Modern Award –
Building and Construction General On-site Award 2010
This award covers employers throughout Australia of employees in the on-site building, engineering and
civil construction industry and their employees.
The rates of pay and allowances contained within are effective 1 July 2014.
The Building and Construction General On-site Award 2010 is a single national industry award that
applies to all on-site residential and commercial construction work. The classes of work covered by the
Award include:

general building and construction;

plant operation and earthmoving;

landscaping;

civil construction; and

metal and engineering construction.
There are four employment categories types within the award:
1. Daily hire employees – employed on daily arrangements.
Weekly hire employee, including:
2. Full-time weekly employees (including apprentices) – employed for 38 ordinary hours per
week.
3. Part-time weekly employees – employed to work an average of fewer than 38 ordinary hours
per week and have reasonably predictable hours of work.
4. Casual employee – paid casual loading of 25% of ordinary hourly rate for minimum of 4
hours engagement. Refer to clause 14.

Description
For a 38 hours per week, worked between 7am to 6pm, Monday to Friday
(except for shift work).
Eight hours for every ordinary worked day, 0.4 of an hour on each day with
accruing towards the twentieth day, which will be taken as a paid day off.
For General building and construction and metal and engineering construction:
Ordinary time plus 50%;
- Afternoon shift; finishing between 9pm and before 11pm.
- Night shift; finishing between 11pm and before 7am.
Ordinary time plus 25%:
- Morning shift; finishing after 12:30pm and before 2pm.
- Early afternoon; finishing after 7 pm and before 9pm.
For Civil Construction:
- Day shift; starting on or after 6am and before 10am.
- Afternoon shift; starting at or after 10am and before 8pm.
- Night shift; starting at or after 8pm and before 6am.
- Rostered shift; with at least 48 hours notice..

A cessation of working time each day for at least 30 minutes taking between
noon and 1.00 pm or as otherwise agreed between parties if employees works
more than five hours.
Employers may require employees to work outside the ordinary hours so long
as it is reasonable and according to the following conditions:
- Monday-Friday work beyond ordinary times – 150% for the first two hours
and 200% thereafter.
- Public holidays or substituted days instead thereof – 250% for all time
worked (minimum of four hours).
- Saturdays – 150% for the first two hours and 200% thereafter, provided that
all work after 12 noon is at 200% (minimum 3 hours).
- Sundays – 200% for all time worked (minimum 4 hours).
Where an employee works so much overtime that they do not receive 10
consecutive hours off work before the start of their next ordinary hours, they
shall continue to get paid 200% until they receive such time off work.
No employee under 18 years will be required to work overtime or shiftwork.

Leave and public holidays – Part 6

An employee is entitled to 10 days of paid personal/carer’s leave which accrues
progressively during a year of service.

Award Flexibility – Clause 7
In accordance with clause 7 an employer and employee may agree to vary the following terms of the
award to suit the individual needs of the employer and employee:
(a) arrangements for when work is performed,
(b) overtime rates,
(c) penalty rates,
(d) allowances, and;
(e) leave loading.
The agreement between the employer and the individual employee must:
1. be confined to a variation in the application of one or more of the terms listed above,
2. not disadvantage the individual employee in relation to the individual employee’s terms and
conditions of employment, and;
3. be in writing.
If the individual is under 18 years of age, the employee’s parent or guardian must sign the agreement.
The agreement does not need to be lodged, however the agreement must ensure that the employee is
‘better off’ under the varied conditions of engagement.

- Construction Skills Test in accordance with RPL principles; or is a
- Special Class Engineering construction tradesperson (electrical/electronic/mechanical/fabrication) level III; or who
has completed
- Ten and a half appropriates modules towards an Advanced Certificate/Diploma, or in addition to the requirements
of ECW3; or
- any training which a registered provider or state training authority has recognised as equivalent; or
- equivalent work experience subject to competency testing to the prescribed standards.

Level 8

A level 6 employee works in one or more skill streams within this award. An employee at this level will have
successfully completed:
- relevant structured training in addition to the requirements of level 7; or
- Construction Skills Test in accordance with RPL principles; or is a
- Advance engineering construction tradesperson (electrical/electronic/mechanical/fabrication) level I; or who has
completed
- twelve appropriates modules towards an Advanced Certificate/Diploma; or
- any training which a registered provider or state training authority has recognised as equivalent; or

An Advanced engineering construction tradesperson level II is an
- Advanced engineering construction tradesperson (mechanical/fabrication) level II, who has completed:
- An Advanced Certificate; or
- Fifteen appropriate modules of an Associate Diploma; or
- Fifteen appropriate modules in addition to the requirements of CW/ECW 3; or
- any training which a registered provider or state training authority has recognised as equivalent; or
- equivalent work experience subject to competency testing to the prescribed standards.
