Völlig unangemessen und insoweit nicht auf Verständnis stoßend ist jedoch, die Beteiligung sachkundiger Akteur*innen so zu organisieren und zu terminieren – mit Frist für die Stellungnahme binnen Tagesfrist –, die erkennen lässt, dass eine substantielle Beteiligung nicht wirklich gewollt und nur eine leere Formalie ist. Bereits die hektische Betriebsamkeit, unter der die Gesetzentwürfe erarbeitet und der Öffentlichkeit präsentiert worden sind, lässt jede Seriosität vermissen, die von Gesetzesvorhaben zu hochkomplexen Gegenständen zu erwarten ist. Die Gesetzesentwürfe berühren den Kernbereich des Grundrechts auf Asyl und des humanitären Flüchtlingsrechts, indem sie protektionistisch auf Abschottung und Abschreckung setzen und nicht nur lediglich verfahrenssteuernde Regelungen treffen. Sie sind maßgeblich davon gespeist, sich der Verantwortung für Zuflucht suchende Menschen zu entledigen. Die Vereinigung Demokratischer Juristinnen und Juristen hält die vorliegenden Entwürfe für völlig ungeeignet, einen ganzheitlich humanitären Beitrag zur Lösung des aktuellen Fluchtgeschehens zu leisten, die im Übrigen auch jenseits verfassungsrechtlicher Bindungen, insbesondere der Unantastbarkeit der Menschenwürde nach Art. 1 GG, angelegt sind.
