E.S.P., we wish to inform you of the reasons for which your company should not participate in the bid scheduled for May 19th: There are currently eight lawsuits—in various courts—against the sale of the electric power company ISAGÉN S.A. E.S.P., which are still pending. Four political parties (Polo Democrático Alternativo, Alianza Verde, Centro Democrático, Liberal), along with Representatives from other parties, which make up the majority of the Congress of the Republic, have demonstrated their opposition to the sale. Various social organizations, including the two most important trade unions in the country: the Central Unitaria de Trabajadores (CUT) and the Confederación General del Trabajo (CGT), as well as the unions of the company, Sintraisagén and Atrae, and the Network for Tax Justice in Colombia (Red por la Justicia Tributaria en Colombia), have for nearly two years been part of the Committee for the Defense of Isagén (Comité por la Defensa de Isagén), which opposes the sale. There have been public initiatives, forums, and a Public Hearing in Congress to express the rejection of the National Government’s decision to sell ISAGÉN. Accordingly, it is valid to assert that there is a generalized sentiment among the population against the sale of the company. Taking into consideration the aforementioned points, it is a risk for your company to purchase a company like ISAGÉN, as the transaction exposes you to possible litigation. Additionally, there is risk generated by the significant political and social opposition to the sale. It is for these reasons that we ask you to reconsider the purchase of ISAGÉN S.A. E.S.P., considering that a range of political, social, labor, and academic sectors demand that the electric power company remain in the State’s control.
