1913-2013 Newsletter Issue 116 Local Medical Committee Limited LMC Ltd DERBY AND DERBYSHIRE “Putting the needs of GPs first” July 2014 http://www.derbyshirelmc.org.uk/ EMAS - Working together with GPs We have recently received a communication from Dr Trevor Mills, interim Medical Director at EMAS, regarding working together between EMAS and General Practice. You can read the letter here titled ‘East Midlands Ambulance Service’. The letter mentions that EMAS is now recruiting to a pool of experienced GPs to work with their Clinical Assessment Team at weekends and bank holiday. You can see the advertisement here. _________________________________ Interest on late payments The GPC has sought legal advice on whether practices can charge interest on late payment from the Area Team and sue through the small claims court (assuming it has not elected to become an NHS body) for cases of non-payment. The advice confirmed that this course of action is open to practices and 'The Late Payment of Commercial Debts (Interest) Act 1998' should apply too (as the GMS Contract does not appear to have contracted out of this). This allows for interest at the rate of 8% above base rate, plus a fixed sum and reasonable costs of recovering the debt. _______________________________ General Practice and Workforce Developmental Needs Click here for the Position Statement from Derby and Derbyshire LMC to Health Education East Midlands (HEEM) Derbyshire, regarding training and education in General Practice. ______________________________ BMA Committee Visitors Scheme The BMA Committee Visitors Scheme is a new initiative that allows BMA members who have not previously been involved in core BMA work to participate and voice their say in how the profession is run. GMS and PMS contracts require that practices should give patients choice about where they have their prescriptions dispensed. As always, choice implies informed choice. This means that if a practice gives a patient information about a particular pharmacy without giving the patient the opportunity to acquire information about other pharmacies the practice could be said to be directing the patient towards the particular pharmacy. Pharmacies, including online pharmacies, advertise their services in different ways. Many are now doing this by offering specific linkages to individual practices. In order to avoid allegations of prescription direction and investigation by NHS England of any contractual issues we strongly advise practices to be completely even-handed in their dealings with pharmacies. If one pharmacy offers, say, a prescription collection service or buys advertising space in the practice waiting room then the practice should offer the same facilities to other pharmacies that wish to do the same and that might, in the practice's opinion reasonably be used by its patients. The position is complex when pharmacies offer medicines management type services to practices that are over and above the services offered under the NHS pharmacy contract but, again, we advise that practices should take steps to be able to show that other pharmacies have been offered the opportunity to provide similar services to the practice's patients and that any decisions made by the practice have been taken solely in the best interests of its patients _______________________________ Unplanned Admissions Enhanced Service A revised version of the joint guidance on the unplanned admissions enhanced service has now been published here along with NHS England's service specification, click here. From September this year, the number of doses of HPV vaccine that girls aged 12 to 13 years should receive, is being reduced from three to two. The two doses should be given at least six and not more than 24 months apart, but, for planning purposes, Public Health England is recommending an interval of twelve months between doses. Local needs, however, should be taken into consideration when planning the programme, so that any girls who may have missed out on their vaccinations can be accommodated. Also girls who have received two HPV vaccine doses under the 2013/14 programme should still receive their third dose, to complete their course. For full details of the change to the programme, see the letter from Public Health England, the Department of Health and NHS England here.
