 DURCATS RUSSIAN BLUE CATS http://durcatsrussianblue.com Contract for Sale of a Cat or Kitten THIS AGREEMENT IS MADE ON 15th November 2014 BETWEEN The Seller: Mary Durkacz, ­ ‘Mary’ AND The Buyers: ‘The Buyers’ CONCERNING ‘The Kitten’, a Russian Blue cat, born on ********** IT IS HEREBY AGREED AS FOLLOWS: 1. The Sale and Contract Price 1.1. The Kitten belongs to Mary and Mary agrees to sell The Kitten to The Buyers 1.2. The Buyers agree to pay a total of £625 for The Kitten (‘the Purchase Price’). 2. Delivery of The Kitten 2.1. The Kitten shall be collected by The Buyers by prior arrangement by telephone, text or email. 3. Details of The Kitten 3.1. The Kitten has been microchipped, number **************** . 3.2. The Kitten does not as yet have a pet passport. 3.3. The Kitten and his pedigree are registered with the GCCF on its Non­Active Register which stipulates that he shall not be used for breeding purposes and therefore must be neutered. 3.4. The Kitten has been given the following vaccinations: Nobivac Triple Trio, inoculating against feline calicivirus (FCV), feline herpes virus type 1 (FHV) and feline panleucopenia virus (FPLV), and Nobivac FelV inoculating against the Feline Leucaemia Virus (FelV) ­ these should be repeated annually starting in ******************. 3.5 The Kitten has been wormed and protected against flea infestation. This should be repeated monthly from around ****************** or according to the vet’s advice. 4. Neutering The Kitten (appended from GCCF guidelines) 4.1. The Buyers undertake to keep The Kitten as a household pet only. 1/3 4.2. The Buyers will not under any circumstances whatsoever use The Kitten for breeding or allow The Kitten to breed with any other cat of the same or a different species, neither will The Buyers allow any such use to be made of The Kitten by any other party. 4.3. If for any reason it becomes necessary for The Buyers to transfer, give or sell The Kitten to a third party The Buyers undertake to obtain from the third party a covenant in similar terms to those contained herein ­ see also 8.4. 4.4. The Buyers will ensure that The Kitten will be neutered by a Veterinary Surgeon/Practitioner, before attaining the age of twelve months. They will copy or send to Mary a Certificate from the Veterinary Surgeon/Practitioner stating that this has been carried out. 4.5. In the event of these covenants being breached Mary shall have the right to repossess legally The Kitten and to be reimbursed by The Buyers the reasonable cost of such repossession and the keeping of such Cat for a period of up to two months after repossession. 5. Property Rights and Assumption of Risk 5.1. Any property rights, title or ownership in The Kitten shall remain with Mary until The Buyers have paid the Purchase Price in full in accordance with the terms of this contract, whereupon title shall pass to The Buyers. 5.2. Risk in and responsibility for The Kitten shall pass from Mary to The Buyers upon payment of the Purchase Price. 6. The Condition of The Kitten and Warranties 6.1. The Buyers hereby warrant that they have had the opportunity to inspect The Kitten and to assess his condition and state of health, and that they have availed himself of this opportunity. 6.2. Mary expressly excludes any and all warranties or guarantees as to the condition or state of health of The Kitten whether implied at common law or by statute or by business practice. 7. Whole Agreement, Governing Law, Severability and Miscellaneous Provisions 7.1. This document constitutes the entirety of the agreement between the parties. It supersedes any prior representations which may have been made, whether orally or in writing. Any modification to this agreement must be made in writing and signed by both Parties. 7.2. All clauses, sub clauses and parts thereof shall be severable and shall be read and construed independently. Should any part of this Agreement be found invalid this will not affect the validity or enforceability of any other provision or of this agreement as a whole. 8. Care and Welfare of The Kitten 8.1 The Buyers shall ensure excellent care of The Kitten, giving the shelter, nourishment, grooming, stimulation and love which will allow him to continue to become a loving, well­balanced pet. 2/3 8.2 The Buyers, whilst away from home or on holiday, shall ensure the highest quality of care for The Kitten. 8.3 The Buyers shall provide immediate, high quality care for The Kitten should he become ill or injured. 8.4 Should The Buyers wish to give away or sell The Kitten due to a change in circumstances or for any other reason, Mary would very much appreciate being given the opportunity to buy, take or rehome The Kitten.
