Greetings!
I hope everyone enjoyed their summer. As the
season winds down it is always nice to
remember the fun times had over the past
months, but also look forward to what the next
year holds.
I have taken a lot of time the past month
traveling across the state and visiting with our
Don Hall
dealers. I love seeing how our dealers put their
customers first - just as we put our members first. It is a great sight
to see people do what they love and make a difference in someone's
day.

We are also looking forward to the 2015 legislative schedule. It is
shaping up to be a good session and VADA is eager to represent its
members in front of legislators.
It has been a great few months and I am sad to see the warm days
winding down - but I am also excited to see what the cooler months
have to offer.

Programs
Employers frequently ask about the
obligations imposed by the
Americans with Disabilities Act
("ADA") for a "reasonable
accommodation". The ADA requires
employers to provide a reasonable
accommodation for an employee's
disability unless doing so would
impose an undue hardship on the
business. A reasonable
accommodation can include
assistance or changes to the work environment such as addition of
or changes to equipment, changing the work space, adjusting
schedules, or similar sorts of flexibility to permit a worker to perform
the essential functions of a job.
But must an employer make a reasonable accommodation to allow
employees to work from home?
A recent case in the United States Court of Appeals for the Sixth
Circuit, which covers Kentucky, Michigan, Ohio, and Tennessee,
ruled that a reasonable accommodation required by the law can
include telecommuting where the employer cannot show that the
employee's physical presence is an essential function of the job.

Each fall the members of the Greater Richmond New Car Dealers
Association work together to help eliminate hunger in the Richmond
Metro area. This process kicks off with our GRNCDA Golf Classic at
the end of September, and throughout the month of October,
dealerships have boxes in their showrooms and service bays to
collect food - ending with a check presentation at the Greater
Richmond Food Bank.
Last year the GRNCDA
was able to raise
$39,863 and donated
5,063 lbs of food - good
enough for 204,368
meals for those in need!
VADA is extremely proud
of its Richmond dealers,
and encourages everyone
throughout the state to get
involved with local charities of your choice - it is our duty to support
the community that supports us.
Keep up the good work , and let us know of any great community
outreach stories you may have!
VADA GSIA returns $1.4 million to
members; reduces rates
The VADA Groups Self Insurance
Association (VADA GSIA) was
excited to once again return a
dividend to our members. This year
we returned $1.4 million to our
members bringing the total
approved for the past 6 years to
$14.3 million! Whereas we return
this to our members, a private insurance carrier would keep this as
profit.
We are also pleased to report that the Bureau of Insurance approved
our request to reduce our Loss Cost Multiplier with effectively lowers
the premiums we charge our members. We believe this makes us
the most competitive program for dealers in Virginia while still
providing us with solid financial stability.
VADA GSIA is proud to represent more than two-thirds of Virginia
dealers for their workers compensation insurance needs. Together
we continue improve workplace safety and reduce workers
compensation costs to Virginia's dealers!

FTC Buyers Guide:
How Well Do You Know the Requirements?
The FTC buyers guide has been around for so long that many dealers take
for granted that their personnel understand the requirements. That can be a
costly mistake.
Like the cash reporting rule enforced by
the IRS, the Used Car Rule enforced by the
FTC is regularly the subject of compliance
sweeps leading to consent orders with a
number of dealers in a geographical area.
The FTC is considering changes to the
FTC buyers guide, but dealers should not
assume that the FTC will relax its
enforcement efforts until the changes are announced. Buyers guide
compliance should be a part of a dealer's compliance program.
So how well do your personnel know the FTC Used Car Rule? Here's a
short quiz to find out.
Answer whether a statement is True or False.
1. I can put the completed buyers guide in a clear plastic sleeve that I
hang from the rear view mirror.
2. I have a customer who wants to take a test drive and he wants me to
remove the buyers guide from the side window because he feels it is
not safe with his family in the car. I must leave the buyers guide on
the car until it is sold.
3. The FTC Used Car Rule requires customers to sign a copy showing
that they received the buyers guide.
4. There is one buyers guide form to be used throughout the United
States.
5. If the transaction is conducted in Spanish, I cannot just provide a
copy of the filled-in Spanish language form to the customer to
replace the English language form that was on the car after we
agree on the terms of the deal. The Spanish language version must
be on the vehicle when the vehicle is on my lot.
6. I must have buyers guides on the used vehicles for retail sale on my
front lot. The vehicles on my back lot that are not yet ready to go on
the front lot do not need buyers guides.
7. I have three cars on consignment. I must display a buyers guide on
each one.
8. I know that the manufacturer's warranty still applies to the used car
I am offering for sale. I may simply mark "balance of factory
warranty"

9. With today's smaller cars, I can reduce the buyers guide somewhat
so that it will fit on the rear side window of the vehicle.
10. If the customer and I negotiate a change in the warranty described
on the buyers guide, it must be noted on the buyers guide.

The AAA's Consumer Clause Registry
As of September 1, 2014, The American Arbitration Association
(AAA) requires any business that provides for or intends to provide
for the AAA to administer its consumer arbitrations to register the
business's consumer arbitration clause with the newly-created
Consumer Clause Registry. AAA developed the Registry to provide
public access to information about the AAA's consumer arbitration
services. The Registry will provide a list of businesses whose
arbitration clauses the AAA has determined substantially and
materially comply with the due process standards of the AAA's
Consumer Due Process Protocol.
The Procedure
Dealers who intend to have the AAA administer consumer arbitration
must submit their clauses accompanied by the consumer review and
registry fee. The AAA will review the submitted clause. If the AAA

determines that the submitted clause complies with the Consumer
Due Process Protocol, the AAA will administer consumer-related
disputes filed using the consumer clause. The publicly accessible
Consumer Clause Registry will include the dealer's name and
address, the consumer arbitration clause, and any additional
documents that may be related to the clause.
