a Submitter to or acknowledge the addenda and return the revised Bid Sheets shall be cause for
rejection of the bid.

The Bid Opening Date remains as January 29, 2014 at 2:00 p.m.

The Bid Sheet has been revised and is now an Electronic Bid Pricing Sheet, refer to instructions
included in this addendum. This bid sheet “MUST” be completed and returned with your Bid submittal.
3.
An additional attachment titled “Section 01270, Unit Prices” is included in this addendum.
All other terms, conditions and specifications remain unchanged for this bid.

In accordance with the General Conditions, Special Instructions to Bidders, Technical Specifications and
Requirements, the undersigned bidder offers pricing and services as per the Electronic Bid Pricing Sheet:
Instructions for completing the Electronic Bid Pricing Sheet:
1. Download the Electronic Bid Pricing Sheet, in Microsoft Excel format, from the Purchasing Division
website at http://www.broward.org/Purchasing/Pages/CurrentSolicitationList.aspx. Respond to this bid
by inputting the company’s information and unit pricing into the formatted Excel spreadsheet. Only the
highlighted cells will be available for entering information.
2. Once the Electronic Bid Pricing Sheet is completed, bidder should save the Excel file to a CD or DVD in
a read-only format. Do not password protect the file and do not save it as a PDF. Label the front of
the disk with the bidder’s name and bid number.
3. Print the completed Electronic Bid Pricing Sheet; sign and date where indicated.
4. Bidder must submit, in one envelope, the printed, signed Electronic Bid Pricing Sheet with the bidder’s
complete, original bid submission as per the General Conditions and Special Instructions to Bidders
and should include the CD/DVD (with the saved Excel file).
5. If bidder is unable to electronically fill out and submit Electronic Bid Pricing Sheet with its bid submittal,
bidder must submit a hardcopy of the Electronic Bid Pricing Sheet(s) with handwritten unit prices and
extensions.
6. If the hardcopy of the Electronic Bid Pricing Sheet does not match the Electronic Bid Pricing Sheet(s)
submitted on the CD/DVD, the hardcopy prices shall prevail for any discrepancies in pricing. If handwritten bid Sheet(s) and electronic bid Sheet(s) are submitted, handwritten unit prices will prevail for
any discrepancies in pricing.
7. It is the Bidder’s responsibility to monitor the Purchasing Division’s website for any issued addenda.
Addenda may include revised Electronic Bid Pricing Sheet that will need to be downloaded, properly
filled out, and submitted by the Bidder.
8. The CD/DVD submitted with the bid will become County property; as such, it is submitted at no cost to
the County.
9. If the Bidder believes there is an error in the Electronic Bid Pricing Sheet, Bidder must immediately
notify the Purchasing Agent prior to the bid opening date.

SECTION 01270
UNIT PRICES
PART 1
1.01
GENERAL
SECTION INCLUDES
A. Measurement and payment criteria applicable to portions of the Work performed under a unit price
payment method.

1.02 AUTHORITY
A. Measurement methods delineated in the individual specification sections complement the criteria of this
section. In the event of conflict, the requirements of the individual specification section govern.

1.03 UNIT QUANTITIES SPECIFIED
A. Contractor shall provide The Project Consultant and Owner with quantities indicated on Document
01250c – Proposal Worksheet detail, Document 01250d – Proposal Worksheet Summary and
Schedule of Unit Prices by individual specification sections. All materials and labor to be used in the
project shall be accounted for and submitted before the start of construction. These Unit Quantities are
for bidding and contract purposes only. Quantities and measurements supplied or placed in the Work
and verified by the Project Consultant and Owner determine payment.
B. If the actual Work requires more or fewer quantities than those quantities indicated, provide the
required quantities at the unit sum/prices contracted.
1.04
MEASUREMENT OF QUANTITIES
A. Measurement Devices:
1. Weigh Scales: Inspected, tested and certified by the applicable Florida or The Broward County
Board of County Commissioners within the past year.
2. Platform Scales: Of sufficient size and capacity to accommodate the conveying vehicle.
3. Metering Devices: Inspected, tested and certified by the applicable Florida department within the
past year.
B. Measurement by Weight: Concrete reinforcing steel, rolled or formed steel or other metal shapes will
be measured by handbook weights. Welded assemblies will be measured by handbook or scale
weight.

UNIT PRICE FOR PRODUCTS
A. The amount of each Unit Price is to be based on the actual quantity of existing material removed and/or
replaced and shall include the following:

Delivery to the Site.
All equipment and labor required.
Applicable taxes and necessary bonds.
Handling at the Site including unloading, uncrating and storage.
Protection from the elements and from damage.
Labor for installation and finishing and other expenses required to complete the installation.
Contractor’s and subcontractor’s overhead and profit.
Excess material used due to waste, overlap of materials, purchase quantity limitations and
similar factors.
PAYMENT
A. Payment Includes: Full compensation for all required labor, products, tools, equipment, plant,
transportation, services and incidentals; erection, application or installation of an item of the Work;
overhead and profit.
B. Final payment for Work governed by unit prices will be made on the basis of the actual measurements
and quantities accepted by the Project Consultant and Owner multiplied by the unit sum/price for Work
which is incorporated in or made necessary by the Work.
1.07
DEFECT ASSESSMENT
A. Replace the Work, or portions of the Work, not conforming to specified requirements.
B. If, in the opinion of the Project Consultant and Owner, it is not practical to remove and replace the
Work, the Project Consultant will direct one of the following remedies:
1. The defective Work may remain, but the unit sum/price will be adjusted to a new sum/price at the
discretion of the Owner.
2. The defective Work will be partially repaired to the instructions of the Project Consultant, and the
unit sum/price will be adjusted to a new sum/price at the discretion of the Owner.

C. The individual specification sections may modify these options or may identify a specific formula or
percentage sum/price reduction.
D. The authority of the Project Consultant and Owner to assess the defect and identify payment
adjustment is final.

NON-PAYMENT FOR REJECTED PRODUCTS
A. Payment will not be made for any of the following:

Products wasted or disposed of in a manner that is not acceptable.
2.
Products determined as unacceptable before or after placement.
3.
Products not completely unloaded from the transporting vehicle.
4.
Products placed beyond the lines and levels of the required Work.
5.
Products remaining on hand after completion of the Work.
6.
Loading, hauling and disposing of rejected Products.
ADJUSTMENTS FOR COSTS
A. Should the quantities be more or less than the specified quantity submitted with base bid, the
Contract Sum will be adjusted accordingly by Change Order.
B. The Unit Price shall apply to the quantities actually used as determined by the Project Consultant
and the Owner.
C. Unit Price material and the quantities used shall be recorded on a daily basis within the Contractor’s
Daily Log, and be accompanied by photographs of the conditions prior to removal of the old
material and conditions after installation of the new replacement material.
D. The Unit Price quantity records are to be reviewed with Project Consultant and Owner at each
Progress Meeting. Acceptances of quantities used to date are to be documented in the Meeting
Minutes.
E. If these documentation and approval procedures are not followed by the contractor, a later request
for aware of Unit Price Costs may be denied by the Project Consultant and Owner.

SCHEDULE OF UNIT PRICES
A.
Line Items 5 – 19 of Form 004113-2, Schedule of Prices Bid: Bid Price shall include unit costs
to replace or install the following items described in Bid Sheet: 1) any existing deteriorated item
OR 2) new item not included in Base Bid as submitted by contractor under Line Item 4 of Form

PART 2
INSTRUCTIONS TO BIDDERS
The following instructions are given for the purpose of guiding Bidders in properly preparing their bids. Such
instructions have equal force and weight with other portions of the Contract Documents and strict compliance
is required with all the provisions contained in the instructions.
A.
Examination of Contract Documents and Site: It is the responsibility of each Bidder before
submitting a Bid, to:
1. Examine the Contract Documents thoroughly;
2. Visit the site or structure to become familiar with conditions that may affect costs, progress,
performance or furnishing of the Work;
3. Take into account federal, state and local laws, regulations, ordinances, and the Broward
County Procurement Code that may affect costs, progress, performance, furnishing of the
Work or award;
4. Study and carefully correlate Bidder’s observations with the Contract Documents; and
5. Carefully review the Contract Documents and notify the COUNTY of all conflicts, errors or
discrepancies in the Contract Documents of which Bidder knows or reasonably should have
known.
The submission of a Bid shall constitute an incontrovertible representation by Bidder that Bidder has complied
with the above requirements and that without exception, the Bid is premised upon performing and furnishing
the Work required by the Contract Documents and that the Contract Documents are sufficient in scope and
detail to indicate and convey understanding of all terms and conditions for performance and furnishing of the
Work.

and wage rates that have been found to be prevailing for the
cited type(s) of construction in the area covered by the wage
determination. The classifications are listed in alphabetical
order of "identifiers" that indicate whether the particular
rate is union or non-union.
Union Identifiers
An identifier enclosed in dotted lines beginning with
characters other than "SU" denotes that the union
classification and rate have found to be prevailing for that
classification. Example: PLUM0198-005 07/01/2011. The first
four letters , PLUM, indicate the international union and the
four-digit number, 0198, that follows indicates the local union
number or district council number where applicable , i.e.,
Plumbers Local 0198. The next number, 005 in the example, is
an internal number used in processing the wage determination.

changes in the collective bargaining agreements governing the

Classifications listed under an "SU" identifier were derived
from survey data by computing average rates and are not union
rates; however, the data used in computing these rates may
include both union and non-union data. Example: SULA2004-007

LA indicates the State of Louisiana; 2004 is the year of the

wage determination. A 1993 or later date, 5/13/2010, indicates
the classifications and rates under that identifier were issued
as a General Wage Determination on that date.
Survey wage rates will remain in effect and will not change

1.) Has there been an initial decision in the matter? This can

On survey related matters, initial contact, including requests
for summaries of surveys, should be with the Wage and Hour

Cone of Silence: The Cone of Silence is in effect for this project. In accordance with Section 1-266 of the
Broward County Code of Ordinance, as amended, provides that after the advertisement of the bid solicitation,
potential vendors and their representatives are substantially restricted from communicating regarding the Bid
with the County Administrator, Deputy County Administrator, Assistant County Administrator, Assistants to the
County Administrator, their respective support staff, or any or any staff person that is to evaluate or
recommend selection in this bid process. The Cone of Silence Ordinance further provides that after the bid
opening for this solicitation, potential vendors and their representatives are substantially restricted from
communicating regarding this Bid with the County Commissioners and their staff.
The Cone of Silence shall be in effect for staff involved in the award decision process at the time of the
solicitation advertisement. The Cone of Silence shall be in effect for the Board of County Commissioners upon
bid opening for the solicitation.
The Cone of Silence terminates when the County Commission or other awarding authority takes action which
ends the solicitation.
Any violations of this ordinance by any member(s) of the responding firm or joint venture may be reported to
the County’s Office of Professional Standards. If there is a determination of violation, a fine shall be imposed
against the vendor as provided in the County Code of Ordinances. Additionally, a determination of violation
shall render any award to a vendor who is found to have violated the Ordinance voidable, at the sole discretion
of the Board of County Commissioners.
