reward. 10. The date of referral must not be later than the date of account opening. 11. Each Referrer: (a) confirms that the Referred Person has consented to a DBS representative contacting him/her for the purposes of the Programme and/or the opening of the First Account; (b) undertakes to comply with the provisions of the Personal Data Protection Act (Cap 26 of 2012) (“Act”); (c) warrants that he/she has obtained consent under the Act from the Referred Person to the collection, use and disclosure of the Referred Person’s personal data by/to DBS and such other third party for the purpose of the Programme and/or the opening of the First Account; (d) consents to DBS disclosing the Referrer’s name to the Referred Person for the purposes of the Programme and/or the opening of the First Account; and (e) confirms that he has read and agrees (and procures that the Referred Person has read and agrees) to be bound by the terms of the DBS Privacy Policy, a copy of which can be found on http://www.dbs.com/privacy. 12. Without prejudice to any other provisions herein, DBS reserves the right not to accord Reward(s)/ Additional Reward to the Referrer if (a) the assets deposited in the First Account are transferred from another DBS/POSB account (or from the liquidation of an investment held with DBS/POSB); (b) Referred Person is an existing DBS Treasures, Treasures Private Client or DBS Private Bank customer (collectively a “DBS Wealth Management Customer”) or was a DBS Wealth Management Customer in the last six months from the date of the referral; or (c) the Referred Person is the spouse of the Referrer or an employee of DBS. 13. If more than one Referrer successfully refers the same Referred Person to DBS within the Promotional Period, the Reward/Additional Reward will be given to the first Referrer who submits the referral form to DBS via mail, fax or email with the name of the Referred Person and such form is received by DBS. 14. There is no limit to the number of referrals that can be made by the Referrer. 15. The use and redemption of all Reward(s)/Additional Reward are subject to such terms and conditions which DBS or the merchant may impose from time to time. The Reward(s)/Additional Reward is not transferable and not exchangeable for cash, credit or any other item in part or in whole. 16. DBS may at any time and without prior notice substitute or replace the Reward(s)/Additional Reward with any other reward of equal or higher value, such value to be determined by DBS at its sole discretion. DBS makes no representation or warranty whatsoever as to the quality or fitness for purpose or any other implied terms or conditions with respect to the Reward(s)/Additional Reward. Any dispute about the same must be resolved directly with the merchant. DBS is not liable for any injury, loss or damage whatsoever, whether direct or indirect, arising from or in connection with the Reward(s)/Additional Reward. 17. Referrer agrees to hold DBS and its directors, officers and employees (each an “Indemnified Party”) harmless and keep each Indemnified Party fully and effectively indemnified from and against any losses, costs, claims, damage and expenses whatsoever which any of them may incur (directly or indirectly) as a result of any breach by the Referrer of any of its representations, warranties, undertakings or obligations hereunder. 18. DBS' decisions on all matters relating to the Programme, including without limitation, on whether or not to establish an account in the name of the Referred Person, the determination of the AUM and whether or not an Referrer is eligible to receive the Reward(s)/Additional Reward, will be final and binding on all participants. DBS may discontinue the Programme or vary these terms and conditions, without prior notice or liability to any party. In the event of any inconsistency between these terms and conditions and any brochures, marketing or promotional materials relating to the Programme, these terms and conditions shall prevail. 19. These terms and conditions are governed by Singapore law and parties submit to the exclusive jurisdiction of the Singapore courts. Updated Nov 2014
