北朝鮮による核及びミサイルの脅威に関する
日本国防衛省、大韓民国国防部及びアメリカ合衆国国防省の間の三者間情報共有取決め
日本国防衛省、大韓民国国防部及びアメリカ合衆国国防省（以下「参加者」という。
）は、
秘密情報の共有について相互の利益を有し、次のとおり一致する。
１．参加者は、北朝鮮による核及びミサイルの脅威に関する秘密情報の共有を可能にするた
めのメカニズムを構築する意図を有する。
２．この取決めに基づき交換される秘密情報は、本取決めの第３パラグラフに記述される日
本国政府及び大韓民国政府それぞれがアメリカ合衆国政府と締結している既存の二国間の情
報共有協定によって定められている情報の定義の範囲内で、口頭、映像、電子、磁気又は文
書の形態を含め、いかなる形態もとることができる。
３．参加者は、この取決めに基づき、各参加者間で共有されたいかなる秘密情報も次の二国
間協定に従って保護する意図を有する。１９８７年９月２４日ワシントンD.C.において署名
された秘密軍事情報の保護に関する大韓民国政府とアメリカ合衆国政府との間の協定（以下
「米韓協定」という。）及び２００７年８月１０日に東京において署名された秘密軍事情報
の保護のための秘密保持の措置に関する日本国政府とアメリカ合衆国政府との間の協定（以
下「日米協定」という。
）
。
４．日本国防衛省及び大韓民国国防部が相互に秘密情報を共有する意図を有するときは、そ
れぞれはこの取決めに基づき、アメリカ合衆国国防省に当該秘密情報を提供することによっ
てこれを行うことができる。当該情報は、日米協定及び米韓協定に従って扱われ、保護され
る。また、当該情報はこの取決めの他の参加者に共有する秘密情報であって、関連する二国
間協定に従って適切な保護を必要とする秘密情報であることが明示される。
５．アメリカ合衆国国防省は、当該秘密情報を受領した後、当該情報に対して、当該情報の
秘密区分と同等のアメリカ合衆国政府の秘密指定を行い、実行可能な範囲で、当該アメリカ
合衆国政府の秘密指定を表示し、この取決めに基づき共有される秘密情報であることを明ら
かにする意図を有する。アメリカ合衆国国防省は、大韓民国国防部に提供する日本国からの
秘密情報については米韓協定の規定及びこれに定める保護措置に従って、また、日本国防衛
省に提供する大韓民国からの秘密情報については日米協定の規定及びこれに定める保護措置
に従って、当該秘密情報を他の参加者と共有する意図を有する。この方法により、日本国及
び大韓民国からの秘密情報は、適用される範囲内で、第三国との情報共有に関する規定を含
め、日米協定及び米韓協定の規定や保護措置に従って、全ての参加者の間で共有することが
できる。
６．参加者はこの取決めの文書全体を公表する意図を有する。
７．この取決めは、北朝鮮による核及びミサイルの脅威に関する秘密情報の交換に適用し、
また、日米協定及び米韓協定の中に含まれる保護の要件に対し適用する。
８．この取決めは、国際法及び各参加者に適用される国内法令の下で、法的な拘束力を与え
ることを意図するものではない。参加者は、既存の国際約束に基づくそれぞれの権利及び義
務に影響を与えることを意図しない。参加者は、各参加者に適用される国内法令に従ってこ
の取決めを実施する意図を有する。
９．この取決めは、最後の参加者の署名の日に運用を開始し、一の参加者が他の参加者に対
しもはやこの取決めに参加する意図を有しないことを通知するまでの間運用される。参加者
は、参加を取りやめる旨の決定について、事前に書面により通知する意図を有する。いずれ
の参加者による参加終了の決定にかかわらず、この取決めに基づき共有された全ての秘密情
報は、適用される範囲内で日米協定及び米韓協定に従って引き続き保護される。
日本語、英語、韓国語による本書３通に署名した。それらはひとしく正式である。翻訳に
相違がある場合は、英語による。

TRILATERAL INFORMATION SHARING ARRANGEMENT
CONCERNING THE NUCLEAR AND MISSILE THREATS POSED BY NORTH KOREA
AMONG THE MINISTRY OF NATIONAL DEFENSE OF THE REPUBLIC OF KOREA,
THE MINISTRY OF DEFENSE OF JAPAN,
AND
THE DEPARTMENT OF DEFENSE OF THE UNITED STATES OF AMERICA
The Ministry of National Defense of the Republic of Korea (“MND”), the Ministry of Defense of
Japan (“MOD”), and the Department of Defense of the United States of America (“DoD”) (each a
“Participant,” and collectively the “Participants”);
Having a mutual interest in the sharing of classified information;
Concur in the following:
1. The Participants intend to establish a mechanism to enable the sharing of classified information
concerning the nuclear and missile threats posed by North Korea.
2. Classified information exchanged under this Arrangement may be in any form, including oral,
visual, electronic, magnetic, or documentary form, within the definitions of information covered by
existing bilateral information sharing agreements that the Government of the Republic of Korea
(the “ROK”) and the Government of Japan (“Japan”) each have with the Government of the United
States of America (“U.S.”), described in paragraph 3.
3. The Participants intend to protect any classified information that is shared among them under
this Arrangement pursuant to the following bilateral agreements: the Security Agreement between
the Government of the Republic of Korea and the Government of the United States of America
governing the Protection of Classified Military Information signed at Washington, D.C., on
September 24, 1987 (the “U.S.-ROK agreement”); and the Agreement between the Government of
the United States of America and the Government of Japan concerning Security Measures for the
Protection of Classified Military Information, signed at Tokyo on August 10, 2007 (the “U.S.-Japan
agreement”).
4. When MND and MOD intend to share classified information with each other, each may do so
under this Arrangement by providing such classified information to DoD. Such information is to be
handled and safeguarded in accordance with the U.S.-ROK agreement and the U.S.-Japan
agreement and to be identified as classified information requiring appropriate protection to be
shared with the other Participants of this Arrangement in accordance with the relevant bilateral
agreement.
5. DoD intends, after receipt of such classified information, to designate the information with an
equivalent U.S. security classification and, to the extent practicable, to mark such information with
that equivalent U.S. security classification and identify it as classified information to be shared
under this Arrangement. DoD then intends to share such classified information with the other
Participant, subject to the terms and protections of the U.S.-ROK agreement with respect to Japanoriginated classified information to be provided to MND, and subject to the terms and protections of
the U.S.-Japan agreement with respect to ROK-originated classified information to be provided to
MOD. In this manner, Japan- and ROK-originated classified information may be shared among all
Participants, subject to the terms and protections, including those on third-party information
sharing, provided by the U.S.-ROK agreement and the U.S.-Japan agreement, as applicable.
6. The Participants intend to make the full text of this Arrangement public.
7. This Arrangement applies to the exchange of classified information concerning the nuclear and
missile threats posed by North Korea and the protection requirements contained within the U.S.ROK agreement and the U.S.-Japan agreement.
8. This Arrangement is not intended to have legally binding effects under international law or the
domestic laws and regulations applicable to any of the Participants. The Participants do not intend
to affect their respective rights and obligations under existing international agreements. The
Participants intend to implement this Arrangement in accordance with the domestic laws and
regulations applicable to them.
9. The Participants intend this Arrangement to become operative as of the date it is signed by the
last Participant and to remain operative until a Participant notifies the other Participants that it no
longer intends to participate in this Arrangement. The Participants intend to give advance notice in
writing of any decision no longer to participate. Notwithstanding a decision by any Participant to
terminate participation, all classified information shared pursuant to this Arrangement continues to
be protected in accordance with the U.S.-ROK agreement and the U.S.-Japan agreement, as
applicable.
Signed in triplicate in the English, Korean, and Japanese languages, the three texts being equally
official. In case of any divergence of interpretation, the English text should prevail.

대한민국 국방부, 일본 방위성, 미합중국 국방부간
북한 핵과 미사일 위협에 관한 3자 정보공유 약정
대한민국 국방부(“한국 국방부”), 일본 방위성 (“일본 방위성”), 미합중국 국방부(“미국 국방부”)
(각각 “당사자”, 전체적으로 “당사자들”) 는
비밀정보 공유에 대해 공동의 관심을 가지고 있으며
다음과 같이 동의한다.
1. 당사자들은 북한의 핵과 미사일 위협에 관한 비밀정보를 공유할 수 있는 체계를 마련한다.
2. 본 약정에 따라 교환되는 비밀정보는 본 약정 3조에 명시된 대한민국 정부(“한국”)와 일본
정부(“일본”)가 각각 미합중국 정부(“미국”)와 체결한 현행 양자 정보공유 협정에서 규정한 정보
에 대한 정의의 범위 내에서 구두, 시각, 전자, 자기, 또는 문서를 포함하는 어떤 형태로든 교환할
수 있다.
3. 당사자들은 다음 양자 협정을 근거로 본 약정상 당사자들 간 공유되는 모든 비밀정보를 보호한다.
1987년 9월 24일 워싱턴에서 서명한 ｢대한민국 정부와 미합중국 정부 간의 군사비밀보호에
관한 보안협정｣(“한･미협정”)과 2007년 8월 10일 도쿄에서 서명한 ｢미합중국 정부와 일본 정부 간의
군사비밀보호를 위한 보안대책에 관한 협정｣(“미･일협정”).
4. 한국 국방부와 일본 방위성이 상호 비밀정보를 공유하고자 할 때, 한국 국방부와 일본 방위
성은 본 약정에 근거하여 비밀 정보를 미국 국방부에 제공함으로써 비밀정보를 공유할 수 있다.
본 약정의 당사자들 간 공유하는 정보는 한･미협정과 미･일협정에 근거하여 취급하고 보호하며
관련 양자협정을 근거로 본 약정상에서 공유하기 위해 적절히 보호해야 할 비밀정보라고 고지
한다.
5. 미국 국방부는 공유된 비밀정보를 접수한 후 미국 비밀등급과 동일 수준으로 해당 정보를 지정하고,
가능한 해당 비밀정보에 동일 수준의 미국 비밀등급을 표시하여, 본 약정이 정하는 바에 따라 공유
할 수 있는 비밀정보임을 고지한다. 미국 국방부는 일본에서 생산하여 한국 국방부에 제공할 비
밀정보는 관련 한･미협정의 내용과 보호조항에 따라 다른 당사자와 공유하고, 한국에서 생산하
여 일본 방위성에 제공할 비밀정보는 미･일협정의 내용과 보호조항에 따라 다른 당사자와 공유한다.
이러한 방식으로, 한국과 일본에서 생산한 비밀은 한･미협정과 미･일협정에 명시된 제3자와의 정보
공유와 관련된 내용과 보호조항에 따라 모든 당사자들 간에 공유할 수 있다.
6. 당사자들은 본 약정 전문을 공개한다.
7. 본 약정은 북한의 핵과 미사일 위협에 관한 비밀정보의 교환에 적용되며 한･미협정과 미･일협
정에 명시된 보호조항을 적용한다.
8. 본 약정은 당사자들에게 국제법상, 국내법 및 규정상 어떠한 법적 구속력을 창출할 의도가 없
다. 당사자들은 기존의 국제 협정상 각자의 권리와 의무를 저해할 의도가 없다. 당사자들은 각자
의 국내법령과 규정에 따라 본 약정을 이행한다.
9. 본 약정은 당사자가 모두 서명한 날부터 유효하며, 어느 한 당사자가 본 약정에 더 이상 참여
하지 않겠다고 다른 당사자들에게 사전에 서면으로 통보하는 날까지 유효하다.
어느 한 당사자가 참여를 종료시킨다고 하더라도, 본 약정에 근거하여 공유된 모든 비밀정보는 관련
한･미협정과 미･일협정에 따라 지속적으로 보호된다.
정본인 한국어, 영어, 일본어로 동등하게 작성하고 서명하였다.
해석의 차이가 있을 경우 영어본을 우선시 한다.
