CHAPTER - 5 PUBLIC HEARING PROCEEDINGS After submission of Draft EIA/EMP and Executive Summary to all the offices directed, the “Public Hearing” was fixed on 30-10-2013 at 11.00 a.m. at Government Primary Health Centre, Roopangarh, District Ajmer. All the necessary arrangements including photography, Videography, power point presentation were made. Till the presence of Hon’ble ADM II Ajmer and Regional Officer, Rajasthan State Pollution Control Board, Kishangarh, no public person turned up. Only after they left few persons including Chairman, Nagar Palika, Parbatsar had reached to attend the meeting. The photographs depicting the arrangements and presence of Chairman, Nagar Palika Parbatsar are depicted : 1 2 Hon’ble ADM II Ajmer instructed for the re-conduction of public hearing at Gram Panchyat Paner. The copy of order sheet attendance sheet is enclosed with the letter of Regional Officer, RPCB, Kishangarh, Ajmer to Group Incharge, Mines, RPCB, Jaipur, as referred in next para. The facts with the annexures were forwarded by Regional Officer, Rajasthan State Pollution Control Board, Kishangarh, District Ajmer to the Group Incharge (Mines), RPCB, Jaipur vide letter No. RPCB/RO KSG/PH/3280 dated 01-11-2013. Mines/2778 dated 25-11-2013 copy is depicted 10 Attempts were made for re-conduction of public hearing on 20-12-2013 at 11.30 a.m. at Gram Panchyat Bhawan, Jajota, Tehsil Roopangarh, Distt. Ajmer. In previous order sheet Hon’ble ADM (II) Ajmer had instructed for re-conduction of Public Hearing at Gram Panchyat Paner. The fact that the mining lease area does not come under jurisdiction of Gram Panchyat Paner, but in the jurisdiction of Gram Panchyat, Jajota was brought in the notice of RO, RPCB, Kishangarh. Hence, re-conduction of public hearing was decided to be done at Gram Panchyat Bhawan, Jajota. RO, RPCB, Kishangarh had written letter No. RPCB/RO KSG/Ajmer/Public Hearing/3356 dated 11-11-2013 to the District Magistrate, Ajmer for necessary orders : 11 But the orders could not be issued by the District Magistrate, Ajmer and hence Public Hearing could not be conducted on 20-12-2013. RO, RPCB Kishangarh again requested to District Magistrate, Ajmer for reconduction of public hearing at Gram Panchyat Bhawan, Jajota Tehsil Roopangarh Distt. Ajmer on 04-022014 at 11.30 a.m. vide letter No. RPCB/RO KSG/Ajmer/Public Heating/4040 dated 18-122013. The copy of letter is depicted : 12 The matter of news paper notification was issued by The Regional Officer, RPCB, KIshangarh, Ajmer on 02-01-2014 vide letter No. jkizfue@{kSdk@fd’k-@jkt@ AM-1148/4230. The details of public hearing proceedings with phonographs and DVD of Videography were forwarded to Group Incharge (Mines) RPCB, Jaipur by the RO RPCB, Kishangarh vide letter No. RPCB/RO KSG/PH/5147 dated 26-02-2014. Description of Public Hearing Conducted on 04-02-2014 for Environment Clearance of Mining Project. Place : Gram Panchyat Bhawan, Village – Jajota, Tehsil Roopangarh, Distt. Ajmer Date : 04-02-2014 Time : Morning 11.00 Present : 1. Hon’ble Shri Raj Kumar Singh, Additional District Magistrate (II) (Representative of District Collector), Ajmer. 2. Hon’ble V.S. Sankhla, Regional Officer, Rajasthan State Pollution Control Board, Kishangarh, Distt. Ajmer (Raj.) As per the Public Notice of the Regional Office, Rajasthan State Pollution Control Board, Kishangarh Notice No. jk-iz-fu-e-@{ksdkfd’k@ih,p@, ,e&1148@4230&32 dated 02-01-2014 on schedule dated 04-02-2014 the public hearing for enhanced production from 10000 TPA to 0.1 MTPA Quartz and Feldspar (ML 9/97 – Lease Area 188.011 Hectors) approved by M/s. Pradeep Goyal was conducted at Gram Panchyat Bhawan, Jajota, Tehsil Roopangarh, Distt. Ajmer under Chairmanship of Shri Raj Kumar Singh, ADM (II), (Representtive District Collector) and Shri V.S. Sankhla, Regional Officer, Rajasthan State Pollution control Board, Kishangarh. The attendance sheet of motivated Government Officers, Residents of the area villages and others with signatures is enclosed (Annexure A & B). As required by rules, the notification of the Public Hearing was published in news papers Dainik Bhaskar on 03-01-2014 and Punjab Kesari on 03-01-2014. Photocopies of newspapers are enclosed. (Annexure C & D) . This public hearing has been conducted under Environment Protection Act.,1986 by the notification dated 14-09-2006 issued by the Ministry of Environment and Forest, Government India, New Delhi. Public Hearing was conduted near the Project site (about 3 Kms. from Project site) at Gram Panchyat Bhawan, Village Jajota, 23 Tehsil Roopangarh, Distt. Ajmer on 04-02-2014. Video recording CD and Photofraphs of the Public Hearing are enclosed (Annexure E & F). Starting the proceedings of Public Hearing the Regional Officer Shri V.S. Sankhla explained the objects, importance and provisions of the Public Hearing and requested the present people to submit their verbal/written views and expectations regarding the project. Dr. Subhash Goyal, Technical Advisor for the project of M/s. Pradeep Goyal village Paner Teshil Kishangarh, District Ajmer explained in detail the different aspects of the project of production enhancement. He also presented the Environment Pollution Control and Environment Protection Steps to be taken by M/s. Pradeep Goyal, Village Paner, Tehsil Roopangarh, Distt. Ajmer. Then after the Regional Officer, Rajasthan State Pollution Control Board, Kishangarh invited the suggestions and objections from the people present. Shri Nanu Ram R/o. Village Khajpura present in public hearing narrated that charagah is included in the lease area difficulty in the grazing of cattle, sheep and Goat of the local residents which is the Chief means of livelihood/ earning of the local population. Charagah will be damaged/ will be finished by the mining work in lease area. This will cause difficulty for grazing of cattle hence mining permission should not be granted to this lease This was the opinion of all the residents of village Khajpura and Bhairwai. Except this all the villagers narrated that in addition to this lease government has received 800 application for granting the leases of Cheja Pathar. ADM directed the Tehsildar, Roopangarh present in the meeting to go to the lease area with the local villagers and to demarcation charagah land in the lease area to the villagers. Tehsildar was directed to prepare on the spot written report. The spot report of Tehsildar in enclosed (Annexure “G”). Three written representation were received during public hearing which are enclosed at annexure H, I , & J. In the end public hearing was concluded by thanks to all the attending population and the Regional Officer declared the conclusion and end of Public Hearing Enclosed Annexure as above sd (V.S. Annexure “F” are the photographs forwarded, which are ad under : 30 31 32 33 34 35 36 37 38 39 ` 40 41 ` 42 43 44 The minutes of public hearing alongwith all the documents, photographs and videopgraphy (DVD were forwarded by the Member Secretary, RPCB to the MOEF video letter No. F12 (1-130)/RPCB/Kishangarh/Gr. Mines/4369 dated 19-03-2014. Copy is depicted below : 45 ANALYSIS OF FACTS OF PUBLIC HEARING 1. Shri Nanu Ram R/o. Khajpura stated that since grazing land is included in the lease area, sheep and Goat etc of local residents are Grazing in the area. Hence, the lessee should not be granted permission for mining. 2. The same Bhairwai. 3. All the villagers stated that except this lease government has received 800 application for grant of leases of Cheja Pathar. No body should be granted mining lease here. 4. The ADM II had instructed the Tehsildar, Roopangarh to go to the lease area with villagers and to delineate the boundaries of the lease and the charagah. The Tehsildar, Roopangarh was instructed to prepare the inspection spot report which is included at “G” of the minutes. The report depict : opinion was expressed by present residents of Khajpura and Annex. “G” spot report of the Tehsildar Roopangh depicts : 5. i) Khasra numbers of the mining lease with total lease area of about 1250 Bhigas have been shown. ii) Presently mining is closed. Previously waste material was stacked in mining lease area. Some waste material is lying out side lease area which is very old. iii) Total charagah land of Khajpura and Bhairwai is depictged to be 326.18 Bigha and 25.13 Bigha respectively. Out of this only about 40 bhiga of charagah land is included is mining lease, but no mining work has been done in this charagah land. iv) Plantation has been done in the lease area. v) On the back side the khasra numbers included in lease area are depicted. Mining waste is being stacked in lease area. Some waste material is lying outside lease area which is old. Three written representations were received during public hearing included at H.I.J. of the minutes : h) States that no new leases must be granted in the area. Clearly it is depicted that the villagers have no objection to present mining lease. 46 i) From villagers of Bhairwai stating that no mining lease should be granted in revenue boundaries of Bhairwai because problem for grazing will be created. Expressly this is against the proposed delineation of mining leaser of cheja a Pathar as included in column 3 above. j) No leases should be granted in the hills of revenue boundary of the village Khajpura due to creation of problem for Granzing of cattle. Again this is against the delineation as included in para 3 above. FROM THE ABOVE ANNEXURES IT IS EVIDENT THAT 1. There is no objection to the operation of existing mining lease Annexure – H.I.J. 2. The report of the Tehsildar Roopangarh Annexure G depicts that (i) only about 40 Bighas of Charagah land is included in mining lease. No mining operation has been conducted over this included Charagah. i) Mining waste/overburden has been stacked with in lease boundary. ii) Some mining waste is lying outside lease boundary which is very old, probably created by unauthorized mining. 3. Anxiety is for Grazing of cattle was reveled / expressed. In the matter it was submitted that no restrictions for grazing of cattle had been imposed in the post. Assurance was given that in future life of mine no restriction will be imposed for grazing, rather plantation by local species/edible species will increase the availability of fodder. 4. Thus no objection was received for the existing mining lease. 5. The concern /Anxiety was against the grant of new leases annexure - H, I. J. This relates to the matter of “Delineation of mining leases of cheja pathar” to the mining lease and quarry licence holders displaced from Jhalana Doongri, Jaipur. About 200 mining leases have been delineated to be granted to them. Any such allotment/delineation of mining leases of Cheja Pathar has been opposed by the villagers. To conclude there is no objection against the mining lease. For the concern of grazing of cattle presented by the villagers, expressly it is made clear : 47 1. No restriction on the entry and grazing of cattle has been ever imposed. 2. No such restriction on the entry and grazing of cattle will ever be imposed. 3. Plantation of edible grass and edible species of trees will be done ever the included charagah land with the consent of Gram Panchyat 4. Plantation over the mining lease area will also increase the avaiablilty of fodder for the cattle. 48
