This column will explain that process. If a claimant is determined at any step not to meet that particular step’s requirement, then the person’s claim will be denied. These steps are summarized below. There are exceptions of course, but for purposes of a general overview, these are the broad outlines of the SSA’s sequential disability evaluation process. Step One - Is the claimant engaging in Substantial Gainful Activity? (SGA) The SSA determines if the claimant is working and the amount of income he is earning. In 2014, if a non-blind claimant is earning above $1070 per month or a blind claimant is earning over $1800 per month, then the SSA will presume he is capable of SGA and his claim will be denied at this step. In other words, if you are working and earning above SGA, no matter how sick you are, your claim will be denied. If the claimant is not earning SGA then the SSA goes to step two. Step Two: Does the claimant have a medically determinable impairment that is “severe” or a combination of impairments that are “severe”? An impairment is considered severe if it significantly limits a person’s ability to perform basic work activities. These impairments can be physical or mental impairments. If the person does not have a severe impairment then his claim is denied. If the claimant has a severe impairment then the SSA goes to step three. Step Three: Does the claimant’s impairment or combination of impairments meet or medically equal the criteria of the SSA’s Listings of impairments? The SSA Listing’s describe most major medical conditions and establish clinical findings and symptoms that must be met before the claimant will be determined to have met the Listing. The Listings also describe the length of time the impairment must have been in existence. If the claimant’s impairments meet a Listing, then the claimant is determined to be disabled. If the claimant does not meet a Listing, then the SSA has to determine the claimant’s “Residual Functional Capacity” (RFC). The RFC is the claimant’s remaining ability to perform physical and mental work activities on a sustained basis despite the limitations imposed by the claimant’s impairments. Step Four: Does the claimant have the RFC to perform the requirements of his past relevant work? (work performed in the last 15 years) If the claimant has the RFC to do his past relevant work, then the claimant is not disabled. However if the claimant is unable to do any past relevant work, or does not have any past relevant work then the SSA moves on to Step 5. Step Five: Can the claimant do any other work considering his RFC, age, education, and work experience? If the claimant is able to do some other type work, then the claimant is found to be not disabled.
