SABA Juvenile Law
Seminar, Oct. 17
The San Antonio Bar Association is pleased
to announce its third annual Juvenile Law CLE,
scheduled for October 17, 2014. The seminar,
chaired by 386th District Court Judge Parker,
will take place in the Central Jury Room of the
Cadena-Reeves Justice Center (300 Dolorosa).
Registration begins at 8:30 a.m. and the seminar
will get started at 9 a.m.
The course will cover topics spanning a
wide range of practice skills, including: Juvenile
Law Basics and Ethical Considerations for the
New or Infrequent Juvenile Practitioner, Police
Interactions with Juveniles, Adjudication Hearings, School Law-Ethical Considerations, Immigration Law and Ethical Considerations when
Representing Non-Citizen Minors, Sealing of
Records-Ethical Duty to Clients, Preparing
Your Case-Meeting and Dealing with Probation, Disposition Hearings and TJJD Programs.

Thank you. Thank you.
Thank you to those who came out last
month on Saturday, September 20 to attend
the SABA Installation Gala, which supports
our nationally and statewide recognized
Community Justice Program. The CJP
provides legal services to the poor here in San
Antonio. Together, with 500 in attendance at
the Grand Hyatt, we raised over $25,000 for
the CJP access to justice program.
Fall is in the air, and that means,
among other things, that the World Series
is just around the corner. My Uncle Jim
introduced me to baseball nearly 60 years
ago, and I’ve been playing ever since. It
would be difficult to select a highlight
from this year’s Installation Gala, but the
tribute to my old lawyer softball team, the
San Antonio Blue, ranks high on the list.

Carol King’s “Now and Forever.” The song
is special for me because it references a line
“we had a moment,” which relates back
to when that team won nine consecutive
state championships in the 70s and 80s.
San Antonio Bar Association Executive
Director Jimmy Allison was our first
coach. The team passed the hat around
this summer, and during the Gala, we
were thrilled to be able to present Jimmy
and his wife with a $2,500 check for a trip
to Cooperstown and the National Baseball
Hall of Fame. Baseball provided me with
a scholarship to college and a chance to
play professionally, but more importantly,
it provided me with hard core life lessons,
including sportsmanship, competition,
teamplay and a sense of belonging and
self-worth that can test one’s resolve to
survive just as the game of life itself.

Law and the Law Alumni Association have named attorney Clarence
“Clem” Lyons (J.D. ’62) and Hidalgo
County 430th District Court Judge Israel Ramon, Jr. (J.D. ’77) the 2014 St.
Mary’s Distinguished Law Graduates. In addition, the Distinguished
Young Alumnus award will be presented to Tiffanie S. Clausewitz
(J.D. ’08) of the Rosenblatt Law Firm.
The annual award is given
to individuals with outstanding
achievements in the legal profession
and dedicated service to St. Mary’s
School of Law. The Law Alumni
Association began presenting an
award to a distinguished graduate
of the Law School in 1981. Prior to
1981, the Distinguished Law Gradu-

ate was selected by faculty members
of the Law School. The purpose of
the award is to recognize those graduates who have rendered service to
their clients and the legal community in accord with the spirit of the
mission of the University and of the
Law School.

Stephen Sheppard

On October 23
the San Antonio Bar
Association is excited
to welcome Stephen
M. Sheppard, Dean
of St. Mary’s University School of Law to
our monthly luncheon!
Before joining St.
Mary’s in June 2014,
Dean Sheppard was the Associate Dean for
Research and Faculty Development at the
University of Arkansas School of Law. He
was also named William H. Enfield Distinguished Professor of Law at Arkansas.
In addition to his work in the law school,
Sheppard was a graduate faculty member
in Political Science and Public Policy and
an advisory faculty member for European
Studies and the King Fahd Center for
Middle Eastern Studies.
Dean Sheppard, a member of the
Mississippi bar, has practiced law with
Phelps Dunbar in New Orleans; Jackson,
Miss.; and London, primarily in federal
litigation and environmental law. He also
has served as law clerk to U.S. District
Judge William Barbour and U.S. Appellate Judge E. Grady Jolly Jr.
His extensive education includes a
bachelor’s in political science from the
University of Southern Mississippi as
well as a Juris Doctorate and Master of
Laws from Columbia University. He also
earned a post J.D. certificate in international law and a Doctor of the Science
of Law from Columbia, plus a Master of
Letters from Oxford University.
The October luncheon will take place
at the Plaza Club, located on the 21st floor
of the Frost Bank building. The cost to attend is $25 for members of the San Antonio
Bar Association and Plaza Club members,

Pro Bono Awards Nominations Sought
The 2014 National Pro Bono Week will be
held October 19-25. In honor of this event,
the CJP is seeking nominations for its sixth
annual pro bono awards at the October 23,
SABA Monthly Luncheon. The individual
attorney and firm or local bar association
or section that took the most pro bono cases in the last 12 months will be recognized.
Additionally, we are seeking nominations
for our 2014 CJP Excellence in Pro Bono
Award. This award goes to an individual
or organization in the community that
has helped to further pro bono efforts or
shown an outstanding commitment to pro
bono work. Nominations should include a
letter of recommendation explaining what
the person or organization has done to
show a commitment to or enhancement of
pro bono work in our community. Please

Don’t miss the 23rd annual SABF Fun Run, Nov. 8
Lace up your snazziest running or walking shoes, and join us at 8 a.m. on
Saturday, November 8, 2014 for the 23rd annual SABF Fun Run and Junior Jog for Justice!
This year’s 5K course will take you
on a scenic run through the picturesque
City of Olmos Park, starting and ending
at the San Antonio Gun Club, located at
928 Contour Drive. “Ready. AIM. Run!”
showcases the good works of the Bexar
County Dispute Resolution Center’s
Amigos in Mediation (“AIM”) Program
— a unique public school training program that teaches school faculties and
students ways to resolve disputes and
conflicts without violence, as well as
leading efforts to address the epidemic
of bullying in our local schools. Proceeds
from the Fun Run will help the San Antonio Bar Foundation continue its support of this and other worthy missions in
the San Antonio community.
Our family-friendly event welcomes
everyone from stroller pushers to dog
walkers to recreational and serious runners. For the kiddos, Judge Toni Arteaga
is once again sponsoring the Junior Jog
for Justice. Children 12 years and younger
can enjoy the approximately 1/4-mile fun
run for kids, while older siblings may participate in the 5K run to compete for cash
prizes. After the race, stay to enjoy free
refreshments and kid-friendly activities.
We are also offering a Virtual Team
Relay to promote some healthy competi-
tion between the firms and other legal
organizations in our community. When
you sign up on-line, you can coordinate
with your fellow teammates to run under
the same team name. To participate in
the team relay, you must have at least four
runners sign up under your team name.
Make sure you use the exact same team
name when you register. The fastest four
runners from each team will be counted
toward the virtual team relay time, and
awards will be handed out after the race.
Bragging rights, of course, last forever.

for a successful event! Sponsorship levels are $300 (Bronze), $500 (Silver), $1,000
(Gold) and Title ($2500), which entitle
each sponsor to free entries for the race,

Thanks to the generous support of
the Texas Bar Foundation, Texas
Advocacy Project (“The Project”)
is pleased to announce the Assisted Pro Bono Program. The Assisted Pro Bono Program will provide
legal assistance to pro bono attorneys in Texas who are assisting
clients who are living at or below
150 percent of the federal poverty
level in family law matters, with a
special emphasis on cases involving family violence, sexual assault,
teen dating violence, or stalking.
Any attorney licensed to practice in
Texas who agrees to take a family
law case pro bono for a party with
an annual income at or below 150
percent of the federal poverty level
may call the Assisted Pro Bono Hotline at 1.866.598.4277 from 10 a.m.
to 4 p.m. Monday through Friday to
speak with a family law practitioner
for assistance in handling the pro
bono case. The Project’s lawyers
will provide legal advice relating to
property issues, custody, visitation,
and — most importantly — more
complex cases where domestic violence and sexual assault are an issue. Pro bono attorneys will receive
the support they need to succeed:
the Project’s lawyers will provide a
full spectrum of assistance, ranging
from answering basic questions relating to family law to drafting the
pleadings that the pro bono attorney
will need throughout the litigation.

Antonio’s bar keeps a small-town collegiality. While the days of catching up at the

SABA Brown Bag Lunch Series presents
‘Social Security for Dummies,’ Oct. 16
The San Antonio Bar Association
is proud to continue its 2014 Brown Bag
Lunch Series: “The SABA Sampler: Everything You Wanted to Know About...”
which focuses on a different area of law
each month. Each month, a new seminar is
hosted by, and covers topics relevant to, a
different Section of the San Antonio Bar.
The SABA Elder Law Section will host
the October Brown Bag Seminar on Thursday, October 16, entitled “Social Security
for Dummies,” presented by Constance R.
Somers. Ms. Somers will discuss the basics
of both the medical and the non-medical requirements for Social Security Disability, SSI,
and Childhood Disability Benefits (CDB,
formerly known as DAC), as well as procedures and pitfalls in the handling of claims.
Ms. Somers has been licensed since 1981 and
practicing as a sole practitioner since 1985,
specializing in Social Security cases. The seminar will be held at 12 noon in Judge Pozza’s
407th District Courtroom on the 4th floor of the
Bexar County Courthouse (100 Dolorosa).
The course has been accredited for 1.0 hour
of participatory CLE credit. Attendees are
encouraged to bring their own lunch. If you
don’t want to brown bag it, there are plenty of
to-go options in and around the Courthouse.
The Brown Bag Lunch Series, which
is usually held on the third Thursday of
every month and offers at least 1.0 hour
of CLE credit, is FREE to current members
of the San Antonio Bar Association. You
heard that right — that’s a minimum of
12 hours of FREE participatory CLE credit
toward fulfilling your annual State Bar requirements! Just for being a member of the
San Antonio Bar Association! The cost of
attendance to nonmembers is $25.

Red Mass
62nd Annual
The celebration of the Red Mass will be held on Thursday, October 9, 2014 at
6 p.m. at the San Fernando Cathedral. His Excellency, Archbishop Gustavo
Garcia-Siller, M.Sp.S., Archbishop of San Antonio, will officiate. All faiths
are welcome. The Red Mass has been a legal and judicial tradition since the
reign of King Edward III in the early 14th Century. A peculiarly English tradition, its purpose was to join the ordinary and traditional celebration of the
Mass to the traditions and processes of the courts and the law. In the United
States, the first Red Mass was celebrated in 1928. San Antonio revived the
tradition 62 years ago under the auspices of St. Mary’s University School of
Law and the Catholic Lawyers Guild of San Antonio. This Votive Mass of
the Holy Spirit calls upon God to grant light and inspiration to the lawyer in
pleading, and to the judge in adjudicating during the coming term. All individuals in the legal and judicial professions of all faiths are welcome at the
Red Mass to receive God’s blessing and guidance for the coming court term.
Members of judiciary and legal organizations may join in the procession
carrying a banner representing their organization into the Cathedral prior
to Red Mass. Judges robe at 5 p.m. for the procession beginning at 5:45.

the legal community. The Young Lawyer
Award is given to an attorney who has
been in practice for less than seven years.
Leslie is a Partner with Pulman, Cappuccio, Pullen, Benson & Jones, LLP where
her practice focuses on all aspects of state
and federal trial and appellate courts, bankruptcy courts, and arbitrations, with an emphasis on complex commercial litigation
and bankruptcy. Prior to joining Pulman,
Cappuccio, Pullen, Benson & Jones, LLP she
was a shareholder at Cox Smith Matthews
Incorporated and clerked for the Honorable
Edward Prado at the United States District
Court for the Western District of Texas.
Natalie is an associate with Langley
& Banack where her practice focuses on
commercial restructuring and litigation.
Prior to joining Langley & Banack, Natalie clerked at the Hawaii Supreme Court
for Justice Simeon R. Acoba, Jr., and was
in private practice.
Belva Ann Bennett Lockwood (October 24, 1830 – May 19, 1917) was an American attorney, politician, educator, and author. She was active in working for women’s
rights, although the term feminist was not in use. The press of her day referred to her as
a “suffragist,” someone who believed in women’s suffrage or voting rights. Lockwood
overcame many social and personal obstacles related to gender restrictions. After college, she became a teacher and principal, working to equalize pay for women in education. She supported the movement for world peace, and was a proponent of temperance.
Lockwood graduated from law school in Washington, D.C. and became one of the
first female lawyers in the United States. In 1879, she successfully petitioned Congress to be allowed to practice before the United States Supreme Court, becoming the
first woman attorney given this privilege. Lockwood ran for president in 1884 and
1888 on the ticket of the National Equal Rights Party and was the first woman to appear on official ballots.

The Bexar County Women’s Bar Foundation will hold its annual charitable fundraising event, Autumn Affair, at its new
location, the Veranda, at 1746 Lockhill Selma Road, San Antonio, Texas on Thursday, October 16, 2014, at six o’clock in the
evening. Proceeds from Autumn Affair will benefit the Rape Crisis Center
The Rape Crisis Center was founded in 1975 to provide comprehensive services to victims of sexual assault and their
friends and families. Today, it serves the community by offering counseling services, a crisis hotline, hospital accompaniment, and primary prevention programs across Bexar County and the surrounding areas. The proceeds from this year’s
Autumn Affair will help extend its primary prevention education curricula for middle and high school students.
In addition to raising money for the Rape Crisis Center through a raffle and silent auction, the 2014 Autumn Affair will
shine a spotlight on the Center’s important work in our community. The event will also allow the Bexar County Women’s

District Courts COMMITTEE
The District Courts Committee (DCC)
met at noon on September 4 in the Bexar
County Courthouse 5th floor courtroom.
This was on the first Thursday of the
month, which is our usual meeting date.
Five committee members attended, plus
one non-member judge (Judge Mery).
Our agenda was to discuss goals
for this committee, including possible
projects and topics of interest. Topics discussed at this meeting were:
Courtroom Technology. Which, if
any, of our courtrooms are up to speed
in technology and which are not? Judge
Specia’s courtroom (at the time) was the
first to be modernized; our first “hightech” courtroom. Other high-tech courtrooms followed; but that was years ago
(to put it into perspective, did you have
a smart phone ten years ago?) Therefore,
even the high-tech courtrooms, although
not obsolete, may have room for improvements to keep up with the rapid growth of
technology. Also, low-tech items that will
make hearings and trials easier for attorneys, can be added here and there — for
example, a scanner or fax machine for a
particular court or an easy place for an
attorney to “plug in” electronic devices.
With this in mind, we have created a subcommittee (yet to have an official name) to
survey our courtrooms, consult with the
judges, brainstorm and make recommendations for improvements that will benefit trial attorneys. These improvements
might be simple and inexpensive, or they
might require government funds and approval of the Commissioners Court. The
sub-committee’s work, chaired by Etan
Tepperman, could take a few months, and
a report will be published. Etan is completing his first year as a licensed attorney, yet
he is willing to take this on. We expect this
project to require quite a bit of time, and
current DCC members will be asked to
volunteer for this sub-committee. (I mentioned Etan being a new lawyer because
the DCC has a long history of providing
leadership opportunities, such as this new
sub-committee project. The hope and expectation is that the lawyers taking on
these projects will develop leadership and
project management skills that they will
apply in future service to the bar.)
Local Rules. The district judges adopted revised local rules about a year
ago, but these rules have not yet been approved by the Supreme Court. Therefore,
discussion was held on whether it would
make sense to review the proposed rules
one more time before the Supreme Court
approves them. No decision was reached;
it is just something to think about doing.
Courtroom Renovations. We discussed the latest round of renovations. The
entire renovation project will take several
more years to complete. In the meantime,
judges are changing courtroom venues
from time to time, so trial lawyers must
keep abreast of what court is in what courtroom (or what is being called a courtroom,
in some cases). Additionally, the renovation of the old presiding courtroom on
the 2nd floor continues. Under the decision
of the present Commissioners Court, this
courtroom, once restored, will be used for
Commissioners Court meetings and special events. Many lawyers believe its highest and best use would be as the presiding
courtroom, because it will be beautiful, and
would add dignity and pride to the trial
process. Also, it will easily accommodate
the morning docket call. But we must defer
to the wisdom of the Commissioners Court.
The Current Presiding Courtroom.
The acoustics are not good. In particular,
it is difficult to hear the announcements
at the back of the courtroom. The county
is aware of this, and the problem is being
looked into. Possibly, a speaker system
will be installed soon. One person suggested an elmo be installed to project each
case being called. Another suggestion is
to install a screen in the waiting area to
show what is going on in presiding.
Committee Meeting Attendance. The
fact that we had only five members present made our discussion easier, although
we would prefer larger attendance at these
meetings. In recent years, our meetings have
often featured a “presentation” that would
draw large attendance; however, what is
missing with the presentation model is the
opportunity for committee members to become better acquainted and to brainstorm.
This year we will focus more on discussion
meetings, with a presentation here and there.
Other. We discussed the headaches
of eFiling, as the methods and procedures vary from county to county, and
the clerks and lawyers are still working
out nuances for different kinds of filings.
We are in modern times, but perhaps
we are in the same position of society
as when people started switching from
horses to cars. That only took about forty
years. So, if you are having eFiling headaches, just know that you are not alone.
We also discussed how stressful trial
practice is, and for a moment, we felt sorry for ourselves. But that passed quickly,
because we are tough trial lawyers.
