自動車リサイクル法では、使用済み自動車や解体自動車（廃 車ガラ※）などは、廃棄物処理法上の「廃棄物」とされています。 ※ 自動車リサイクル法上、 「解体自動車」とは、使用済自動車を解体することによって、部品、 材料等有用な物品を取り外した後に残存するもの（廃車ガラ）をいいます。 また、ハーフカット等が行われた自動車から、フロン類又は エアバック類、鉛蓄電池、リチウムイオン電池、ニッケル・水 素電池、タイヤ、廃油、廃液若しくは室内照明用の蛍光灯が回 収されていない場合は、それが客先の依頼によるものでも自動 車リサイクル法違反であり、そのハーフカット自動車等は「廃 棄物」に該当するおそれが高いものとなります。 ＜違法行為の例＞ 車上作動処理されていないエアバッグ類が取り外されてい ないハーフカット車の輸出 車上作動処理されていないエアバッグ類が取り外されてい ないハンドルの輸出 引き取り報告未実施の使用済自動車の解体、解体自動車の引 渡報告未実施 など 廃棄物の輸出に当たっては、環境大臣の確認を受けることが求 められ、違反した場合には、廃棄物処理法に基づき罰則（５年以 下の懲役又は最大３億円の罰金）が課されます。 自動車リサイクル法の再資源化基準及び廃棄物処 理法を遵守し、自動車解体部品の不適切な輸出を 行わないよう注意してください。 Be careful when exporting Half-cut cars! End-of-Life Vehicles (ELVs), Dismantled Vehicles and Parts Specified for Recycling (e.g. inflator for air-bags) shall be deemed as WASTE, as described in article 121 of the ELV Recycling Act. Vehicles for export which undergo the dismantling operations (e.g. Half cut, Roof cut), must have all of fluorocarbons, air-bags, lead batteries, lithium-ion batteries, nickel hydride batteries, tires, waste oil, waste liquids, and interior fluorescent lamps properly removed by licensed dismantling operators. When all of these items are not properly removed from the vehicles, they are likely waste, even if it meets clients’ request. ＜Examples of illegal acts＞ Exporting half-cut cars without removing the air-bags that have not been processed for in-vehicle operations Exporting steering wheels without removing the air-bags that have not been processed for in-vehicle operations Dismantling ELVs without reporting collection, delivery of dismantled vehicles, etc. When exporting waste without consent of the Environment Minister, exporters may be liable for punishment (imprisonment for up to five years or a fine of up to 300,000,000 yen.) for unconfirmed export of waste even if this illegal exporting is not completed but only attempted. Be sure to comply with the ELV recycling Act and Waste Management and Public Cleansing Law so as to prevent the inappropriate exportation of dismantled automobile parts.
