Disadvantaged Business Enterprise
(DBE) Requirements
• To be determined responsive, a proposer must
demonstrate in its proposal that it:
(1) will meet the 15% DBE participation goal for
this project, or
(2) performed good faith efforts to meet the goal
• A proposer that is not responsive to either of
these requirements shall be ineligible for the
award of the contract
Meeting the DBE Goal
•
Firms listed to meet the DBE goal must be certified on proposal due date
•
DBEs may participate as a prime contractor, subcontractor, lower-tier
subcontractor, joint venture partner, or supplier
•
DBEs must perform a commercially useful function, i.e., must be
responsible for the execution of a distinct element of work and must carry
out its responsibility by actually performing, managing and supervising the
work
•
DBE suppliers will receive a credit of 60% of the listed amount towards
meeting the DBE goal
•
DBE brokers will receive the entire amount of fees or commissions earned
Good Faith Efforts
• Only evaluated if DBE goal not met (but
should submit anyway)

Who Qualifies for the DBE Program
• A DBE is a for-profit, small business concern means a
for-profit small business concern 1) That is at least 51 percent owned by one or more
individuals who are both socially and economically
disadvantaged or, in the case of a corporation, in
which 51 percent of the stock is owned by one or
more such individuals; and
(2) Whose management and daily business
operations are controlled by one or more of the
socially and economically disadvantaged individuals
who own it.
