Implant System OKTAGON®
The OKTAGON® implant system consists of grade 4, pure titanium and is available in TISSUE LEVEL and
BONE LEVEL versions.
Tissue Level implants are connected to the prosthetic restoration via an 8° inner cone
with additional octagonal rotation stop. Bone Level implants are connected via a 15° inner
cone where by internal grooves secure the prosthetic components in position.

The macro-roughness exhibits a roughness profile of 20 to 40 µm with micro-roughness of 2.0 to 4.0 μm.
The surfaces in the endosteal section are sandblasted with corundum (> 99% Al2O3 = aluminium oxide)

Regular Platform (RP)
OKTAGON® 3.3 mm Ø RP implants are an alternative option for cases with a minimum jaw width of
5.5 mm and a mesiodistal gap of at least 7 mm between adjacent teeth.
As their mechanical strength is lower than that of the 4.1 mm Ø implants, these implants should only
be used for the following indications:
EDENTULOUS JAW
4 Implants Ø 3.3 mm RP in combination with a bar.
PARTIALLY DENTATE JAW
Fixed restorations on 4.1 mm Ø implants should be splinted with a superstructure.
OKTAGON® Implants Ø 4,1 mm RP are an alternative option for cases with a minimum jaw width of 6.0
mm and a mesiodistal gap of 7.0 mm between adjacent teeth.
OKTAGON® Implants Ø 4.8 mm RP are an alternative option for cases with a minimum jaw width of 7.0
mm and a mesiodistal gap of 7.0 mm between adjacent teeth.

Tapered Design (TD)
Immediate and early implantation
Thanks to its geometry, the Tapered Design Implant combines the specific advantages of cylindrical and
conical implants.
The coronal section of this implant has a 1.8 mm high smooth surface and, due to its geometry, respects
both the biological width as well as an extended range of indications. Depending on the surgical evaluation, this type of implant can be placed transgingivally, semigingivally or subgingivally thus providing for
flexible soft tissue management.

support and power transmission of the abutment to the implant and
ensures the tightness of the joint.

Guarantee conditions
terms and conditions
The guarantee relates to the OKTAGON® and HEXATEC® implant systems of DRS
International GmbH, hereinafter referred to as «DRS products and components».
In addition to the statutory seller’s warranties we provide – at the discretion of
the authorised persons from this guarantee – a guarantee as follows:
1.GENERAL/SCOPE
1
SCOPE OF GUARANTEE
In accordance with our guarantee promise DRS guarantees treating dentists,
who after 01.01.2014 fitted original DRS products and components in their patients under the following requirements and conditions, to replace these DRS
products and components if the fixation fails. This includes free delivery of the
relevant DRS product and DRS components as well as compensation of the
resulting additional treatment costs for replacement. The guarantee only covers the normal wear of DRS implants and abutments with a lifetime guarantee
excluding instruments. It is a requirement of the guarantee that the patient did
not have any contraindications specified in the product description before, during or after implant placement. This obligation applies only for DRS products,
which have been sold in Germany by DRS and inserted in Germany. The basis
of the guarantee is always the individual guarantee certificate given by DRS
with the delivery of a DRS product. The obligation is only for the benefit of a
treating doctor/dentist. Third parties, in particular patients or intermediate suppliers cannot derive any rights from this guarantee. The assignment of claims
from the guarantee declaration is excluded. This guarantee programme is valid
in the Federal Republic of Germany.
2GUARANTEE CONDITIONS AND EXCLUSIONS
DRS undertakes to replace only if the fixation fails within lifetime guarantee, even
though the following essential conditions have been fulfilled by the treating dentist
or doctor and/or patient:
• The patient must be carefully selected by the treating dentist and/or doctor,
informed about the risks connected with the treatment and the obligations of
the patient and asked to cooperate.
• The indications/contraindication must be carefully observed and documented. [More details are available in the respective product descriptions.]
• At the time of treatment the available instructions from DRS and recognised
dental medical procedures must be observed and used accordingly before, during and after implant placement. The attending doctor is additionally
responsible to regularly inform himself about the current status of the
DRS-products and –components and their proper use.
• Continual good oral hygiene by the patient and checks at regular intervals
must be ensured and documented.
• The product that is the subject of the claim must be returned in a sterilised
state for the purpose of identification. A completed guarantee form, the original guarantee certifi cate and the required additional documents for fulfilling
the conditions of the guarantee must be submitted together with the product.
• The guarantee does not apply: if DRS products have been modified or if DRS
products have been used in combination with products that did not originate
from DRS; for special designs or specially fabricated or modified products; if
failure of an implant is triggered or induced by an accident, trauma or other
damages caused by the patient or a third party; and in case the disadvantage
bases on the fact the attending doctor does not have provable knowledge
of implantation technology or does not have acc. qualification in this special
field.

If you think you meet the requirements for making a claim under guarantee,
within the framework of the guarantee procedure you must submit a completed and signed guarantee form (including the required attachments therein)
together with the original of the guarantee certifi cate to DRS within 1 year of
becoming aware of the failure of the DRS products and/or components. All
components must be returned sterilised.

5OTHER
By participating in this guarantee programme and the purchase of products
from DRS in connection with it, the treating dentist and/or doctor accepts the
conditions defined herein.
6VALIDATION
These warranty terms are valid beginning from 01.06.2014 for all DRS-products
and/or –components used after 01.01.2014. In case at the time of purchasing
DRS-products and/or –components the then valid warranty terms were covering a larger scope of warranty terms as the now valid terms, then these terms
will apply.

1.1. Our terms and conditions of delivery and payment apply for all business
relationships with our customers and customers accept them as binding
for them with placement of an order.
1.2. Conditions that deviate from the following and/or legal provisions – in
particular in the conditions of purchase of the customer – are only binding for us, if they have been confirmed in writing. This also applies
for conditions, which are not stipulated in our terms and conditions for
delivery and payment. The unconditional delivery of goods or receipt of
payment does not mean any acceptance of deviating provisions by us.
1.3. All agreements, which are reached between us and the customer for the
purpose of fulfilling a contract, are laid down in writing in the contract
and in these applicable terms and conditions. Changes, additions or
cancellation of a contract or these terms and conditions are only effective with our written confirmation.
2.OFFERS/OFFER DOCUMENTATION
2.1. Our offers are non-binding, if no other agreement has been made.
2.2. Illustrations, drawings, calculations and other product, application or
project related documents remain our property and are subject to copyright, even if we place them at the customer’s disposal: they may not be
reproduced or made accessible to third parties without our express prior
written consent.
3.
PRICES/TERMS OF PAYMENT
3.1.Unless otherwise agreed, our prices apply “ex-works”. The costs for
package, insurance, freight and VAT are not included and will be invoiced separately. The VAT will be shown separately on the invoice at the
statutory rate on the invoice date. If we do not have any written request
in advance by the recipient for uninsured delivery, all our shipments will
be internationally insured at the expense of the recipient.
3.2. With customer-specific production we are entitled to an over or under
delivery of 10% in relation to the order quantity and to invoice accordingly.
3.3.Unless otherwise agreed, the purchase price is net (without deductions)
payable within 30 days from the date of the invoice. Deduction of a discount requires special written agreement.
3.4. Should the customer be in default of payment, we are entitled to charge
default interest at 8% over the current valid base interest rate. We are
entitled to charge reminder fees of 30.00 to 60.00 EUR for each reminder
depending on the reminder stage.
3.5. If, after conclusion of the contract, a significant deterioration of the
customer’s financial circumstances is recognised which will endanger
our claim for payment, provided there is an obligation for advance performance we are entitled to withhold our performance up and until payment is effected or security is provided to us for our payment claim. If,
after a reasonable deadline set by us, the customer is neither willing to
perform concurrently nor provide security we will be entitled to rescind
the contract.
3.6. The customer shall only be entitled to offsetting rights, if they have been
established by us as existing and due or enforced by law. The customer
is only entitled to right of retention in so far as the counterclaim is based
on the same contractual relationship.
4.DELIVERY, TIMES & PARTIAL DELIVERIES
4.1. Compliance with our delivery obligations shall depend on punctual due
fulfilment of the obligations of the customer, in particular compliance
with the agreed terms and conditions of payment. The right to raise an
objection to a non-fulfilled contract is reserved.
4.2. The delivery times agreed in writing begin on the day of our confirmation
but not before clarification of all technical and commercial details as
well as presentation of any authorisations required. Any modifications
requested by the customer regarding the delivery of the contractual object within the period of delivery shall interrupt and extend the period of
delivery accordingly.
4.3. Occurrence of unforeseen events, force majeure and non-delivery by our
supplier for which we are not responsible entitle us to suspend the delivery for the duration of the disruption and a reasonable restarting period.
4.4. Partial deliveries are permitted to a reasonable extent.

4.6. If delivery is delayed for reasons for which the customer is responsible,
the customer can be charged a storage fee for each month started at 0.5
percent of the price of the delivery items but not more than 5 percent. After a reasonable period of grace we are entitled to dispose of the delivery
item otherwise and to supply the customer after a reasonably extended
period. The contractual parties reserve the right to provide evidence of
higher, lower or no storage costs. The statutory right to rescind the contract and claim compensation for damages remain unaffected.
4.7. If the customer is in default of acceptance or is in violation of other obligations to cooperate, we are entitled to claim compensation for damages incurred by us to this extent including any additional expenses. We
reserve the right to make further claims.
5.DISPATCH, TRANSFER OF RISK
Unless otherwise agreed, delivery will be made using the most favourable
mode of shipment for us. All deliveries are made ex warehouse, at the expense and risk of the recipient, creditworthiness assumed. At the request of the
customer and against payment of the additional costs we also arrange special
modes of dispatch (e.g. express transport) or partial deliveries.
6.Notification of defects, guarantee, liability
6.1. The customer must check the delivery with due care immediately after
receipt and notify us in writing of any detectable defects immediately or
at the latest within seven days after delivery (obvious defects) or discovery. Otherwise the delivery is deemed to have been accepted.
6.2. Guarantee claims shall not be valid with natural wear or damages, which
were caused after transfer of risk as a result of incorrect or negligent
handling, excessive loading, unsuitable equipment or due to special external influences, which have not been provided for in the contract. If
the customer or a third party undertake improper modifications or repair
work, guarantee claims are also not valid for these or consequences
arising therefrom.
6.3. If there is a defect for which we are responsible, we have the choice of
remedying the defect or making a replacement delivery.
6.4. If we refuse to remedy the defect or make a replacement delivery, if it is
unacceptable for the customer or it fails, the customer has the choice of
rescinding the contract or reducing the purchase price by a reasonable
amount. This is provided, however, that there is no doubt that the notification of defect is justified. If the notification of the defect is unfounded,
we are entitled to demand reimbursement of any expenses incurred by
us from the customer.
6.5.Unless otherwise stated hereinafter, other or additional claims under guarantee, in particular claims of compensation for damages instead of
performance are excluded. We therefore do not accept liability for damages, which were not caused to the delivery item itself; in particular we
are not liable for a loss of profit or other financial losses of the customer.
6.6. The aforementioned disclaimer does not apply, if claims are made for
damages based on grossly negligent or intentional breach of duty or
claims are made for damages arising from injury to life, body or health or
the customer makes a claim because of absence of a warranted product
feature. With the latter claims for compensation can only be made in so
far as the warranted feature covers the risk of consequential damage
and the damage that occurred is based on its absence.
6.7. The guarantee period is for one year from the transfer of risk (Subparagraph 5).
6.8. Claims for personal damages or damage to privately used items according to the German product liability law remain unaffected by the aforementioned provisions.
7.Returns
7.1. We generally only take back originally packaged and unused goods within six weeks after receipt of the goods and after our prior agreement.
We charge 25% of the net value of the goods when accepting returned
goods. If it has exceptionally been agreed to take goods back that are
not in the original packaging, handling fees will be charged accordingly
but not less than 20% of the net value of the goods.
7.2. Goods can only be taken back if the Lot number is given.
7.3. Special orders and designs as well as sterile goods are generally excluded from exchange.
8.Retention of title
8.1. Goods supplied remain our property (retention of title goods) until all our
claims against the customer from the business relationship have been
completely fulfilled.
8.2
If the customer is in breach of obligations, in particular in default of payment, we are entitled rescind the contract and recover the goods; the
customer is obliged to return the goods. Withdrawal or exercising retention of the title does not require rescission by the supplier; in such
actions or a seizure of the reserved goods by us shall not be deeded as
rescission from the contract, unless we have expressly stated this to be
the case.
8.3. The customer is entitled to resell the goods in the ordinary course of
business; however, the customer now assigns to us all claims to the
amount of the final invoice value (including VAT), accrued from the resale
against the purchasers or third parties, regardless of whether the goods
supplied were resold before or after processing. The customer remains
authorised to collect this claim even after assignment. Our authority to
collect the claim ourselves remains unaffected by this. However, we
undertake not to collect the claim as long as the customer fulfils the
payment obligations from the proceeds collected, is not in default of
payment and in particular when no application for the opening of insolvency proceedings has been made or payments have been suspended.
If this is the case, however, we can demand that the customer informs us
of the assigned receivables and the debtors, gives us all the information
and relevant documents necessary to assert our rights and informs the
debtors (third parties) of the assignment.
8.4. For the duration of the retention of title the customer may not pledge the
retained goods or use them as security. The customer shall inform us
without delay in the event of pledges, seizures or other dispositions or
interference by third parties so that we can assert our rights. If the third
party is not in a position to refund us the judicial or extrajudicial expenses of an action under Article 771 of the German Code of Civil Procedure
(ZPO), the customer shall be liable for the loss we incur.
8.5. The customer is obligated to handle the object of sale with care; in particular the customer is obligated at their own expense to insure the object of sale adequately to cover the replacement value against damage
caused by fire, water or theft. If maintenance and inspection work are
required, the customer must perform these in a timely fashion at their
own expense.
8.6. The processing or modification of the object of sale by the customer
shall always be undertaken for us. If the object of sale is processed or
inseparably mixed with other objects not belonging to us, then we shall
acquire co-ownership of the new item in proportion to the ratio of the
value of our item (final invoice value including VAT) to the other objects
at the time of processing or mixing. The same applies to items that have
been processed or mixed as for the goods supplied subject to retention
of title. If mixing is performed in such a way that the supplier’s goods
are regards as the main item, it is agreed that the customer transfers
co-ownership proportionally. The customer shall store the sole property
created for us.
9.Effectiveness of the contract
If one or more of the provisions of these General Terms and Conditions of
Delivery and Payment is or becomes inoperative, this does not affect the efficacy of the other provisions. Rather the ineffectiveness of the provision will be
replaced by a provision that is as close as possible to the identifiable interests.
10. Place of performance, place of jurisdiction,
applicable law
10.1. Our business location shall be the place of performance for both parties
for all rights and obligations resulting from our deliveries. We shall have
the optional right to take legal action at the location of the customer.
10.2. German law shall apply exclusively. Use of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.
The data specified by the customer will be stored and processed by
electronic data processing provided it is permitted in accordance with
the data protection act.

4.5. If we are in default in delivery, the customer is entitled to set us an extended deadline in writing. If the delivery goods have not been delivered by
us within the period of the extended deadline, the customer is entitled to
withdraw for those parts which were not delivered before expiry of the
extension. We accept liability for provable damages that occur to the
customer due to a delay for which we are at fault. Our liability is limited
in such a way that the customer can claim 0.5 percent for each complete week of the delay but not more than 0.5 percent in total of the price
for the part of the delivery that could not be put into proper operation.
This does not imply a change in the burden of proof to the disadvantage of the customer. The statutory right of withdrawal of the customer
remains unaffected.
