NEW SUPREME COURT PRACTICE DIRECTION – SUPERVISED CASE
LIST FOR CASES INVOLVING SELF-REPRESENTED PARTIES
Supreme Court Practice Direction No 10 of 2014
The Chief Justice has issued a further important practice direction which establishes a
supervised case list (the SRL Supervised Case List) for cases involving self-represented
litigants. The practice direction provides for the transfer of all matters pending in the Brisbane
Registry of the Supreme Court in which a party is self-represented to the SRL Supervised Case
List and identifies what occurs when the matter is placed on the list. Practitioners should be
aware that the practice direction places an obligation on a practitioner who is aware that one of
the parties to the action is self-represented and that the matter is not listed on the SRL
Supervised Case List to notify the List Manager of that fact. The practice direction also requires
the parties to give appropriate consideration to the early reference of the matter to the ADR
Registrar.

NEW PLANNING AND ENVIRONMENT COURT PRACTICE DIRECTION –
CASE MANAGEMENT IN THE P & E COURT
Planning and Environment Court Practice Direction No 2 of 2014
The Chief Judge of the District Court has recently issued this important practice direction
relating to the conduct of proceedings in the Planning and Environment Court. The practice
direction requires that the party who has the onus of proof in the action must bring an
application for orders or directions about the management of the case within six weeks of the
action being commenced. It also requires that the parties provide each other with drafts of the
orders and directions they seek before the hearing of the application for directions. Importantly
the parties are to prepare a dispute resolution plan which sets out methods for narrowing the
issues in dispute or for resolving the whole of the action. This is reinforced by the requirement of
all parties to give consideration to alternative dispute resolution as soon as is practicable.

OF THE FEDERAL COURT OF AUSTRALIA – CIVILITY IN PUBLIC
DISCOURSE
Civility, reason, fairness and justice, and the law: The Hon James Allsop, Chief
Justice of the Federal Court of Australia
As part of the opening of the new law term service at the Great Synagogue in Sydney, Chief
Justice Allsop, of the Federal Court of Australia, spoke about the “place of the law and of
judges in our society” and the importance of “civility, reason, fairness and justice”. In this
speech, his Honour focused on the importance of civility in public life, focusing principally upon
Queensland Law Reporter – 28 February 2014 – [2014] 07 QLR

the need for civility in public discourse to ensure adequate and reasoned discussions and
decisions. It is undoubted that his Honour’s observations have been influenced by recent
events in New South Wales relating to the “one punch laws” and some unwarranted criticism of
the State Courts in relation to the sentencing of offenders.
The Chief Justice’s comments express concern about present day threats to the Rule of Law; a
concern which has been echoed throughout many judicial speeches of the present day. His
Honour’s particular focus was that the Rule of Law required civility, reason, fairness and justice.
He observed that civility was essential for human expression and social intercourse which are
necessary in a civilized society.
His Honour observed that the recent personal attacks upon members of the judiciary following
their decision to impose prison sentences that were deemed too “light” by members of the press
is a potent example of the loss of civility in social discourse and the consequences this may
have. This lack of civility, his Honour argues, played a significant role in the government’s
reactionary, and unreasoned, introduction of mandatory sentences for “one-punch” killings. The
Chief Justice contends that this form of uncivil discourse creates an environment in which the
reasoned discussion and debate of ideas is grossly stymied and, as a consequence,
discussions about ideas and values that the nation ought to pursue are lost to a whirl of insults
and invective. Yet, despite the negative consequences, incivility is, somewhat protected in
Australia, where it is often perceived as embedded within the concept of “political freedom”.
The Chief Justice, however questions the rationale behind this “freedom” and suggests that a
civil, democratic society is neither advanced nor fostered by the “expression of insulting
calumny or personal invective; and instead that the civil discourse is necessary for the
development of a just, democratic society”.

More Weird Cases 2011 is the second in a series with Weird Cases having been
published in 2010. Gary Slapper has delivered a punchy array of legal anecdotes that
are interesting and, in places, laugh out loud funny. Whilst the cases from which the
material is drawn are not cited, the book is a bountiful resource for any speech writer.

The Rt Hon Sir Robert Megarry A New Miscellany at Law 2005 (Hart Publishing)
This is the third Miscellany at Law provided by Sir Robert Megarry not long before his
death in 2006. Beautifully written, the book is testament to Sir Robert Megarry’s love of
legal minutia. The book is primarily a collection of some of the wise and witty sayings
that have fallen from judges since court proceedings commenced being recorded.

Philip Ayres Owen Dixon 2003 (Melbourne University Press)
This biography is an opportunity to better understand a man who has left an indelible
mark on Australian law. It is not a deep legal analysis, but it is an intimate biography
written with the benefit of Ayres gaining access to Dixon’s private papers. Depending on
one’s point of view, the narrative does slow during the discussion of Dixon’s time as
Minister to the United States during the course of WW II. That said, the work contains
Queensland Law Reporter – 28 February 2014 – [2014] 07 QLR

many revealing insights into the workings of the High Court during the time Dixon was a
member of that Bench. It is worth reading if only for that aspect. Few may know that
whilst Dixon was one of our pre-eminent jurists, his academic career at university was
average. Philip Ayres gives an impressive account of Dixon’s life and the book is an
accessible read.

David Marr Barwick 1980 (George Allen & Unwin Australia Pty Ltd)
Sir Garfield Barwick is one of a select few of High Court judges who had served in
Federal Parliament before being appointed to the Court. Barwick is controversially
remembered for his role in advising Governor-General Sir John Kerr during the 1974
Constitutional Crisis. Indeed, Marr’s biography of Barwick is criticised for being an
ideologically motivated attack on the character and work of Barwick because of his role in
the dismissal. Marr is certainly unsympathetic, but conscious of Marr’s partisan, it is a
worthy read.

Federation Press has given notice of the forthcoming publication of a collection of the 14
lectures of the W A Lee Equity Lectures hosted by the Queensland University of Technology
from 2000 to 2013. The lectures in this series are some of the most important legal lectures
given each year in Queensland. Over the years the lectures have been of an extremely high
standard and have been delivered by some of Australia’s leading Equity lawyers including
Justice Gummow, Justice Handley, Professor Lee, Professor Cope and Hubert Picarda QC.
The lectures have covered a wide range of topics including estoppel, charitable trusts, the
conscience of Equity and equitable liens. Federation Press have indicated that the work will be
published in late March 2014 and can be purchased on line from the Federation Press website
at a cost of $150.00.

LIMITATION OF ACTIONS – WHEN A CAUSE OF ACTION ARISES – LOST
OPPORTUNITIES AND CONTINGENCIES
JNJ Resources Pty Ltd v Crouch & Lyndon [2014] QSC 13; Jackson J; (19 February
2014)
This important decision by Jackson J concerns the difficult question of identifying when a cause
of action arises where rights are immediately affected but the sustaining of actual damage is
possibly contingent on other matters. The facts of this matter are complex but nevertheless
should be fully stated. The plaintiff in the matter, which was owned and directed by a husband
and wife, carried on business as a stock feed supplier. It did so from a parcel of land referred to
in the case as Lot 53. The land was owned by the directors and there was no agreement in
place for the company’s occupation of the land. The directors merely permitted it to use the
land for its business. No fees or rent was paid for the occupation. The directors wished to sell
a major portion of the land to a third party but wished to retain that part from which the company
carried on its business. It is claimed that instructions were given to the defendant solicitors that
the sale of the land was to be subject to a simultaneous purchase of a sub-divided part of the
land being that part on which the business was conducted. The sale went ahead with the
directors entering into a simultaneous contract to acquire the relevant portion of Lot 53. That
contract, however, was subject to the obtaining of sub-division approval in respect of that
relevant portion. As a result of an alteration to the town planning laws the sale could not
proceed and the new purchaser of Lot 53 terminated the contract. That said, a five year lease
had been granted by the new owner to the directors and, in 2011 that lease was extended for a
further five years. The plaintiff company alleged that the solicitors were negligent because the
contract for the sale of Lot 53 was not made conditional upon the “completion” of the sale of the
sub-divided portion or that the solicitor should have advised the directors that the possibility
existed that the sub-division may not occur. The company alleged that had that the directors
been given appropriate advice they would not have sold the land.
The plaintiff company claimed in negligence and alleged that it had suffered damage arising
from the giving of negligent advice to the directors in their personal capacity in that it would not
be able to sell the stockpile of material stored on the land resulting in a loss of profits and further
that the material would degrade with the result that substantial sums will have to be expended in
disposing of it. It also aserted that it will suffer loss and damage on the basis that it would not
be able to continue to undertake business on the land and that its security of tenure was
weakened.
The defendant sought to strike out the action on the basis that the contract for the sale of Lot 53
settled more than six years before the action was commenced.
In relation to the argument that the cause of action arose when the sale was completed,
Jackson J identified the importance of carefully analyzing the rights of the party whose is said to
have suffered loss and the manner in which those rights were affected by the transaction. In
doing so, his Honour noted that, given the loose arrangement between the plaintiff company
and the directors as to the company’s occupation of the land (which involved no legal right of
occupation) the sale of Lot 53 had no impact on the company’s rights. The company had no
right which was made less valuable by reason of the transaction regardless of whether or not
the directors suffered any loss. Whilst his Honour noted that the parties did not seek to agitate
that the loss of the expectation by the company that it would be granted occupancy rights in the
future was a loss which was compensable in an action for negligence, he did consider that the
closest analogue to the case before him was that line of cases of which Hill v Van Erp is the
highest authority. However, it was observed that in Hill v Van Erp the expectation of the
beneficiaries was, at the relevant time, backed by a concrete proposal which was not so in the
matter before the Court.
Nevertheless, his Honour did consider what the position would be if the loss of the opportunity
of future occupation was a valuable right which was lost to the plaintiff. In this respect it was
noted that, from the company’s point of view, the risk was that the conditional contract for the

sale of the subdivided portion would not complete. In these situations it is necessary to keep in
mind the distinction identified in Wardley between circumstances of actual loss on the one hand
and circumstances where the risk or fact of loss is contingent on the other. His Honour
considered a number of authorities concerning this issue and identified that risk of loss
becomes actual loss when the circumstances are such that actual loss will occur with some
certainty. It was not possible to determine that point in an interlocutory application before the
Court.
CRIMINAL LAW – SENTENCING – WHETHER PAROLE
AUTOMATICALLY CANCELLED BY PERIOD OF IMPRISONMENT
ORDER
R v Smith [2013] QCA 397; Court of Appeal (Muir and Morrison JJA and Daubney J)
20 December 2013
In this application for leave to appeal against sentence the Court of Appeal was required to
consider the proper application of s 160B(2) of the Penalties and Sentences Act 1992,
specifically whether the sentencing judge ought to have fixed a date that the Applicant be
released on parole, rather than a date that the Applicant was eligible for parole. On the facts
before the Court the Applicant had committed a series of offences whilst she was on parole;
however she was not sentenced until after the original end-date of her period of imprisonment –
the question was whether her parole order had been cancelled during her period of
imprisonment. After undertaking a careful analysis of the relevant sections of both the Penalties
and Sentences Act 1992 and the Corrective Services Act 2006 (“CSA”), in particular s 209 of
the CSA, their Honours unanimously concluded that a parole order is cancelled automatically
upon the commission of an offence, and it is irrelevant (to this analysis) whether or not the
sentencing for that offence occurs after the period of parole has expired. Consequently, in this
appeal, the Court affirmed the sentencing judge’s decision to fix the date that the Applicant was
eligible for parole.

Coeur de Lion Investments Pty Ltd v Kelly [2013] QCA 160
The appellant made an application in the Supreme Court, pursuant to s 237(1) of the
Corporations Act 2001 (Cth) (“the Act”), for leave to bring a proceeding in the name of the fourth
respondent, The President’s Club Ltd (“the Club”), against the first, second and third
respondents, who were three of the four directors of the Club. The primary judge dismissed the
application on the basis that, first, the appellant had not explained its own failure to take steps to
prevent the impugned conduct of its directors; and, second, the appellant had made no attempt
to show that the likely recoverable amount from the proposed proceeding made it in the best
interests of the Club to bring the action. On those bases, the primary judge concluded that the
appellant had not satisfied the Court that it was acting “in good faith”, or that it was in the best
interests of the Club that the appellant be granted the leave sought, respectively. The appellant
appealed from that decision.
Held, per Muir JA (Fraser JA and Jackson J agreeing), dismissing the appeal:

That an applicant for leave under s 237 of the Act, acting in good faith, would turn its
mind to the question whether the amount likely to be recovered in the litigation merited
the expenditure of time, resources and money which litigation would necessitate, such
that absent such consideration, the Court will not be satisfied as to this requirement. [57].

GENERAL INFORMATION
ICLRQ
The Incorporated Council of Law Reporting for the State of Queensland (ICLRQ) is a charitable
institution which was founded in 1907. Under its constitution, the principal object of the ICLRQ is
“the preparation and publication in a convenient form, at a moderate price, and under gratuitous
professional superintendence and control, of Reports of Judicial Decisions of the Supreme
Court in the State of Queensland.”
In pursuit of this object, the ICLRQ publishes a set of authorised reports of the key decisions of
the Supreme Court of Queensland (Queensland Reports) and a weekly supplement to these
reports (Queensland Law Reporter). Under the constitution of the ICLRQ, all surplus funds from
its operations are used to benefit the Supreme Court of Queensland Library.
The members of the Council serve on a voluntary basis. The Council is constituted by three
practising barristers and three practising solicitors (who are appointed annually by the Judges of
the Supreme Court) and three ex officio members (the Attorney-General of Queensland, the
Solicitor-General of Queensland and the Registrar of the Supreme Court). The Editors, SubEditors and Reporters are all practising members of the Queensland Bar who serve on a largely
voluntary basis. The offices of the Council are located in the Queen Elizabeth II Courts of Law
and are managed by the Secretary of the ICLRQ.

Supreme Court of Queensland since Federation. These decisions have been selected for
inclusion in the Queensland Reports by the editors, reviewed by reporters for their textual
accuracy, summarised in concise headnotes, and authorised for publication (with corrections
where necessary) by the deciding judges.

The Queensland Law Reporter has been published since 1908 as a weekly supplement to the
Queensland Reports. It is published, both in print and electronic format, every Friday save for a
period during the court vacation (from late December to early January).
A free subscription to the electronic version of the QLR can be requested at

The QLR includes a summary by the editors of this week’s most significant developments in
Queensland law, including brief summaries of recent cases which have been identified as
potentially suitable for reporting in the Queensland Reports and information about the progress
of appeals in reportable cases. Extracts from the headnotes of all new cases appearing in the
Queensland Reports are also included.
The Queensland Law Reporter is a publication which has been approved by Practice Direction
of the Supreme Court for the publication of various public notices. It is approved under r 599(4)
of the Uniform Civil Procedure Rules 1999 (Qld) for the purposes of giving notice of intention to
apply for a grant of probate or letters of administration under Chapter 15 Part 2 of the UCPR. It
is also approved under r.12(3)(b) of the Supreme Court (Legal Practitioner Admission) Rules
2004 (Qld), for the purposes of giving notice of intention to apply for admission as a legal
practitioner.
PUBLIC NOTICES
To arrange for public notices to be published in the QLR, please arrange for ICLRQ to receive
the following (by post or delivery) before the relevant publication deadline:

payment of $161.70 (incl GST); and
written instructions concerning the date of the QLR in which publication of the notice is
requested and an email address at which you may be contacted.
The publication deadline is 3pm on the Monday immediately prior to the date upon which the
relevant QLR is scheduled for publication. In 2013, QLRs are scheduled for publication every
Friday from 11 January 2013 to 13 December 2013.
Acceptance of public notices for publication occurs by email notification to the address provided.
The ICLRQ regrets that it cannot advise or assist in the drafting of public notices. The ICLRQ
also regrets that, after the relevant publication deadline has passed, notices can only be withdrawn or corrected with the permission of the Secretary of the ICLRQ.
