Royal 1WTC Management LLC an affiliate of The Durst Organization Inc. 115 Broadway, Suite 1602 New York, NY 10006 212.218.1370 www.durst.org ASSUMPTION OF RISK, RELEASE AND HOLD HARMLESS AGREEMENT WHEREAS, I ____________________ have requested ROYAL 1 WTC MANAGEMENT LLC (“Royal”) for permission to be allowed on premises known as the One World Trade Center site in the Borough of Manhattan, County, City and State of New York (the “Premises”); and WHEREAS, I have been advised that, to grant this request involves serious hazards to me, including risk of personal injury due to the existence of construction and other activities at the Premises, but still I desire permission to enter the Premises. NOW THEREFORE, to induce Royal to give me permission to be allowed on the Premises, I hereby: 1. To the fullest extent permitted by law, assume all risks and hazards attendant upon my entry on and my presence at the Premises; 2. To the fullest extent permitted by law, release Royal, The Durst Organization Inc., Royal Realty Corp., 1 World Trade Center LLC, The Port Authority of New York and New Jersey, Tower 1 Member LLC, Tower I LLC, Tower 1 Joint Venture, LLC, Durst 1 WTC LLC, Durst 1 WTC Consultant LLC, Durst 1 WTC Developer LLC, Durst Development and Management LLC, Durst WTC Corporation, Durst WTC Holding LLC, The Durst Organization, L.P., The Durst Manager LLC, SRDA Manager LLC, Tishman Construction Corporation of New York, and each of their affiliated and subsidiary corporations, partnerships, limited partnerships, limited liability companies, and other entities thereof as may now or hereafter exist, including nominees or trusts, and the members, shareholders, partners, directors, officers, employees and agents of any such person or entity (collectively, “Royal, et al.”) from and against any and all causes of action, claims, rights or demands which I or my heirs, executors, administrators, or assigns might have as a result of any losses, damages, expenses, personal injury or death, which I or any person on the Premises under my permission may suffer or sustain; and 3. To the fullest extent permitted by law, agree to indemnify and hold harmless Royal, et al. from and against any and all loss or damage, claim, demand, suit or action caused by or directly or indirectly arising out of or in connection with my presence on or about the Premises (collectively, a “Claim”), and from all judgments for damages on account of or by reason of any such Claim, including but not limited to bodily injury, death and damage to property, and from all reasonable costs and expenses incurred by Royal, et al. on account of or by reason of any such Claim, including, without limitation, reasonable attorneys’ fees and disbursements.
