SABF Fun Run and Junior Jog for Justice! This
year’s 5K course will take you on a scenic run
through the picturesque City of Olmos Park,
starting and ending at the San Antonio Gun
Club, located at 928 Contour Drive.
“Ready. AIM. Run!” showcases the good
works of the Bexar County Dispute Resolution Center’s Amigos in Mediation (“AIM”)
Program — a unique public school training
program that teaches school faculties and students ways to resolve disputes and conflicts
without violence, as well as leading efforts to
address the epidemic of bullying in our local
schools. Proceeds from the Fun Run will help
the San Antonio Bar Foundation continue its
support of this and other worthy missions in
the San Antonio community.

President’s Message
Who Packs Your Parachute?
In memory of my father and all who
served our country, I thought it best to
remember Veteran’s Day this year with
the following true story:
Who Packs Your Parachute?
-Author Unknown
Charles Plumb, a U.S. Naval
Academy graduate, was a U.S. Navy
jet pilot in Vietnam. After 75 combat
missions, his plane was destroyed by
a surface-to-air missile. Plumb ejected
and parachuted into enemy hands.
He was captured and spent 6 years in
a communist Vietnamese prison. He
survived the ordeal and now lectures
on lessons learned from that experience.
One day, when Plumb and his
wife were sitting in a restaurant, a
man at another table came up and said,
“You’re Plumb! You flew jet fighters in
Vietnam from the aircraft carrier Kitty
Hawk. You were shot down!”
“How in the world did you know
that?” asked Plumb.
“I packed your parachute,”
the man replied. Plumb gasped in
surprise and gratitude. The man
pumped his hand and said, “I guess
it worked!” Plumb assured him, “It
sure did. If your chute hadn’t worked,
I wouldn’t be here today.”
Plumb couldn’t sleep that night,
thinking about that man. Plumb
says, “I kept wondering what he
might have looked like in a Navy
uniform: a white hat, a bib in the
back, and bell-bottom trousers. I
wonder how many times I might
have seen him and not even said
‘Good morning, how are you?’ or
anything because, you see, I was a
fighter pilot and he was just a sailor.”
Plumb thought of the man
hours the sailor had spent on a long
wooden table in the bowels of the
ship, carefully weaving the shrouds
and folding the silks of each chute,
holding in his hands each time the
fate of someone he didn’t know.
Now, Plumb asks his audience,
“Who’s packing your parachute?”
Everyone has someone who provides
what they need to make it through
the day. Plumb also points out that he
needed many kinds of parachutes when
his plane was shot down over enemy
territory — he needed his physical
parachute, his mental parachute, his
emotional parachute, and his spiritual
parachute. He called on all these
supports before reaching safety.
Sometimes in the daily challenges
that life gives us, we miss what
is really important. We may fail
to say hello, please, or thank you,
congratulate someone on something
wonderful that has happened to
them, give a compliment, or just do
something nice for no reason.
As you go through this week,
this month, this year, recognize the
people who pack your parachute.
Speaking of who packs your parachute, I’d like to acknowledge some of the
people who packed mine: My parents,
Shirley and Eugene Keyser; my sister, Susan
Keyser; my grade school and high school
classmates, my high school teacher, Brother
Gerry, my college professor, Stan Duggan
and my legal mentor, Oliver Heard.
One more important order of business before I close: Several names were
unfortunately left off last month’s list

Fun Run, Nov. 8

For the kiddos, Judge Toni Arteaga
is once again sponsoring the Junior
Jog for Justice. Children 12 years and
younger can enjoy the approximately
1/4-mile fun run for kids, while older
siblings may participate in the 5K run
to compete for cash prizes. After the
race, stay to enjoy free refreshments
and kid-friendly activities.
We are also offering a Virtual Team
Relay to promote some healthy competition between the firms and other legal
organizations in our community. When
you sign up on-line, you can coordinate
with your fellow teammates to run under the same team name. To participate
in the team relay, you must have at least
four runners sign up under your team
name. Make sure you use the exact
same team name when you register.
The fastest four runners from each team
will be counted toward the virtual team
relay time, and awards will be handed
out after the race. Bragging rights, of
course, last forever.
We need your help to set the pace
for a successful event! Sponsorship levels are $300 (Bronze), $500 (Silver), $1,000
(Gold) and Title ($2500), which entitle
each sponsor to free entries for the race,
including all pre-post-race activities, early mention in the Subpoena, your name
or firm’s name on the T-shirt, registration brochures and finish line banners.
The number of free entries begins with
8 at the $300 level and increases with the
sponsor amount.

Thanks to the generous support of
the Texas Bar Foundation, Texas
Advocacy Project (“The Project”)
is pleased to announce the Assisted Pro Bono Program. The Assisted Pro Bono Program will provide
legal assistance to pro bono attorneys in Texas who are assisting
clients who are living at or below
150 percent of the federal poverty
level in family law matters, with a
special emphasis on cases involving family violence, sexual assault,
teen dating violence, or stalking.
Any attorney licensed to practice in
Texas who agrees to take a family
law case pro bono for a party with
an annual income at or below 150
percent of the federal poverty level
may call the Assisted Pro Bono Hotline at 1.866.598.4277 from 10 a.m.
to 4 p.m. Monday through Friday to
speak with a family law practitioner
for assistance in handling the pro
bono case. The Project’s lawyers
will provide legal advice relating to
property issues, custody, visitation,
and — most importantly — more
complex cases where domestic violence and sexual assault are an issue. Pro bono attorneys will receive
the support they need to succeed:
the Project’s lawyers will provide a
full spectrum of assistance, ranging
from answering basic questions relating to family law to drafting the
pleadings that the pro bono attorney
will need throughout the litigation.

Expand your client base with the
San Antonio Bar Association’s Lawyer Referral Service
The San Antonio Bar Association’s
Lawyer Referral Service is a valuable
source of clients for our members, and
it needs competent lawyers in all fields
of law to handle the increasing number
of client calls.
Attorneys who participate in the
LRS are not obligated to accept any case
that is referred to them by the service,
and the clients are told from the outset
by LRS staff that the attorney services
are not free. The calls are screened first
by the staff, and the clients are then referred to attorneys on a rotation basis
according to the following criteria: area
of law, geographical location, and language preference. The LRS is funded by
annual member dues of $200 and by a
10 percent fee paid by the member to
the LRS from any fees the lawyer re-
ceives in any referred case.
Not only does the SABA Lawyer Referral Service help our members expand
their client base, it also provides a valuable service to the community by assisting those persons who have legal issues
or questions but who do not know where
to turn to find a lawyer who is knowledgeable in the area in question.

Wells has been named managing director
of the Foundation. Wells succeeds Palmer
Moe who retired in May. Bank of America,
NA serves as trustee for the foundation.
The Kronkosky Foundation was created by
Albert Kronkosky, Jr. and Bessie Mae Kronkosky. Its mission is to produce ‘profound
good that is tangible and measurable’ in
Bandera, Bexar, Comal, and Kendall counties. The foundation supports programs
in the areas of health and human services;
cultural activities; parks, zoos and wildlife
sanctuaries; animal cruelty prevention and
assisting victims of public disasters in Texas. This extraordinary and generous couple
created a legacy of giving that stands as the
single largest gift to this region. Since the

Attorneys interested in an ID may obtain a
Bexar County Courthouse Attorney Identification Badge Application online at is.gd/
SABAbadge. The application fee for an Attorney Identification Badge is $40 for attorneys who are members of the San Antonio

Association Fiesta
Medal Contest
The FBA San Antonio Chapter is
holding its first annual FBA Fiesta Medal Contest! The FBA is accepting Fiesta
Medal Designs through the end of the
December 10th member luncheon. You do
not have to be a member of the FBA San
Antonio Chapter to participate. Please
design for a 1.5-inch medal with a limit
of six colors (gold or silver background
does not count toward the color limit).
Designs will be reviewed by the Fiesta
Medal Design Committee and the winner will be announced at the January 14
member luncheon. The lucky designer
will have the satisfaction of knowing his
or her design will be worn throughout
San Antonio. The FBA will also throw in
two tickets to NIOSA and a feature in The

Order Required for Supervised Visitation
and Neutral Exchanges
Supervised visitation and exchange
services are frequently utilized by courts
and families when parents in high conflict
litigation are ordered to exchange children
for parenting time or when a parent is ordered to have supervised parenting time.
Since 2002, the Bexar County Domestic
Relations Office (DRO) has provided financial support for supervised visitation
and neutral exchange services through
two contracted agencies: Family Service
Association — KidShare and the Center
for Family Relations. Both agencies offer the supervised visitation and neutral
exchange services on a sliding fee scale
with a court order. Currently, the agencies will accept most orders that identify
the services. Unfortunately, many orders
lack important information for the parties
and often do not provide for a clear and
consistent process for facilitating these
services. Therefore, to remedy this situation, the DRO with input from the DRO
Advisory Board, numerous Civil District
Court Judges, and the two agencies, created the Temporary Order for Neutral Exchange or Supervised Visitation at Center
for Family Relations or KidShare.
This order identifies such things as
where the services are to take place, the
party or parties responsible for the cost,
and other specifics about the supervised
visitation and neutral exchange. Additionally, the order contains check box options
so that the order can be specifically tailored
for each individual case. The goal of creat-

Judges, and posted on the the Bexar
County Juvenile Probation website. The
Domestic Relations Office maintains hard

District Courts COMMITTEE
The District Courts Committee met
at noon on October 2 in the Bexar County
Courthouse’s 5th floor courtroom. This
was on the first Thursday of the month,
which is our usual meeting date. Sixteen
persons attended, including Judge Mery,
Judge Nellermoe, and Donna Kay McKinnney, our District Clerk.
The agenda was to continue our discussion of goals for this committee, including possible projects and topics of interest.

Brian Steward volunteered for this subcommittee, which is chaired by Etan Tepperman. We discussed particular acoustic
problems in Judge Nellermoe’s courtroom
and the fact that the county is trying to
solve these problems. We still need more
volunteers for this subcommittee.
eFiling
We discussed ongoing eFiling issues in
Bexar County. Donna Kay McKinney
pointed out that her office will provide
assistance to any attorneys who come in
for help. Jimmy Carter raised a recurring
problem he has encountered with obtaining a judge’s signature on a fiat or order
when using eFiling. The District Clerk’s
office is aware of this issue. Jimmy volunteered to meet with Ms. McKinney to
further understand why this problem
exists and how it might be resolved (or
how to work around it within the limitations of the current system.) Jimmy will
eventually give us a written report. It is
hoped that this report can be published
to the bar as an aide in eFiling.

Joe Gamez expressed interest in identifying things that could be done to further
accommodate lawyers in Presiding during docket call; in other words, to make
life easier. An example would be providing a Starbucks kiosk (this obviously is
not realistic, and you can’t have coffee
in court anyway, but is an example). Joe
agreed to chair a subcommittee to brainstorm on ideas.

Emeritus Lawyers –
Pilot Program
Allan DuBois, also told us about a program he wants to promote as presidentelect, and as president of the State Bar.
This program — only at the concept
stage right now — would pair emeritus
lawyers (age 70 +) with new lawyers so
that one could help the other. For example, the emeritus lawyer would provide space, clerical support and wisdom,
and the new lawyer would provide legal
work and administrative assistance. This
concept would allow the emeritus lawyer to maintain purpose by contributing
knowledge which would otherwise be
lost. The new lawyer gets a good start. If
you have any ideas on this, please share
them with Allan DuBois.

Federal Courts COMMITTEE
Arc of a Case
On Friday, November 14, 2014,
the Civil Law and Magistrate Judge
Liaison Subcommittees of the Federal
Courts Committee of the San Antonio
Bar Association are proud to present
their inaugural Arc of a Case program,
designed to bring a big-picture perspective
to the young lawyer engaged in federal
civil litigation. The program will walk
the young lawyer through the litigation
process, from accepting the client and
filing of the complaint to discovery, ethical
pitfalls, and preparation for trial. Expected
speakers include several prominent local
federal civil practitioners, including a
question-and-answer session with a few
federal judges, who will discuss various
aspects of federal litigation practice.
The program will begin at 9 a.m. at
the Adrian A. Spears Federal Judicial
Training Center, 643 East Durango Blvd.,
San Antonio, TX (immediately west
of the John H. Wood, Jr. United States
Courthouse and directly across from the
front door to the courthouse). Registration
will begin at 8:30 a.m. A box lunch will
be provided during the program. The
registration fee is $35 and includes the box
lunch. Business dress is recommended.
If necessary, we will limit attendance to
room capacity. Additionally, we anticipate
approval for 6.0 hours of participatory
CLE credit, including 1.0 hour of ethics.

Constitution Day
On September 17, 2014, volunteers
from the San Antonio Bar Association’s
Federal Courts Committee and the
San Antonio Chapter of the Federal
Bar Association presented the annual
Constitution Day program to over 1,700
students from five local high schools:
Edison, Fox Tech, Highlands, Wagner, and
the Young Women’s Leadership Academy
in the San Antonio Independent School
District. The program provides a way
to educate young high school students
about the United States Constitution and
how it affects their lives as students and
private citizens.
As part of the program, attorneys
made brief presentations on the
Constitution, including the First and
Fourth Amendments. They discussed
citizens’ rights regarding aspects of
freedom of speech, freedom of religion,
the right to assemble, and searches and
seizures not only at a local level, but also
in public schools. The presenters also gave
the students free pocket Constitutions,
courtesy of the Federal Bar Association
and the San Antonio Bar Association.
Following the attorney presentations,
the students were able to show off their
newly acquired knowledge by joining in
a quiz on the Constitution.
The Federal Courts Committee has
been presenting the Constitution Day
program for many years. This year’s
event was organized by the Special
Projects Chair Soña Ramírez. The
Committee would like to extend its
thanks to the high schools for helping
organize the event, as well as to the
following volunteers, some of whom
have volunteered for the program for

SA Bar Auxiliary supports CASA
The Bar Auxiliary’s first meeting of
the new year was held at Los Patios on
Tuesday, September 23. The speaker and
special guest was Yolanda Valenzuela,
director of Child Advocates of San Antonio (CASA). Ms. Valenzuela spoke about
her experiences with the youth, ages
birth through 18 years, the trials they
have experienced, and how CASA volunteers help the youths choose a better
path for a better life.
There are 71 CASA agencies throughout the country, and San Antonio’s is one
of the best. The mission of CASA is to
recruit, train, and supervise court-appointed volunteer Advocates who provide constancy for abused and neglected
children and youth while advocating for
services and placement in safe and permanent homes. There are currently 500
volunteers and 1,650 children in the San
Antonio CASA system, and more volunteers are needed.
The San Antonio Bar Auxiliary sponsors a yearly Angel Tree, which holds cards
containing a youth’s age and gender (no
name) for members to select and purchase
$50 store gift cards. The gift cards are presented to CASA at the Auxiliary’s annual
Holiday Open House, which will be held
December 7 in the home of Mary-Jean
and Matt Stolhandske. All members, their
guests and interested parties are welcome
to attend and participate in the Angel Tree.
This year, Ms. Valenzuela requested
that gift cards be purchased from either
K-Mart or Wal-Mart, since a number of
the communities where the youth reside
do not have wide store selections but always have these two stores.
Immediately following the luncheon,
the San Antonio Bar Auxiliary Foundation Board met to vote on the scholarship
funding for 2014-2015. It was determined
that $2,500 would, once again, be presented to a St. Mary’s Law student and $1,500
to a San Antonio College ParaLegal student. Scholarship recipients are chosen
by the schools, and each student receives
their scholarship at the May meeting.
