State Board of Certified Real Estate Appraisers

Present at the regular meeting of the Board were: Chairman Tom Smith, Secretary Eric Lehmayer
and members Joseph Pasquarella, Jeffrey Walters, Martha Brown (Secretary of the Commonwealth
Designee), John Abel (Office of Attorney General), and Paul Wentzel (Secretary of Banking
Designee). Also present were Board Counsel Christopher McNally and Board Administrator Heidy
Weirich.
The following key discussions/actions were taken:
1. The Board approved minutes from the September 2014 meeting.
2. Report of Prosecutorial Division:
· File 13-70-07032 (Shawn Sullivan) The respondent is an appraiser trainee who signed
the name of a deceased supervisor on an appraisal report. Terms of the Agreement:
permanent voluntary surrender. Board approved.
3. The Board approved the application of Guideline Real Estate Services LLC as an Appraisal
Management Company.
4. The Board provisionally denied the application of Manuel Joseph as a Certified Professional
Evaluator.
5. Counsel provided that the AQB has rescinded a requirement that fingerprint-based
background checks be included in state licensing laws. The Board discussed the provision
and determined that they will request the DOS to reintroduce the legislative initiative
regarding background checks, continuing education for appraiser trainees and reciprocity.
6. The Board heard a presentation from Gary Heiland and Michael Mignogna from the MidAtlantic Valuation Group, as well as Michelle Bradley from the Coalition of Real Estate
Appraisers.
Discussion centered on three general topics:

Requiring individuals to identify a supervisor when applying for a Licensed
Appraisal Trainee (LAT) certificate. Concerns were voiced that this limits the
ability of offices to hire and train individuals new to the profession. The presenters
indicated that the policy should be for individuals to identify a supervisor after
getting their LAT but before they start accumulating experience. After discussion in
executive session, the Board directed staff to revise the application process so
individuals can apply for an LAT before designating a supervisor.

Provision that supervisors can have up to three trainees but trainees are
limited to one supervisor. The Board clarified that the regulations permit trainees
to have one supervisor per assignment, and that this does not limit trainees to one
supervisor in total. After discussion in executive session, the Board determined that
no further clarification is necessary.

Concerns over the 5-year waiting period after licensure to become a
supervisor. The presenters noted that AQB requires a 3-year waiting period plus a
4-hour class before becoming a supervisor, and asked the Board to consider a similar
requirement for PA. After discussion in executive session, the Board determined that
they would maintain the 5-year requirement.
7. Regulatory Report
· Regulation 16A-7016 (Schedule of Civil Penalties) – The proposed rulemaking will
codify and amend the Board’s current schedule of civil penalties statement of policy.
Status: The Board did not discuss the proposal.

Regulation 16A-7018 (Assessment Record Keeping and Reporting) – The proposed
rulemaking would revise requirements for the use of certificate number and title for
Certified Pennsylvania Evaluators to make the regulation consistent with standards
of USPAP, the International Association of Assessment Officers and existing
practices in county assessment offices.
Status: The Board did not discuss the proposal.

Regulation 16A-7020 (Renewal Fee for Appraiser Trainees) – The proposed
rulemaking would adopt a biennial renewal fee for licensed appraiser trainees.
Status: The Board did not discuss the proposal.

Regulation 16A-7021 (Appraisal Management Companies) – The proposed
rulemaking defines the scope of the Board’s jurisdiction over Appraisal Management
Companies.
Status: The Board did not discuss the proposal.
8. Next Meeting – December 11, 2014.
